6 new laws and regulations bettering people's lives in China

In order to make people have more sense of gains in China, six new laws and regulations aiming to strengthen environmental protections, satisfy people's reading demands, reduce enterprises' burdens, protect people's rights during travel, build a credit system in the construction market, and guarantee food safety, took effect starting Jan 1.


New green tax law

China started collecting a new green tax based on the Environmental Protection Tax Law that replaces the previous pollutant discharge fee.

According to the Environmental Protection Tax Law, which targets enterprises and public institutions that discharge listed pollutants directly into the environment, companies will pay taxes for producing noise, air water pollutants and solid waste.

Where tax rates are concerned, the central authorities will set upper limits and allow local governments to determine rates on their own.

The new law rules specifically on public libraries' construction, operation, service and management.

According to the law, four services will be free to the public, including the inquiry and borrowing of literature, the reading of books in reading and study rooms, the participating in public lectures, reading promotion, training courses and expos and other state-regulated projects.


Revised promotion law to reduce enterprise burdens

According to the promotion law, the central government and local governments at or above county level should create a special fund via measures including subsidies, purchasing services and grants to build the public service system and the financing service system to support middle and small-sized enterprises.

By regulating finance and taxation policy to reduce the enterprises' burdens, the newly revised law balances fair competition and protection in market, and helps enterprises see greater gains.


Curbing bad tour guide etiquette

The new Tour Guide Management Regulation bans 11 behaviors in tour guides, including forcing visitors to buy items, bullying them with curses, unilaterally altering visitors' routes and extorting tips from visitors.

Those who violate the regulation will face severe punishment, including fines and revoked licenses.

According to new interim procedures to supervise the construction market, firms with a history of bad behavior, including defaulting on construction cost, building constructions of low quality or with safety accidents, utilizing deceptive means to obtain enterprise qualifications, and subcontracting or lending enterprise qualifications to other firms, will be posted on a "blacklist".

The local housing and urban-rural development departments should strengthen supervision of market players listed in the "blacklist" and the "blacklist" of defaulting on migrant workers' wages and restrict blacklist members’ market access, qualifications and tendering and bidding capacities.


Takeout food providers must have real restaurants

A new regulation focuses on takeout food safety, stipulating only offline catering businesses with brick-and-mortar restaurants and proper business licenses are allowed to offer online catering and ordering services.

The regulation also states online catering and ordering services should be subject to the same rules as offline restaurants.

Once a catering service is found breaking laws and regulations, the administration will inform online order platforms, which should then suspend this business from their networks.

Order-taking platforms are required to develop a food safety control system, examine, register and publish operational permits and other key information of all catering services that join the networks.

Food delivery staff are asked to maintain personal hygiene, use clean and safe containers and prevent food contamination, while employers should provide proper training and tools, especially for foods that require special preservation such as refrigeration.
