1.《关于支持社会力量提供多层次多样化医疗服务的意见》印发


近日,国务院办公厅印发《关于支持社会力量提供多层次多样化医疗服务的意见》。


《意见》提出,力争到2020年,社会力量办医能力明显增强,医疗技术、服务品质、品牌美誉度显著提高,打造一大批有较强服务竞争力的社会办医疗机构,服务供给基本满足国内需求。为此,《意见》明确了今后一个时期发展社会办医的主要任务和政策措施。一是支持社会办医拓展多层次多样化服务。二是进一步扩大市场开放。三是强化政策支持。四是严格行业监管和行业自律。


1. Opinions on Supporting Multilayered and Diverse Private Healthcare Services Issued 


Recently, the General Office of the State Council issued the Opinions on Supporting Multilayered and Diverse Private Healthcare Services.


As expected in the Opinions, by 2020, the capacity of the private sector to provide healthcare services will have significantly increased, their healthcare technologies, quality of services, and brand reputation will have remarkably improved, and a host of private healthcare institutions with strong competitiveness will have emerged, to basically meet the domestic demands for their services.The Opinions specify the following major tasks and policy measures in the future: (1) supporting private healthcare in expanding multilayered and diversified services; (2) further opening up the market; (3) increasing policy support; and (4) reinforcing the supervision and self-regulation of the industry. 

2.《互联网新闻信息服务许可管理实施细则》公布


国家互联网信息办公室近日公布《互联网新闻信息服务许可管理实施细则》,自2017年6月1日起施行。


细则明确以下内容:一是进一步明确了互联网新闻信息服务具体类别,细化了每类服务的概念、许可条件、申请材料等;二是适应国有单位转企改制、企业股份制改造等情况,细化了企业法人申请材料等;三是明确传播平台服务提供者应当制定完善的平台账号用户管理制度、用户协议、投诉举报处理机制等;四是明确了技术安全评估有关要求,细化了互联网新闻信息服务单位与境内外中外合资经营、中外合作经营和外资经营的企业进行涉及互联网新闻信息服务业务合作的安全评估要求。五是对许可变更、续办、注销等环节的条件、材料、程序等提出明确要求,进一步完善许可退出机制。


2. Detailed Implementing Rules for the Licensing of Internet News Information Services Issued


Recently, the Cyberspace Administration of China (CAC) issued the Detailed Implementing Rules for the Administration of the Licensing of Internet News Information Services, effective from June 1, 2017.


The Detailed Implementing Rules: (1) further specify the categories of internet news information services, with detailed definitions, licensing conditions and application materials for each category of services; (2) detail the application materials for enterprise legal persons in light of the corporate transformation of state-owned entities and the shareholding reform of enterprises; (3) make it clear that the providers of platforms for spreading news information should establish adequate management rules for accounts and users on the platforms, user agreements, and the mechanism for dealing with tips and complaints; (4) clarify the relevant requirements on technical safety evaluation, with detailed safety evaluation requirements for cooperation involving internet news information services between internet news information service providers and domestic or overseas Chinese-foreign equity or contractual joint ventures or wholly foreign-owned enterprises; and (5) set forth clear requirements on the conditions, materials and procedures for the modification, renewal and cancellation of licensing, further improving the licensing withdrawal mechanism.

3.最高人民法院发布《关于常见犯罪的量刑指导意见(二)》


最高人民法院日前发布《关于常见犯罪的量刑指导意见(二)》(试行)。


《意见》中关于醉驾量刑的规定引人关注,“对于醉酒驾驶机动车的被告人,应当综合考虑被告人的醉酒程度、机动车类型、车辆行驶道路、行车速度、是否造成实际损害以及认罪悔罪等情况,准确定罪量刑。对于情节显著轻微危害不大的,不予定罪处罚;犯罪情节轻微不需要判处刑罚的,可以免予刑事处罚。”


3. Sentencing Guidelines for Common Crimes (II) Issued


Recently, the Supreme People's Court (SPC) issued the Sentencing Guidelines for Common Crimes (II) (for Trial Implementation).


The provisions of the Guidelines on the sentencing for drunk driving especially draw wide public attention: “For a defendant driving a motor vehicle while intoxicated, the defendant's level of intoxication, the motor vehicle type, the road, the driving speed, whether any actual harm has been caused, the defendant's confession and repentance, and other circumstances shall be comprehensively considered for accurate conviction and sentencing. If the circumstances are markedly minor and the harm caused is not serious, the offender shall be acquitted. If a criminal penalty is not necessary due to the minor circumstances of the offense committed, the offender may be exempted from criminal penalty.” 

4.《中国银监会2017年立法工作计划》发布

近日,银监会公布《中国银监会2017年立法工作计划》。


根据计划,今年要完成的立法项目有46项,其中包括制定《商业银行破产风险处置条例》、《银行业金融机构股东管理办法》、《商业银行理财业务监督管理办法》、《商业银行信用风险管理指引》、《交叉金融产品风险管理办法》和《商业银行委托贷款管理办法》等,修订《商业银行流动性风险管理办法(试行)》和《商业银行表外业务风险管理指引》等。


《计划》还提出了16项2017年抓紧研究,待条件成熟提出的立法项目包括制定《小额贷款公司监督管理条例》、《信托公司流动性管理办法》、《商业银行系统重要性评估和资本要求指引》和《关于规范银行业务治理体系的指导意见》等。


4. CBRC Releases Legislative Work Plan for 2017


Recently, the China Banking Regulatory Commission (CBRC) released the Legislative Work Plan of the China Banking Regulatory Commission for 2017.


According to the Plan, there are 46 legislative projects to be completed this year, including the making of the Regulation on the Disposal of the Bankruptcy Risk of Commercial Banks, Measures for the Administration of the Shareholders of Banking Financial Institutions, Measures for the Supervision and Administration of the Wealth Management Business of Commercial Banks, Guidelines for the Credit Risk Management of Commercial Banks, Measures for the Risk Management of Cross-Market Financial Products, and Measures for the Administration of the Entrusted Loans of Commercial Banks and the revision of the Measures for the Liquidity Risk Management of Commercial Banks (for Trial Implementation ) and Guidelines for the Risk Management of the Off-Balance-Sheet Operations of Commercial Banks. 


The Plan also includes 16 legislative projects needing further research in 2017 and to be proposed when conditions are mature, including the formulation of the Regulation on the Supervision and Administration of Petty Loan Companies, Measures for the Liquidity Management of Trust Companies, Guidelines for the Systemic Importance Assessment and Capital Requirements of Commercial Banks, and Guiding Opinions on Regulating the Operations Governance System of Banks. 

5.环保部门按日连续处罚办法拟修订


环保部近日编制《环境保护部关于修改<环境保护主管部门实施按日连续处罚办法>的决定(征求意见稿)》并公开征求意见。


此次《办法》主要修改以下两方面内容:一是调整适用范围。将《办法》第五条关于按日连续处罚的适用范围进行调整,增加一项“未依法取得排污许可证排放污染物的”。将“违法倾倒危险废物的”修改为“非法排放、倾倒、处置危险废物的”。二是取消复查期限三十日和再次复查的规定。


5. Measures for Consecutive Daily Penalties on Environmental Violations to be Amended 


The Ministry of Environmental Protection is requesting public comments on the Decision of the Ministry of Environmental Protection to Amend the Measures for the Environmental Protection Departments to Implement Consecutive Daily Penalties (Consultation Paper).


The amendment of the Measures mainly involves the following two aspects: (1) Adjusting the applicable scope of consecutive daily penalties in Article 5 of the Measures by adding “discharging pollutants without legally obtaining a pollutant discharge license” and changing “illegally dumping hazardous wastes” into “illegally discharging, dumping or disposing of hazardous wastes.” (2) Removing the reexamination time limit of 30 days and second reexamination. 

6. 《关于深化石油天然气体制改革的若干意见》印发


近日,中共中央、国务院印发了《关于深化石油天然气体制改革的若干意见》。


《意见》部署了八个方面的重点改革任务。一是完善并有序放开油气勘查开采体制,提升资源接续保障能力。二是完善油气进出口管理体制,提升国际国内资源利用能力和市场风险防范能力。三是改革油气管网运营机制,提升集约输送和公平服务能力。四是深化下游竞争性环节改革,提升优质油气产品生产供应能力。五是改革油气产品定价机制,有效释放竞争性环节市场活力。六是深化国有油气企业改革,充分释放骨干油气企业活力。七是完善油气储备体系,提升油气战略安全保障供应能力。八是建立健全油气安全环保体系,提升全产业链安全清洁运营能力。


6. Opinions on Deepening the Oil and Gas System Reform Issued 


Recently, the CPC Central Committee and the State Council issued the Several Opinions on Deepening the Oil and Gas System Reform.  


The Opinions set forth key reform tasks in eight aspects: (1) improving and relaxing in an orderly manner the oil and gas exploration and exploitation system to enhance the resource continuity safeguard capacity; (2) improving the import and export management system of oil and gas to enhance the capacity of utilizing resources at home and abroad and capacity of preventing market risks; (3) reforming the oil and gas pipeline network operation mechanisms to enhance the intensive transmission and fair service capacity; (4) deepening the reform of downstream competitive processes to enhance the production and supply capacity of quality oil and gas products; (5) reforming the pricing mechanism for oil and gas products to effectively unleash the market viability in competitive processes; (6) deepening the reform of state-owned oil and gas enterprises to fully unleash the strength of backbone enterprises; (7) improving the oil and gas reserve system to enhance the capacity of oil and gas strategic safety guarantee and supply; and (8) establishing and improving the oil and gas safety and  environmental protection system to enhance the safe and clean operation capacity of the whole industrial chain.
