Business Visa (M)&New short term work visa(Z)

Chinese M Visa, we can called Business Visa or Commerce & Trade Visa (before 1st Sept 2013, we called F visa) is issued to those who intend to go to China for commercial and trade activities. (not including internship).


Start from Jan 2015, Chinese release a new rule (no.78 Rule), especially for foreigner who comes into China to finish a short term work (less than 90 days). In that rule, it determines which kind of situation count as a short term working (Z) and what situation count as a short term Commerce & Trade (M). Details below, please check it carefully, when you have an interview in the Chinese Embassy or Chinese visa center, you have to give the proper answer relate to the visa type which you want to apply. Wrong answer will cause your case reject or delay:

New short term work visa(Z)

Since January 1, 2015, the new regulations regarding foreigners, entering China on M and F visas for short term work, has come into force. The new rules were formulated by the China’s Ministry of Human Resources and Social Security (MHRSS) together with he Ministries of Public Security, Foreign Affairs and Culture and are determining what types of visa is relevant to short term trips to China.


Let’s try to understand, firstly what kind of activities in China can be regarded as short term work, and what kind of specific requirements the new regulations provide.


Before new regulations were issued, the permitted activities of M visa and F visa travelers are not specified and for a long time it has been a question of dispute.


Now companies who are inviting foreign employees to China for a short term work must submit the application to the provincial or municipal Human Resources and Social Security Bureau and clarify the purpose of stay for assignments of no more than 90 days. The new rules apply to the activities for foreigners who are staying in China no longer than 90 days and can be divided into two categories:
1) M or F visa for travelers
2) short term travelers performing specific work activities.

As you can see in a table, the categories of activities that are describing as short term work now request an additional document called the Short Term Work Certificate. This new document is similar to an Employment License, which is required for Z visas.


One of the reasons to implement new regulations is specifically in order to target performing artists coming to China for shows.
As of January 1, 2015 foreigners coming to China to participate in a performing arts show are required to apply for an approval letter from the Cultural Department. The inviting company has to submit this document at the Cultural Department assigned to the area where the first show is going to be held. These activities are determined as “foreign related for-profit show or performance for commercial ends.” If the documents are successfully checked and approved, the Cultural Department will provide the Short Term Work Certificate.


After the inviting company has handed in an Employment License or an approval letter from the Cultural Department, the procedure is similar to applying for a regular work visa, where the company needs to arrange an Invitation Letter. The foreign employee can apply for a Z visa with the Invitation Letter, Employment License and Short Term Work Certificate. In this case a Health Check is not needed.


Those foreigners who are traveling to China for short term work and not engage in a performing arts show, will be able to apply for an employment license from the MHRSS. For regular work visas over 90 days the list of required documents is different. Companies need to prepare photo copies of the domestic partner’s Registration Certificate and Organization Code, a contract between the Chinese and foreign enterprise, a project contract, etc. The foreign employee needs to provide valid passport details, resume, and copies of relevant certifications technical or professional work.

Foreigners coming to China to work for more than 90 days must follow the regular procedures.

Which situation count as a short term working visa (Z Visa)?

• Foreigner (Employed and assigned by a foreign enterprise) comes to Chinese Co-operation Company to finish some technical, scientific research, management or guidance job

• Foreigner comes to Chinese sport club/organization to have a trial (including coach and athlete)

• Foreigner comes to China for a film shooting (including advertisement film and documentary film)

• Foreigner comes to China for a fashion show (including model)

• Foreign performance (for commercial performance)

Chinese M Visa

It is usually issued for up to 60 days  stay per visit and  multiple entry valid up to 10 years for US passport holder, while it is usually issued up to 60 days  stay per visit but only for single or double entry  valid for 3 or 6 months for non-US passport holder. 10 years visa is not guaranteed. Chinese Consulate may issue you a visa with  limited entry, shorter duration  and validity at their discretion.


Which situation does NOT count as a short term working ,but business(M Visa)?


• Mechanical after sales team come to China to repair, install, maintain, remove, guidance, training (Apply M visa)

• Bid Winner come to China to do the project guidance, supervision, checking (Apply M visa)

• Foreigner from head office goes to shanghai branch, representative office to have some short term work (Apply M visa)

• Foreigner comes to China to attend the sports event, including coach, athlete, team doctor, assistant etc. (Apply M visa)

When you get a M visa issued from the Chinese Embassy/Consulate in any other countries, normally the visa is in light green color, on the right top of the visa is the National Emblem of China  After you get your visa, you must first check if your name, passport number, birth date are correct or not. • Category: M (before 1st Sept 2013, we called F visa)

• Entries: M (Multiple)

• Enter Before: 3rd Sept 2014

• Duration of each stay: 030 days after entry

• Issue date: 3rd Sept 2013

It means, your current visa type is M visa (China business visa), you have Multi-entries to enter China (you can enter / leave / re-enter China as many times as you want), But you must enter China before 3rd Sept 2014. After you enter China, you can stay maximum 30 days without leaving (30 days calculated from your last entry date into China).


Business Visa applicants must provide one of the invitation letters:

A) An Invitation Letter of Duly Authorized Unit or a Confirmation Letter of Invitation issued by Government agency OR

B) An Invitation Letter issued by a company, corporation and institution in mainland China


1. Where can I get the Invitation Letter of Duly Authorized Unit for business type visa?

Invitation Letter of Duly Authorized Unit is a pre-approval document issued by a Chinese Government agency. You will need an inviting company in China to obtain that for you. Please notify your contact in China that you need this form. You may advise the Chinese inviting company to contact with one of the agencies listed below for details. Normally, it only takes 2 days to 1 week to have it approved.You will probably need to submit your passport info or a passport photocopy to the Chinese company.

  • Municipal Bureau of Commerce

  • Foreign Economic Relations & Trade Commission

  • International Trade Promotion Commission

  • Foreign Trade and Economic Cooperation Bureau


2 ) What is a qualified Invitation Letter from a Chinese company or institution?

The invitation letter issued by the Chinese company, corporation and institution must include all the 8 elements below:

1.Applicant's personal information:

A. Name

B. Gender

C. Dateof birth

D:Nationality

E.Passport number

F. Fullname of the company which the applicant works for and the job title

2.Purpose of the visit (what kind of business)

3. What city and province will the applicant visit?

4. Date of arrival and leaving

5. What kind of relationship between the Chinese company and the US company? Or What relationship between the applicant and the inviter?

6. Who will bear the cost of the applicant's accommodations in China?

7. Chinainviter's information

A. Full name of the company / unit

B. Name of the person

C. Job title in the company / unit

D. Detail company address, fax and phone number

E. Direct phone and/or cell phone number of the inviter (Must be working number)

F. Email address of the inviter

8. Actual signature of the inviter official seal of the company
