吴文康检举揭发“老领导”薄熙来那些事儿　    

吉林省高院近日公布，原重庆市委书记薄熙来的秘书吴文康二审被维持无期徒刑判决。裁定书显示，吴文康认为自己曾检举、揭发薄熙来滥用职权的犯罪事实，有立功行为，但被法院驳回。　　

裁定书对此解释说：经查，吴文康是在配合中央工作专办对王立军事件调查时检举、揭发了薄熙来滥用职权犯罪事实，而不是到案后检举揭发的。

其行为不符合“最高人民法院‘关于处理自首和立功具体应用法律若干问题的解释’”第五条：“根据刑法第六十八条第一款的规定，犯罪分子到案后有检举、揭发他人犯罪行为，……，经查证属实，应当认定为有立功表现。”的规定。

故其相关上诉理由及辩护意见不成立，不予采纳。　　

澎湃新闻指出，上述最高法关于自首和立功的司法解释，细化了刑法的相关规定，其中对应认定为立功表现的检举、揭发行为加了一个限定词，即“到案后”。　　

法学学者、律师毛立新认为，“到案”的前提是被列为犯罪嫌疑人或者调查对象，而从裁定书的认定看，吴文康检举揭发薄熙来时，身份是群众或党员干部，配合开展调查，也就谈不上到案。　　

“司法解释对应作为立功表现的检举揭发行为做出了比较严格的规定，而根据规定，确实是到案后检举揭发才算得上立功。但如果检举揭发的线索有其重要性，可以作为一个酌情考虑的情节。”毛立新说。　　

此外，吴文康还认为，自己在配合中央工作专办对王立军事件调查时，主动交代了自己的受贿犯罪事实，具有自首情节。但这一意见同样遭到驳回。　　

裁定书称：经查，根据“中共中央纪律检查委员会函”，中央工作专办在对王立军事件调查和对“11.15”案件复查中发现吴文康涉嫌收受贿赂问题，在中纪委对其立案调查期间其主动交代了其受贿犯罪事实，其行为不构成自首。

故其相关上诉理由及辩护意见不成立，不予采纳。　　

也就是说，中纪委早在吴文康自己交代之前，已经发现了他的犯罪事实。　　

长期担任薄熙来秘书，最终被判无期徒刑，吴文康到底干过什么呢?

据凤凰网报道，吴文康在薄熙来案中扮演着至关重要的角色，曾目睹薄熙来扇王立军耳光，而王立军逃入美国领事馆后，也是他向薄熙来报告，并与薄谷开来一起炮制了王立军有精神障碍的报告。

22年前当薄熙来秘书开始受贿 读EMBA、女儿出国都收钱　

早在22年前，吴文康任大连市市长薄熙来秘书，当时吴利用职务便利为一地产公司开发项目审批提供帮助。后于1999年向该地产商索要一套价值30万元的住宅。　　

其后，吴文康更是收不了手。　　

1999年，吴文康利用担任大连市口岸委员会主任助理职务上的便利，接受大连太平洋石材有限公司经理毕某某的请托，为其承包大连周水子机场改造项目工程提供帮助。

2002年9月和2003年春节期间，毕某某为表示感谢并希望继续得到吴文康的帮助，先后两次送给吴文康前妻丛美燕共计5万美元，折合人民币41.384万元。吴文康对此均知情。　　

2001年，吴文康利用担任辽宁省政府办公厅副主任职务上的便利，接受大连亿成房屋开发有限公司董事长范某甲的请托，为其取得大连钢铁集团棚户区改造项目提供了帮助。于2002年在其住处收受范某甲给予的人民币20万元。　　

2001年至2007年，吴文康利用担任辽宁省政府办公厅副主任职务上的便利，接受大连金广建设集团有限公司董事长范某乙的请托，为其下属公司开发“金海花园广场”项目提供了帮助。先后七次在范某乙办公室内收受其给予的人民币81万元。　　

很快，吴文康从辽宁贪到了重庆。　　

2002年至2012年间，吴文康利用担任辽宁省政府办公厅副主任、中共重庆市委副秘书长、办公厅主任职务上的便利，受富某某的请托，在其所属公司取得大连市大起大重地块的开发权、承揽重庆市北碚区朝阳复建桥工程、碚青路工程、蔡家土地整治项目以及取得重庆市农村商业银行贷款等事宜上提供帮助，多次收受富某某给予的款物共计折合人民币1648.6028万元。　　

有趣的事实是，吴文康2004年底欲赴北京大学攻读EMBA，2005年初富某某以为其提供学费的名义送给其现金25万元。　　

从一个访谈可以看到，吴去读EMBA得到了领导的支持。当被问到为何要去读EMBA时，吴文康谈到：“当我考上了以后，我就跟领导谈，我说我一直从事行政管理工作，多年来没有机会进行系统的学习，宏观经济的管理更需要扎实的理论功底，如果有这个机会能给我吗?后来组织上满足了我这个愿望。”　　

裁定书还透露：“2005年至2011年间，富某某以吴文康女儿吴丹出国读书、妻子丛美燕办理赴美签证及为吴文康提供赴美探亲路费名义，先后六次送给吴文康美元共计25万元。

2009年上半年，富某某以为吴文康女儿吴丹在美国购房名义，分三次送给吴文康和丛美燕共计45万美元。”　　

除了借教育之名外，吴文康还擅长用置换的方式受贿。　　

2005年3月，吴文康收受富某某为其购买的价值人民币25.38万元的本田雅阁轿车一辆，吴文康将一辆旧丰田佳美轿车置换给富某某，后富某某将该车以人民币8万元的价格抵账给大连市鑫源建筑材料厂，吴文康实际占有差价款人民币17.38万元。　　

2008年至2009年期间，吴文康以其岳母江德英位于大连市胜利路的一套住宅(评估价值人民币163.3438万元)置换了富某某开发的大连市沙河口区富康园小区的两套住宅(经评估价值分别为人民币383.216万元和380.8577万元)，吴文康实际占有差价款合计人民币600.729 9万元。

后该两套房屋分别落籍到被告人吴文康女儿吴丹和其岳母江德英名下。2009年6月富某某出资为吴文康装修了上述两套房屋，支付装修款共计人民币1278212.74元。　　

对于其犯罪事实，长春市中级人民法院做了如下判决：对被告人吴文康以受贿罪，判处无期徒刑，剥夺政治权利终身，并处没收个人全部财产;扣押在案的现金人民币二千零二十万三千三百四十八元依法收缴，上缴国库，其余部分作为被告人吴文康个人财产，予以没收。　　

薄熙来案重要角色目睹薄熙来扇王立军耳光

然后亮点来了：在上诉中，吴文康及其辩护人提出，其在配合中央工作专办对王立军事件调查时检举、揭发薄熙来滥用职权犯罪事实，有立功表现，并主动交代了自己的受贿犯罪事实，具有自首情节。

在调查王立军事件时，吴文康就已经检举、揭发了“老领导”薄熙来。　　

法院提供的事实显示，吴文康在薄熙来案中扮演着至关重要的角色。　　

1、2012年1月28日晚，王立军将薄谷开来涉嫌投毒杀害尼尔·伍德一事告知薄熙来。

次日上午，吴文康（时任中共重庆市委副秘书长兼市委办公厅主任）及郭维国（重庆市公安局原副局长）和王立军被薄熙来召集谈话，薄斥责王立军诬陷薄谷开来，打了王立军一记耳光，并将杯子摔碎在地上。　　

2、同样是在1月28日晚，吴文康接受薄熙来安排，对“11·15”(薄谷开来涉嫌杀人案)案件原侦查人员王智、王鹏飞进行调查。　　

3、2月6日，王立军叛逃至美国驻成都总领事馆。次日凌晨，吴文康等人到薄熙来住处向其报告此事。薄熙来纵容薄谷开来参与王立军叛逃事件的研究应对，并同意薄谷开来提出的由医院出具王立军精神疾病诊断证明的意见。

当日，薄谷开来和吴文康协调重庆有关医院出具了王立军“存在严重的抑郁状态和抑郁重度发作”的虚假诊断证明。　　

4、根据薄谷开来的证词，可以看出吴文康与薄谷开来关系也不一般。　　

以下是薄谷开来的证言：

2012年1月29日早晨，薄熙来告知其1月28日王立军举报其杀害尼尔·伍德。其表示这都是王立军诬陷，尼尔·伍德是酒后猝死。

薄熙来称当天要狠狠地批王立军。中午，薄熙来说他打了王立军一记耳光。后吴文康也告知其，薄熙来怒斥王立军，并打了王立军一个耳光，摔了一个杯子，且让吴文康和郭维国作见证人。

当天晚上，吴文康拿来几封辞职信，称王鹏飞、王智举报其杀害了尼尔·伍德。其提出举报信系诬陷，并让吴文康调查王鹏飞、王智，薄熙来表示同意。

2月2日，王智写悔过书向其赔罪，承认写辞职信是受王立军指使。

7日凌晨，吴文康等人到其家中向薄熙来汇报王立军进入美领馆事件，其建议由医院出具证明，证实王立军系因精神存在问题而进入美领馆，薄熙来表示同意。

当天中午，其让重庆市大坪医院出具了王立军在精神方面存在严重抑郁状态的诊断证明，其与吴文康看后将诊断证明的日期由2月7日修改为2月4日。

吴文康等人与王鹏飞谈话后，因王鹏飞不承认诬陷，其要求公安机关对王鹏飞立案审查。

后公安机关对王鹏飞以诬告陷害罪立案审查。　　

5、吴文康本人的证词也很有说服力：　　

以下是吴文康的证言：2012年1月29日上午，在市委1号楼会议室，薄熙来怒斥王立军诬陷薄谷开来并打了王立军一个耳光，将茶杯摔在地上，并指着摔碎的茶杯对王立军说：“从此咱俩的关系就这样!”当晚，薄熙来的秘书车辉从市公安局拿来王智、王鹏飞的辞职信。

其带着辞职信到薄熙来家中，将王鹏飞、王智以辞职信的形式举报薄谷开来杀害尼尔·伍德之事告诉薄熙来和薄谷开来。薄谷开来说这是诬陷，让查查王鹏飞和王智，并让其与二人谈谈，薄熙来表示同意。

2月2日下午和晚上，其分别与王智、王鹏飞谈话。王智说辞职信是王立军授意写的，内容与事实不符，并写了一份悔过书。

王鹏飞坚称信的内容真实。事后，其向薄熙来汇报了对王智的调查情况。吴文康还证明其本人没有调查王鹏飞和王智的权力。　　

薄熙来及其辩护人对吴文康等人的证词表示疑问：“不能排除证人吴文康等人因被刑事追诉或者与薄熙来存在重大利害冲突而推卸责任的可能性，其证言的真实性存在疑问。”
