LCL Implementation Regs 21; Termination at Retirement
The following provision of the Regulations on the Implementation of the Labor Contract Law of the People's Republic of China (LCL Implementation Regulations) details how the labor contract shall be terminated at retirement age. Note that judicial and administrative practice in applying the concept of mandatory retirement age to non-Chinese citizens who do not hold Chinese Permeant Residence and have not received/are not due to receive Chinese social insurance pension benefits, is highly variable.
Article 21 - Labor Contract Termination at Retirement Age
A labor contract shall be terminated when a worker reaches the mandatory age for retirement.
第二十一条
劳动者达到法定退休年龄的,劳动合同终止。
