Policy for Enterprise Establishment by Green Card Holder in GZ

In order to accelerate the Implementation of Innovation-driven Development Strategies to further optimize the business environment of Guangzhou City and support foreigners holding Foreign Permanent Resident ID Card to participate in the construction of international science and technology innovation center in Guangdong-Hong Kong-Macao Greater Bay Area by means of scientific and technological entrepreneurship. The trial measures have been officially implemented in August 2021.

为进一步鼓励持永久居留身份证件的外籍人员创办科技型企业，参与粤港澳大湾区国际科技创新中心建设，近日广州市顺势印发的《持永久居留身份证外籍人员创办科技型企业试行办法》已于2021年8月正式实施。

Applicable Personnel

适用对象

Foreign natural persons who have been approved to obtain permanent residence status in China and hold foreign permanent resident ID cards (foreigner’s permanent residence cards) of the People's Republic of China.

经批准取得在华永久居留资格，持有中华人民共和国外国人永久居留身份证（外国人永久居留证）的外国自然人。

Application Scope

适用范围

Those enterprises engaged in technology development, technology transfer, technology consultation, technology services, technology testing or R&D, production and operation of high-tech products (services).

在广州市范围内，从事技术开发、技术转让、技术咨询、技术服务、技术检测或高新技术产品（服务）研发、生产、经营等科技型企业。

Preferential Policies

优惠政策

1. Holding a foreigner's permanent residence ID card will be exempted from notarization.

持外国人永久居留身份证可免公证认证

The permanent residence ID card can be used as the identity certificate for the establishment of scientific and technological enterprises, and is exempt from notarization and authentication.

永久居留身份证可作为创办科技型企业的身份证明，免于公证认证。

2. Enjoy the same treatment asdomestic natural persons

创办科技型企业可享受国民待遇

Foreigners can use their foreign permanent resident ID cards as proof of identity to establish scientific and technological enterprises, and enjoy the same treatment as domestic natural persons holding Chinese resident ID cards as proof of identity. Commercial registration shall be undertaken according to the Foreign Investment Law of the People's Republic of China and its implementing regulations.

持有外国人永久居留身份证的外籍人员创办科技型企业可享受境内自然人同等待遇，即永久居留身份证可作为创办科技型企业的身份证明，享受中国居民身份证创办企业的同等待遇，并根据《中华人民共和国外商投资法》及其实施条例的规定办理商事登记。

3. Encourage technological innovation

Foreigners are encouraged to invest in the establishment of scientific and technological enterprises with their own intellectual property rights, proprietary technology and other non-monetary assets.

外籍人员可以以自有知识产权、专有技术等非货币财产作价出资创办科技型企业。

4. Simplify approval procedures and foreign exchange

简化审批程序及外汇兑换成本

For foreigners holding foreign permanent residence ID cards, they can use legally obtained RMB to make direct foreign investment in China.

对持有外国人永久居留身份证的外籍人员，可使用合法获得的人民币在中国境内直接进行外商投资。

For investment projects and establishment of foreign-invested enterprises in China, the development and reform, commerce, industry and commerce, foreign exchange and other departments shall simplify the approval and approval procedures in accordance with the relevant regulations on foreign investment management to improve efficiency.
