State Council Regulations on Working Hours
The following regulation superseded the 44 hour work week in Article 36 of the Labor Law of the People’s Republic of China and mandate a 40 hour work week (Art. 3). They also mandate the standard working hours system for state workers while allowing exceptions (Arts. 4, 7).

Article 1
In order to reasonably arrange the working hours and rest time of employees, maintain the workers' rest rights, mobilize the enthusiasm of workers, and promote the development of the socialist modernization cause, these regulations are formulated in accordance with the relevant provisions of the Constitution.
第一条
为了合理安排职工的工作时间和休息时间,维护职工的休息权利,调动职工的积极性,促进社会主义现代化建设事业的发展,根据宪法有关规定,制定本规定。
Article 2
These regulations apply to workers of state organs, social organizations, enterprises and institutions and other organizations within the territory of the People's Republic of China.
第二条
本规定适用于在中华人民共和国境内的国家机关、社会团体、企业事业单位以及其他组织的职工。
Article 3
Workers work 8 hours a day and 40 hours a week.
第三条
职工每日工作8小时、每周工作40小时。
Article 4
Those engaged in labor under special conditions and under special circumstances that require appropriate reduction of working hours shall be implemented in accordance with relevant state regulations.
第四条
在特殊条件下从事劳动和有特殊情况,需要适当缩短工作时间的,按照国家有关规定执行。
Article 5
Due to the limitation of the nature of work or production characteristics, if the standard working hours system of 8 hours per day and 40 hours per week cannot be implemented, other work and rest methods may be implemented in accordance with relevant state regulations.
第五条
因工作性质或者生产特点的限制,不能实行每日工作8小时、每周工作40小时标准工时制度的,按照国家有关规定,可以实行其他工作和休息办法。
Article 6
No employer or individual may extend the working hours of workers without authorization. If it is really necessary to extend working hours due to special circumstances and urgent tasks, it shall be carried out in accordance with relevant national regulations.
第六条
任何单位和个人不得擅自延长职工工作时间。因特殊情况和紧急任务确需延长工作时间的,按照国家有关规定执行。
Article 7
State organs and institutions implement unified working hours, with Saturdays and Sundays as weekly rest days.
Enterprises and institutions that cannot implement the unified working hours specified in the preceding paragraph can flexibly arrange weekly rest days according to the actual situation.
第七条
国家机关、事业单位实行统一的工作时间,星期六和星期日为周休息日。
企业和不能实行前款规定的统一工作时间的事业单位,可以根据实际情况灵活安排周休息日。
Article 8
These regulations shall be interpreted by the Ministry of Labor and the Ministry of Personnel; the implementation measures shall be formulated by the Ministry of Labor and the Ministry of Personnel.
第八条
本规定由劳动部、人事部负责解释;实施办法由劳动部、人事部制定。
Article 9
These regulations shall come into force on May 1, 1995. The implementation of the enterprises and institutions with difficulties on May 1, 1995 may be postponed appropriately, but the institutions shall be effective from January 1, 1996 at the latest, and the enterprises shall be effective from May 1, 1997 at the latest.
第九条
本规定自1995年5月1日起施行。1995年5月1日施行有困难的企业、事业单位,可以适当延期,但是事业单位最迟应当自1996年1月1日起施行,企业最迟应当自1997年5月1日起施行。
