1.民法总则草案提请十二届全国人大五次会议审议

《中华人民共和国民法总则（草案）》今日提请十二届全国人大五次会议审议。

草案共11章，210条，提请审议的几大看点为：基本原则体现新发展理念；自然人民事主体更完善；解决监护“空对空”难题；结合国情创新法人制度；加大民事权利保护范围；鼓励见义勇为行为；诉讼时效适应实践需要。

1.Bill of General Provisions of Civil Law Submitted to the 5th Session of the 12th NPC for Deliberation

Today, the Bill of General Provisions of the Civil Law of the People’s Republic of China will be submitted to the 5th session of the 12th National People's Congress for deliberation.

With a total of 210 articles in 11 chapters, the Bill has attracted wide public attention in seven areas: new development ideas reflected in fundamental principles; improved rules on natural persons; loopholes filled in guardianship rules; innovative rules on juridical persons based on China's national situations; expanded protection of civil rights; encouraging good Samaritan; and adapting statutes of limitation to practical needs. 

2.《关于律师开展法律援助工作的意见》发布

近日，司法部、财政部联合出台了《关于律师开展法律援助工作的意见》。

《意见》主要内容为：充分认识律师开展法律援助工作的重要意义；组织律师积极开展法律援助工作；切实提高律师法律援助服务质量；创新律师开展法律援助工作机制；加强律师开展法律援助工作的保障。

2.Opinions on Legal Aid Provided by Lawyers Issued 

Recently, the Ministry of Justice and the Ministry of Finance jointly released the Opinions on Legal Aid Provided by Lawyers.

The Opinions call for a full understanding of the great significance of legal aid provided by lawyers; mobilization of lawyers to provide legal aid; effective improvement of the quality of lawyers' legal aid services; innovative mechanisms for lawyers to provide legal aid; and enhanced safeguards for lawyers to provide legal aid.

3.《网络购买商品七日无理由退货暂行办法》正式实施

近日，由国家工商总局发布的《网络购买商品七日无理由退货暂行办法》正式实施。

《办法》明确了不适用无理由退货的商品：消费者定做的商品；鲜活易腐的商品；在线下载或者消费者拆封的音像制品、计算机软件等数字化商品；交付的报纸、期刊。此外，《办法》规定各方主体的规定动作、时间节点、延误责任，并规定选择无理由退货的消费者，应当自收到商品之日起七日内向网络商品销售者发出退货通知。七日期间自消费者签收商品的次日开始起算。

3.Interim Measures for the Unconditional Return of Commodities Purchased Online within Seven Days Officially in Effect 

Recently, the Interim Measures for the Unconditional Return of Commodities Purchased Online within Seven Days released by the State Administration for Industry and Commerce officially take effect.

The Measures enumerate commodities not covered by the unconditional return: custom-made, fresh, and perishable commodities, digital commodities such as audio-visual recordings and computer software downloaded online or unpacked by customers, and delivered newspapers and magazines. The acts required of the parties, time, and liability for delay are clarified, and consumers choosing the unconditional return should give a notice of return to the seller of online commodities within seven days of receipt of such commodities. The seven-day period starts from the next day after a customer signs for a commodity.

4.《中央财政专项扶贫资金管理办法》发布

近日，财政部、国务院扶贫办、国家发展改革委等六部门共同印发《中央财政专项扶贫资金管理办法》，从2017年3月31日起施行。

《办法》明确不再对相关资金支出范围作具体要求，而是采取负面清单方式，以提高资金使用效益。还规定中央财政专项扶贫资金（含项目管理费）不得用于以下九个方面支出：行政事业单位基本支出、交通工具及通讯设备、各种奖金津贴和福利补助、弥补企业亏损、修建楼堂馆所及贫困农场林场棚户改造以外的职工住宅、弥补预算支出缺口和偿还债务、大中型基本建设项目、城市基础设施建设和城市扶贫、其他与脱贫攻坚无关的支出。

4.Measures for Central Government Funding for Poverty Alleviation Issued

Recently, six departments, including the Ministry of Finance, the State Council’s Leading Group Office of Poverty Alleviation and Development, and the National Development and Reform Commission, jointly released the Measures for the Administration of Central Government Funding for Poverty Alleviation, effective from March 31, 2017.

The Measures adopt a negative list, instead of concrete requirements for the scope of relevant expenditures, in an effort to improve the cost-efficiency of the funding. Central government funding for poverty alleviation (including project management fees) is prohibited from nine uses: basic expenditures of administrative agencies and public institutions; means of transportation and communication; bonuses, allowances, and welfare subsidies; covering losses of enterprises; constructing government buildings, such as administrative buildings, auditoriums, memorial halls, and recreational facilities, as well as employee housing other than renovation of shanty areas on impoverished agricultural and forest farms; covering deficit of budget expenditures and repayment of debts; medium- and large-scale capital construction projects; urban infrastructure construction and urban poverty alleviation; and other expenditures irrelevant to poverty alleviation.

5.出境入境边防检查条例修订草案征求意见

近日，国务院法制办就《中华人民共和国出境入境边防检查条例（修订草案）（送审稿）》征求意见。

《送审稿》增加了“交通运输工具负责人应当采取合理措施，防止载运未持有效出境入境证件的人员，防止未经出境检查的人员搭乘交通运输工具出境，确保载运入境的人员接受边防检查，并教育和监督员工遵守中华人民共和国的法律、行政法规”的规定。

5. Public Comments Requested on Draft Regulation on Exit-Entry Border Inspection 

The Legislative Affairs Office of the State Council is requesting public comments on the Regulation of the People's Republic of China on Exit-Entry Border Inspection (Revised Draft) (Draft for Review).

The Draft for Review includes a new provision that: “The persons in charge of conveyances shall take reasonable measures to prevent the carriage of persons not holding valid exit-entry credentials, prevent the exit of uninspected persons by taking their conveyances, ensure that the persons carried receive border inspection for entry, and educate and oversee their employees on compliance with the laws and administrative regulations of the People's Republic of China.”

6. 关于办理侵犯公民个人信息刑事案件适用法律若干问题的解释原则通过

近日，最高人民法院审判委员会全体会议审议并原则通过《最高人民法院、最高人民检察院关于办理侵犯公民个人信息刑事案件适用法律若干问题的解释》。

《解释》共十条，主要规定了以下三方面的内容：（1）公民个人信息的范围；（2）侵犯公民个人信息罪的定罪量刑标准；（3）侵犯公民个人信息犯罪所涉及的宽严相济、犯罪竞合、单位犯罪、数量计算等问题。

6.Interpretation of Issues on Application of Law to Criminal Cases Involving Infringement of Citizens' Personal Information Passed in Principle

Recently, the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues concerning the Application of Law in the Handling of Criminal Cases Involving Infringement of Citizens' Personal Information passed in principle the plenary session of the Judicial Committee of the Supreme People's Court.

With a total of ten articles, the Interpretation mainly clarifies: (1) the scope of a citizen's personal information; (2) the conviction and sentencing criteria for the crime of infringing upon citizens' personal information; and (3) issues such as balance of rigorousness and leniency, concurrent crimes, crimes committed by entities, and quantitative calculation related to such crimes.

7.人社部印发指导意见支持和鼓励事业单位专技人员创新创业

近日，人社部印发《关于支持和鼓励事业单位专业技术人员创新创业的指导意见》。

《指导意见》明确了支持和鼓励事业单位专技人员创新创业的四种情形和支持鼓励的具体政策措施：一是支持和鼓励事业单位选派专技人员到企业挂职或者参与项目合作，期间与原单位在岗人员同等享有相关权利，并可以依协议取得成果转让、开发收益；二是支持和鼓励事业单位专技人员兼职创新或者在职创办企业，取得的成绩可以作为专技人员职称评审、岗位竞聘、考核的重要依据；三是支持和鼓励事业单位专技人员离岗创新创业，可在3年内保留人事关系，离岗创业期间保留基本待遇；四是支持和鼓励事业单位设置创新型岗位，可以通过设置特设岗位、流动岗位选拔、吸引创新人才，探索实行灵活、弹性的工作时间，鼓励绩效工资分配向在创新岗位做出突出成绩人员倾斜，等等。

7.Guiding Opinions Released to Support and Encourage Innovation and Entrepreneurship of Professional Technicians of Public Institutions 

Recently, the Ministry of Human Resources and Social Security (MOHRSS) issued the Guiding Opinions on Supporting and Encouraging Innovation and Entrepreneurship of Professional Technicians of Public Institutions.

The Guiding Opinions outline four ways and concrete policy measures to support and encourage innovation and entrepreneurship of public institutions' professional technicians. First, the secondment and project participation of a public institution’s professional technicians in enterprises should be supported and encouraged, who will continue to enjoy all rights as the public institution’s in-service employees and can benefit from the transfer and exploitation of their achievements by agreement. Second, innovation made on their part-time jobs or starting their own business while still on the job by a public institution's professional technicians should be supported and encouraged, whose achievements can serve as an important basis for their professional title appraisal, competitive employment, and performance evaluation. Third, innovation and entrepreneurship of a public institutions' professional technicians by suspension of their employment with the institution should be supported and encouraged, who may retain their personnel relationship with the institution for three years and their basic pay while absent. Fourth, innovative posts of public institutions should be supported and encouraged, which can attract innovation talents by providing special posts and mobile posts, exploring flexible work schedules, and incentivizing outstanding employees at such posts in the distribution of performance-based wages.

8.最高法要求为军警全面停止有偿服务工作提供司法保障

日前，最高人民法院印发《最高人民法院关于做好为军队和武警部队全面停止有偿服务提供司法保障工作的通知》。

《通知》要求，各级人民法院要畅通立案绿色通道，及时受理和审查涉全面停止有偿服务纠纷案件；要加强办案力量，提高办案效率，正确理解适用法律，在现行法律框架内，依法平等保护军地双方当事人的合法权益；裁判生效后，当事人申请强制执行的，要加大执行力度，尽快执结案件，保障全面停止有偿服务工作的顺利推进。

8.SPC Requires Judicial Safeguards for the Complete Halt on Paid Services of Military and Armed Police Forces 

Recently, the Supreme People's Court issued the Notice of the Supreme People's Court on Providing Effective Judicial Safeguards for the Complete Halt on Paid Services of Military and Armed Police Forces.

The Notice requires courts at all levels to maintain clear green channels for case filing and promptly accept and examine cases involving disputes over the complete halt on paid services. The courts should assign more resources for handling such cases, improve case-handling efficiency, properly understand and apply laws, and protect the legitimate rights of military and civilian parties on an equal basis within the existing legal framework. For parties who apply for enforcement after judgments take effect, the courts should redouble efforts to close cases as soon as practicable to ensure the smooth progress of the complete halt on paid services.
