0px;box-sizing: border-box;">作为一个地地道道的农村人，崔建远是由于一个偶然的契机成为了村里的民办教师:因为在一次公社大会上给民兵连长写稿被赏识，就获得了村里唯一的教师空缺。后来他又被教导主任郭希圣老师力主调到自己读过的高中当语文老师，仅有中学文凭，却要硬着头皮教高中语文，崔建远没有畏缩，借此机会在语法、修辞和逻辑知识上获得很大提高。</p><p border-box;">1977年恢复高考，通知下达距离考试时间仅剩一个月，崔建远还对要考什么专业毫无头绪。学校里很多老师给他支招，有的劝他考数学，有的劝他考物理，最终崔建远选择了自己教过的语文。但是从来没学过历史和地理让他很头疼，还是一位教过他外语的田庆贺老师拿出自己多年前用过的辅导资料帮他恶补，最后顺利通过了高考。</p><p style="white-space: border-box;">最初填报志愿的时候，法律系离崔建远还很遥远，起初他填的是吉林大学经济系，后来有一个通知说民办教师报师范院校会被优先录取，一门心思只想上大学的崔建远把第一志愿改成了河北师大中文系，以为能优先录取。没想到，作为第一批录取院校的吉林大学因为法律系招生名额不满，就把分数较高的崔建远直接挑走。所以他学法律纯属偶然。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"> </p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">上大学之前，崔建远对于法律只有两个直观的印象，一个是在农村的时候判刑都要通过村民讨论，所以“谈到法律，就是枪毙”。另外一个印象来自于中学政治老师上课时讲过的1954年宪法修改。所以当他打开录取通知书，看到自己被吉林大学法律系录取，虽然沉浸在能上大学的喜悦感中，但心里其实在嘀咕、忐忑。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"> </p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">从接触法律，到逐渐了解、喜欢上法律，中间的过程有难以想象的痛苦。刚上大学时，崔建远每天上课时最难避免的是睡觉。课堂上完全陌生的法理学让他理解困难，从中学毕业到上大学，中间隔了四年，“脑子都锈住了”。另外晚上担心明天上课又睡觉便决心睡好，越担心越睡不着，陷入“晚上失眠，上课睡觉”的恶性循环，所以那段时间很苦恼。最后一个在长春的亲戚奶奶的妹妹一家给崔建远做思想工作，让他挺了过来，“没有他们一家，我可能说不定就真的回家休学了。”</p><p border-box;">20世纪70年代恢复高考时，全国只有三所学校招收法律专业：北京大学、吉林大学、还有当时的湖北财经学院。中国法律学界的状况可谓是一片荒芜。崔建远所在的77级是第一批法律系的学生，无疑是带有使命的一批学生。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"> </p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">让崔建远记忆深刻的是，当时他所在的吉林大学的校长是唐敖庆老师，是从清华大学抽调到吉林大学的著名理论化学家，崔建远与清华的缘分自此开始。在77级开学典礼上，唐熬庆老师在吉林大学的理化楼里主持，灯火通明，掌声雷动，那时候的新生都觉得未来、天下是他们的了，一定要学好，干出一番事业来。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"> </p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;">崔建远也是其中一员。到了研究生阶段，由于父亲想让他以后到机关工作，在他的毕业意向里，自然就不想留校，想去机关。但由于个人学习努力、系里缺少教师，系领导坚决想让崔建远留校任教。“我记得系领导就说这是命令，不服从分配就发回原籍，原籍是农村，不想回去，就服从分配。其实现在想想，系领导肯定是吓唬呢，他能给你发回原籍吗，但是当时比较傻，信以为真，就留下了。不过今天看，这是一个最好的毕业去向。”</p><p border-box;">在本科阶段上民法课的时候，主讲民法的是苏惠祥老师，他说全国只有22个民法的教师，民法领域十分需要人才。崔建远想，他的智商跟常人一样，在强大的阵容里日子不会好过，但在当时全国的22个民法教师里面，竞争应该不会那么激烈。不过，促使他选择民法研究的核心因素还是因为民法和日常生活息息相关，吃饭、睡觉、穿衣都绕不开民法，老百姓需要民法。</p><p border-box;">事实上，77级法律专业的学生在中国法律历史上起到了拓荒的作用。他们拥有得天独厚的条件——断代，从60年以前到现在，很长的时间没有人才。他们成长得很快，无论是政治觉悟还是业务水平，都明显地让人放心，很踏实肯干。李克强总理是北大法律系77级的，现在最高人民法院的院长周强是西南政法78级的，和崔建远一样，他们都是中国法律改革开放后的拓荒者。</p></section></section></section><section border-box;">在全国人大决定立《合同法》，废掉三个旧的相关法律时，先找到了研究民法的老前辈们。老先生们高风亮节、提携后学，决定做顾问，推荐了包括崔建远在内的一批年富力强的学者来做这件事：由法学前辈江平老师担任合同法起草组的组长，梁慧星老师任副组长，两个法官，六个学者组成了合同法立法方案（草案）起草小组，确定起草合同法按什么理念、依什么原则、分几章、规定什么内容。</p><p border-box;">立法方案（草案）通过后，法工委组织14家单位分头起草合同法条文并提出立法理由，分给吉林大学法律系及崔建远的任务是要写“合同的解除”和“合同的终止”两章。崔建远和两个学生王轶、杨明刚就两章的内容写了一年多，他们依据我们国家过去在这方面内容的规定以及几个发达国家和地区的法律条文及其学说，结合中国现实及研究状况来决定条文内容的生成。</p><p border-box;">在《中华人民共和国合同法学者建议草案》完成并提交给法工委后，学者和法工委之间两者的博弈很有意思，每个人都据理力争。“在这个场合没有谦虚的，都要把自己最拿手的表达出来，当然态度要好。尤其老先生很有修养，即使意见跟你针锋相对，也不吹胡子瞪眼。领导也是，我们怎么争，怎么批评全国人大，他不生气，他也不反驳你，就坐那儿听。现在回想起来，那时候那些领导、老先生们真是很可敬。”</p><p
