"Three illegal foreigner" or "sanfei 三非外国人" refers to foreigners who illegally enter, get employed and stay in China.
1. Illegal residence --
refers to the illegal act of a foreigner staying (stopping) in China
who has not applied for a visa or residence permit within the period of
validity stipulated in the visa or residence permit.
2. Illegal employment --
refers to the act of engaging in social labor and obtaining labor
compensation without obtaining legal employment status in China.
3. Illegal entry --
refers to the illegal act of a foreigner who does not hold a valid entry
visa or legally valid entry certificate issued by the Chinese competent
authority, or has not entered the country from China, entered a
designated port, or entered China's border without inspection by a
border checkpoint. behavior.
According to the Law of the People's Republic of China on the Administration of Exit and Entry, foreigners seeking employment in China must obtain work permits and work-related residence permit.
Foreigners who fail to obtain work permits and
residence permits for work or work outside the scope of work permits and
work-study regulations shall be fined, detained, etc. in accordance
with Article 80 of the "Entry and Exit Administration Law" Punishment.
Employing and hiring foreigners without work permits
and residence permits, or hiring and hiring foreigners who are outside
the scope of work permits and work-study programs, will be subject to
the provisions of Article 80 of the Exit-Entry Administration Law. Fines ranging from 10,000 yuan to 100,000 yuan; if there is illegal income, the illegal income is confiscated.
