扎克伯克被轮番“拷问”10小时,遭遇职业生涯最大挑战,身价却上涨了!

美国当地时间10日、11日,脸书(Facebook)首席执行官马克·扎克伯格来到国会,参加为期两天的国会听证会(congressional hearing)。



Facebook CEO Mark Zuckerberg testified before the US Congress twice this week in response to last month’s Cambridge Analytica data fiasco and is without question the largest scandal the social giant has ever faced.

本周扎克伯格两度出席美国国会听证会,就上个月剑桥分析公司数据泄露作出回应,而这无疑是该社交媒体巨头迄今为止遭遇的最大丑闻。

小扎一改往日牛仔裤、灰T恤的随性休闲装,换上西装,打上领带,连着两天接受近百位议员的轮番提问。



He faced questions from 44 senators Tuesday, and took more from 55 members of Congress on Wednesday about everything from Facebook's data collection practices to how the site should be regulated in the US.

10日,他接受44位参议员的问询,11日接受55位议员的问询,内容从脸书的数据收集运作到脸书应在美国受到的管制。

The notes were extensive and not only covered issues of data-scraping, data-safety, and matters surrounding disturbing content on the platform, but also broader issues of diversity, competition, Facebook's business model, Apple's business model, and "Election Integrity."

笔记内容广泛,不仅涉及数据擦除、数据安全和平台上令人不快的内容等诸多事宜,还有关于公司人员多样性、行业竞争、脸书商业模式、苹果公司商业模式以及美国选举的诚实性等内容。


总体来说,第一场听证会议员们的火力并不算猛,没有对小扎构成太大威胁。

甚至有不少媒体坦言,这场听证会是失败的。


CNN:参议院搞砸了扎克伯格听证会


文章说,议员们的问题根本没有切中要害。


As a result, the issue that was supposed to be the focus of the hearing -- "social media privacy and the use and abuse of data," as Sen. Chuck Grassley put it -- was but one among many. And at the moment when the country needed a smart conversation about privacy, what it got was meandering questions and misfires.

结果就是,正如参议员查克·格雷斯利所言,本应作为本次听证会焦点的“社交媒体隐私,数据的使用及滥用”问题,仅仅成为了众多问题中的一个。当前美国需要针对隐私问题机敏的讨论,但结果是收获一众散漫闲聊问题,未达到预期效果。



还暴露出了众多议员对先进技术的无知……

So, how do you sustain a business model in which users don’t pay for your service?

用户不用付钱,这样的商业模式你们怎么维持下去?

Senator, there are some very strong Chinese internet companies.

参议员先生,中国有很多非常强的互联网公司。


场面透着一丝尴尬的味道,参议员说,“不过,你回答‘是’就得了呗……”

我很欣赏小扎,他有那么老多钱,仍然看起来像是老妈给剪得头发一样。

不过,第二场听证会就没那么轻松了,火力非常集中,问题也更尖锐。



扎克伯格在第二轮听证会中,面对更尖锐的问题



第二轮提问的议员们做足了功课,一开始就火药味十足:


Near the start of Wednesday's congressional hearing, New Jersey Rep. Frank Pallone, Jr. asked Zuckerberg why Facebook didn't just automatically set all users' default settings to minimize data collection. That would mean Facebook's users would have to opt in if they wanted to share their personal data, rather than opt out, which is the way it works today.

周三国会听证一开始,新泽西州众议员弗兰克·帕隆便询问扎克伯格,为何脸书没有对用户默认设置进行自动设定,从而尽可能减少数据采集量。这意味着脸书的用户如果想要分享个人数据,需自行加入,而并非按照如今的方式,需要用户自行退出分享。


小扎的回答也没能让议员感到满意:


"That is a complex issue that deserves more than a one word answer," Zuckerberg responded. 

“这是个复杂的问题,不是一两个字能回答的,”扎克伯格说。


Pallone's response, "That's disappointing to me."

“这令我很失望。”帕隆如是答道。


有议员矛头直指扎克伯格,问他自己的个人数据有没有被卖掉:


California Rep. Anna Eshoo asked Zuckerberg if his own data was swept up in the Cambridge Analytica scandal. 

加州众议员安娜·埃肖奥则询问扎克伯格,他自己的个人数据是否也卷入了剑桥数据丑闻当中。



扎克伯格表示,自己的数据也被卖了。


两场听证会下来,一些美国媒体认为,扎克伯格对一些问题没有老实回答,而是在打躲避球(dodge),搪塞了过去。


最大的一个特点就是他说了大量的“following up to do”(做些跟进)


But Zuckerberg frequently gave vague answers and often told members of Congress his team would follow up with them at a later time.

但是扎克伯格经常给出些模糊不清的答案,经常和国会议员们说,他的团队接下来会做一些跟进。


参议员约翰·图恩(John Thune)就表示,一定要警惕扎克伯格这种声东击西的战术(diversion tactic)



"Mr. Zuckerberg's answered a lot of questions today ... but there are also a lot of promises to follow up with some of our members and sometimes on questions about Facebook practices that seem fairly straightforward,"

扎克伯格今天回答了不少问题,但是对我们提出的问题,他承诺了不少“跟进”,包括一些关于公司运作的非常简单的问题。


据CNN盘点,下面这些问题,扎克伯格并没有给出正面回答:

   

Does Facebook track your internet activity outside the app?

脸书会在应用之外追踪用户的上网行为吗?


扎克伯格回答说:


"Senator, I want to make sure I get this accurate, so it would probably be better to have my team followup afterward." 

参议员,我希望给您更精确的答案,所以我最好还是之后请团队来跟进。


在参议员的施压下,他回答说:


"I know that people use cookies on the internet, and that you can probably correlate activity between sessions."

我知道大家都在网上用cookies,因此在关停期间可能也会关联到一些行为。

他表示,脸书这样做有安全预警、确保广告有效投放等用意。又表示“我们跟进后给您完整答案”(follow up with him with a full answer)


然而,后来的问询中,他承认了即便用户不登录脸书,也能追踪他们的信息。

   

Who is Facebook's biggest competitor?

谁是脸书最大的竞争者?


共和党参议员格雷厄姆(Graham)就这一问题向扎克伯格提问:


"You don't think you have a monopoly?" Graham asked.

你认为你没有垄断吗


扎克伯格回答说:


 "It certainly doesn't feel like that to me."

对我来说确实不是这样的。


He said that Americans use an average of eight apps to communicate. "There is a lot of competition that we feel every day," Zuckerberg said.

扎克伯格说,美国人平均用8个应用来交流。他说“我们每天都要面临很多竞争对手。



然而,CNN补充说,脸书占据苹果Appstore中10大免费下载应用的前三:Facebook, Instagram和Messenger。嗯,还有Whatsapp也是脸书的……

   

If I delete Facebook, how long will it take for Facebook to purge my data?

如果我删了脸书,它多久会清除我的数据?


对于这个问题,扎克伯格的答案是“不知道”。


"I don't know the answer to that off the top of my head. I know we try to delete it as quickly as is reasonable."

我不知道这个问题的答案,我知道我们在合理的范围内尽量加快清除的速度。



而在脸书的使用说明上,删除应用后清除数据的时间长达90天。


扎克伯格说,用户可以自行删除数据。但他并没有提到,删除通过脸书共享给第三方的数据有多难……


据CNN报道:


Users have to contact apps directly and ask them to delete their personal data.

用户需要自行联系应用,让他们删除私人数据。

   

Will Facebook do anything about its confusing privacy policy and terms of service?

对模棱两可的用户隐私政策和服务条款,脸书会对此做些什么吗?


在注册应用时,应用挑出一大串隐私条款你会仔细读吗?还是按个“同意”?


相信不少人都是因为隐私条款的麻烦,这一点,脸书的用户许可也并没有好到哪里去……


一位名叫肯尼迪(Kennedy)的来自路易斯安那州的参议员就直截了当地说道:


"Here's what everyone's been trying to tell you today — and I say it gently — your user agreement sucks," Kennedy said. "The purpose of a user agreement is to cover Facebook's rear end, not inform users of their rights."

让我来告诉你所有人的心声,我会说得客气点:“你的用户许可太烂了!”肯尼迪说,“你的用户许可就是为了给你们打掩护,根本不是告知用户权利。”



这一点,扎克伯格也承认:大多数人都读不完全文(most people do not read the whole thing)


"One of the things that we've struggled with over time is to make something that is as simple as possible so people can understand it, as well as giving them controls in line in the product in the context of when they're trying to actually use them," Zuckerberg said.

“长期以来,我们一直努力的一件事就是,把政策协议变得尽可能简单,进而让人们理解。同时当他们实际应用政策内容时,对其在产品内的行为进行监管。”


但截至目前,扎克伯格并未提供解决方案。


值得一提的是,经过这两场轰炸,小扎的身价却上涨了。



Facebook shares on Wednesday built on the previous day's gains. They closed up less than 1 percent, to $166.32, after a 4.5 percent rise Tuesday.

脸书股价继周二上涨4.5%后,周三上涨不到1%,收于166.32美元。
