Tax issues that may affect your visa status

VisaOfChina WorkVisaService 2020-11-12

Visa applications that maybe affected by tax issues:

  • Applying for a work permit through the 60 points system

  • Applying for a work permit through making a commitment to paying taxes;

  • Applying for a work permit as the legal representative of a company

Why pay taxes?

When working in China, you must pay personal income taxes to the government the same way all Chinese citizens do. The tax payment rate is also the same as that of Chinese citizens.

Consequences of not paying taxes

If you fail to pay taxes, your visa cannot be extended, renewed or even cancelled.

If you own a company, you also need to pay an additional corporate income tax, which can be taken care of by financial professionals at the company.

Even if a new company doesn't make any profit, tax returns must be filed every month through a zero-tax declaration.

How to check your tax records?

Scan the code below to check your tax records on the official website (Shanghai).

Expats can bring their passports to the local tax bureau to request and print a detailed list of their tax payments.

What if the company won't pay taxes for the foreign employees?

Can the foreign employee pay the taxes themselves?

Taxes due by foreign employees must be paid by the company they work for. Expats cannot pay taxes by themselves.

If the company does not pay taxes for the employee, they will not be able to extend, renew, or cancel their visa.

If the company fails to pay the taxes, it is recommended to communicate with the company HR or the personnal in charge.

If the company HR or the personnal in charge do not understand related policies, they can follow or contact us for more visa-related knowledge and information.
