一、上海笛爱建筑材料有限公司诉上海市浦东新区人民政府行政批复案

【裁判要旨】

事故调查过程中，事故调查组的主要职责在于查明事故情况、认定事故责任并提交事故调查报告。调查组成员参与事故调查属于职务行为，为维护事故调查的客观公正，调查组成员所在行政机关与事故调查结果之间存在利害关系的，该行政机关与其工作人员均应当回避。

[Judgment Abstract]

In the course of accident investigation, the main duties of an accident investigation team include identifying the accident circumstances, determining the accident liabilities, and submitting an accident investigation report. Participation in accident investigation by a member of an investigation team is an act of duty. For the purpose of maintaining objectivity in accident investigation, where there is an interest relationship between the member of the investigation team and the accident investigation results, the administrative organ and its personnel should disqualify themselves.

二、昆山城开锦亭置业有限公司诉昆山市国土资源局不动产行政登记及行政赔偿纠纷案

Kunshan Chengkai Jinting Property Co., Ltd. v. the Bureau of Land and Resources of Kunshan City (dispute over the administrative registration of an immovable property and administrative compensations)

【裁判摘要】

不动产登记系对物权的公示，涉及民事、行政双重法律关系，既应遵循物权法定等民事法律规范，又应符合不动产登记相关行政法规。物权的种类和内容由法律规定，当事人无权通过约定变更物权的法定内容。登记机关如将缺乏法律依据的约定内容进行登记，有违物权法定原则，当事人请求撤销相关登记内容的，人民法院应予支持。

[Judgment Abstract]

Immovable property registration is the publicity of real rights, which involves civil and administrative legal relations. It should not only follow civil legal norms such as numerus clausus, but also comply with relevant administrative regulations on immovable property registration. The types and contents of real rights shall be provided for by law, and the parties have no right to change the legal contents of real rights by agreement. If the registration authority registers the agreed contents lacking legal basis, it will violate the numerus clausus principle. Where a party requests to cancel the relevant registration, the people's court shall support it.

三、江西省金溪县人民检察院诉徐华文、方雨平人文遗迹保护民事公益诉讼案

People's Procuratorate of Jinxi County, Jiangxi Province v. Xu Huawen and Fang Yuping (civil public interest litigation case of protection of cultural relics)

【裁判摘要】

因破坏古迹、建筑群、遗址等人文遗迹造成生态资源损害的，侵权人应当承担侵权责任。检察机关可以依法对破坏人文遗迹造成生态资源损害的案件提起环境民事公益诉讼。在没有鉴定机构对古建筑损坏导致的人文生态资源损失作出鉴定的情况下，经当庭质证的专家意见可以作为认定根据。人民法院应综合考虑检察机关的公益诉讼请求、人文遗迹所在地经济发展水平、人文遗迹自身的社会影响力、被告的主观过错及其经济条件、对人文遗迹整体性的破坏程度和专家意见等要素，依法酌定人文生态资源损失。

[Judgment Abstract]

Where any damage to ecological resources is caused by destruction of historical sites, building groups, ruins, and cultural relics, the tortfeasor shall assume the tort liability. The procuratorial organ may institute an environmental civil public interest lawsuit against damage to ecological resources caused by destruction of cultural relics. Under the circumstance where there is no identification institution that can identify losses to cultural and ecological resources caused by destruction of ancient buildings, the expert opinions upon cross-examination in court may be taken as the basis for determining the facts. The people's court shall decide the losses to cultural and ecological resources by taking into full account such factors as the public interest claim raised by the procuratorial organ, the local economic development level at the place where the cultural relics are located, the social influences of the cultural relics, the faults and economic conditions of defendants, the degree of destruction of integrity of the cultural relics, and the expert opinions.
