On March 7, China government unveiled a series of institutional reforms in the first session of the 14th National People's Congress. Among the reforms, the most influential one should be the promotion of the patent regulator in the hierarchy: the National Intellectual Property Administration is set to sit directly under the powerful State Council, giving it a bit more heft. Previously, CNIPA was under the jurisdiction of the State Administration for Market Regulation, but now it has been planned to be adjusted to an institution directly under the State Council, which has comprehensively improved the level of creation, application, protection, management and service of intellectual property.
3月7日，中国政府在第十四届全国人民代表大会第一次会议上公布了一系列的国家机构改革部署。在这些改革部署中，最具影响力的当属专利监管机构在国家机构体系中的地位提升：国家知识产权局将直接隶属于强大的国务院，使其在国务院机构体系中有更重要的地位。此前，国家知识产权局隶属于国家市场监管总局，现调整为国务院直属机构，全面提升了知识产权的创造、运用、保护、管理和服务水平。

NCA released "2021 China Network Copyright Protection Annual Report"
国家版权局发布《2021年度中国网络版权保护报告》
On February 28, National Copyright Administration released the "2021 China Network Copyright Protection Annual Report". The report analyzes and summarizes the breakthroughs and historic achievements achieved in China's copyright protection in recent years, and also provides a comprehensive analysis of copyright protection, especially the institutional mechanism of online copyright protection, which should be the focus at current stage. Additionally, the report also points out that with the refinement of digital rights management (DRM) technology, it will develop a greater impact and become another edge tool for domestic network copyright protection.

USPTO has launched a special category of its Patents for Humanity Program
美专利商标局为人道主义专利计划奖项开设新类别
The U.S. Patent and Trademark Office (USPTO) announced on March 6, that it has launched a special category of its Patents for Humanity Program for green energy inventions. This new award category will provide business incentives for patent applicants, holders, and licensees whose inventions are addressing the challenges of climate change through green energy innovations, including wind, solar, hydrogen, hydropower, geothermal, and biofuel technologies. The Patents for Humanity Green Energy category joins other recent USPTO initiatives that are designed to address the challenge of climate change.

Japan announces report surveying next-generation vehicle patents by GAFAM
日本公布美国五大科技公司下一代汽车专利调查报告
On February 27, NIKKEI Mobility, a Japanese specialized media, in cooperation with Tokyo-based research firm Astamuse, conducted a survey and analysis of patents related to next-generation vehicle technologies filed and disclosed by five major U.S. technology companies ("GAFAM") from 2003 to 2021. The report concluded that the competitiveness of next-generation automotive technology depends on intellectual property such as artificial intelligence (AI) rather than production scale, and that the rise of technology giants will change the way of competition and cooperation in the automotive field. Currently, the development of next-generation automotive technology requires the use of four CASE technologies: Connected, Autonomous, Shared and Electric, so the IP rights of such technologies have become the focus, accelerating the cooperation between technology giants and automotive giants.

Hermes asks for an injunction to block 'MetaBirkin' NFT sales after jury win

On March 6, French luxury house Hermes International asked a Manhattan federal court to block artist Mason Rothschild from promoting or owning his "MetaBirkin" non-fungible tokens (NFTs) after a jury found they violate Hermes' trademark rights in its famous Birkin bags. Hermes said in a court filing Friday that Rothschild has continued to market his NFTs despite the jury's verdict last month. It asked the court to force him to stop using "Birkin" trademarks and to transfer the MetaBirkins website, the NFTs that he still owns and his income from sales of the tokens since the trial to Hermes.

U.S. appeals court refuses to admit Gruyere as a geographical indication

On March 3, a U.S. appeals court said that the name "gruyere" can be used to label cheeses from outside of the Gruyère region of Switzerland and France, in a victory for U.S. dairy groups and others. The court upheld a U.S. Patent and Trademark Office (USPTO) ruling that rejected a bid by two groups representing cheese producers from Switzerland and France for a mark that would restrict the use of "gruyere" to cheese from Gruyère itself. However, the groups said in a statement that they were disappointed by the decision and would continue to "pursue vigorously" their efforts to protect the name.

Avanci launched TV licensing platform ATSC 3.0

On March 7, Avanci announced on its official website that the patent licensing platform has launched the one-stop broadcast TV licensing platform ATSC 3.0, which is another licensing platform involving a new field after the launch of the standard essential patents (SEPs) for cellular communications. The ATSC 3.0 standard was developed by the Advanced Television Systems Committee (ATSC) and is currently used in over-the-air television broadcasting in the United States, Korea and other countries. Currently, Samsung Electronics, LG Electronics and Sharp have joined the ATSC 3.0 patent licensing platform as both licensors and licensees, and ATSC 3.0 offers a range of licensing rates from $2.10 to $3 per device (TV/set-top box).

US online interactive fitness platform Peloton was accused of patent infringement

On March 8, The U.S. International Trade Commission (ITC) banned imports of video-streaming fitness devices made by Peloton Interactive Inc and iFit Inc after a judge found they infringed Dish Network Corp patents. In a 2021 complaint filed with the ITC, Dish and its Sling TV unit accused Peloton and iFit of infringing four patents for video-streaming technology through imports of products that stream at-home fitness content. These included Peloton bicycles and treadmills and iFit NordicTrack bicycles and ellipticals. A Peloton spokesperson says the company believes that there’s no infringement as charged, and the ruling will "in no way disrupt service" for its users.

The World Trade Centers Association (WTCA) is a US-based non-profit international trade organization, and its trademarks such as "WTC" and "WORLD TRADE CENTERS" have high awareness. It authorizes others to use those trademarks in the form of special license all over the world. In this case, in the building name and investment promotion advertisements, the defendant had used a large number of trademarks or marks with word size identical or similar to those of WTCA, resulting in the likelihood of confusion among the relevant public and serious infringement of the legitimate rights and interests of WTCA.
世界贸易中心协会（WORLD TRADE CENTERS ASSOCIATION）是一家总部位于美国的非营利性国际经贸组织，其在世界各地采用特别许可形式授权他人使用的“W T C”“W O R L D T R A D E CENTERS”等商标具有很高的知名度。本案被告未经许可，在楼宇名称及招商广告中大量使用与该协会商标、字号相同或近似的标识，导致了相关公众混淆误认，严重侵害了世界贸易中心协会的合法权益。
