中行300亿大坑,

一场外资的猎杀和阴谋!

今天继续聊中行这个价值300亿的大坑!


刀锋的直觉,这是一个巨大的阴谋和陷阱,中行原油宝,很可能是被“下套”了!外资空头大鳄们历来嗜血,吃人不吐骨头,他们跟交易所官方联手,里应外合围猎了“人傻钱多”的中国大肥羊。


主要疑点有三:


1、原油作为一款非常成熟的期货商品,已经存在了近40年,在这40年里从来没有出现过负数价格。甚至在今年4月份前,所有交易所都没有负数的报价机制。


而蹊跷的是,4月3日,芝加哥商品交易所突然通知修改了IT系统的代码,破天荒的允许“负油价”申报和成交,并从4月5日正式生效。


芝加哥为何突然这么做?如此重要的规则修改,不需要向会员单位发个征求意见稿,讨论几个月再实施吗?答案是没有。如此违背市场规律的操作,竟然直接就宣布并实施了,实在是匪夷所思。


我们并不清楚美国芝商所这么做的具体理由,但客观上,报价规则的修改,为后来中国银行客户的巨亏铺平了道路。用一个成语来形容规则修改后的市场,非常贴切,叫做请君入瓮

2、因为疫情,原油需求几乎停滞,但全球各主要石油生产国,并未减产。而全球石油储备的空间是有限的,若所有储备空间填满,现货实物交割将变得“毫无可能”。中国银行这类抄底多头,若到期完成不了实物交割,就只能接受负数价格。


据了解,芝商所石油期货到期现货交割仓库在库欣。刀锋查了一下,库欣是美国的一个内陆城市,4月中旬时库欣的原油库容已被预订一空,中行原油宝多头根本无法交割。而老练的空头资金,提前一个月就算好了库欣的库容,面临交割时,中行必将毫无还手之力。


交易所增加负数报价,交割的时候仓库又没有地方可以让中行多头客户完成实物交割,倒逼多头不计成本的疯狂出逃,最后没有出逃的,就只能按-37.63美元强制结算。客观上说,美国芝交所早就和石油空头势力挖好了一个巨大的陷阱,准备坑杀中行的300亿多头。


3、第三个疑点,是中行自身产品设计存在重大缺陷。首先就是22:00之后中行将冻结交易,不再盯市,强平;其次,选择了完全追随MYEMX到期日的产品设计思路,不会提前移仓。这两方面产品缺陷,完全可以被空头利用。


以美国时间为基准的原油期货交易,中行竟然在晚上10点后就关闭了交易窗口,实在是难以理解。难道因为自己是国企,福利好,舍不得让员工上夜班?


没有提前移仓,每天晚上10点后停止交易,几百亿的风险敞口,在美国市场交易最活跃的时间段,就一动不动的躺在那里,赤裸裸的成为待宰羔羊。


这次奔向负数的暴跌,恰恰发生在4月20日凌晨,这个时间点,中行已经退出了市场,冻结了交易。原油宝多头客户,在那个时间段没有任何出逃的可能性,人为刀俎我为鱼肉。中行拱手将300亿真金白银送给美国芝商所的石油大空头,一点儿脾气都没有!

从美国芝商所修改报价规则,到交割仓库无法实现多头客户交割,再到中国银行在最关键的的几个小时冻结交易,三大条件形成共振,一场针对中国银行原油宝客户的猎杀就形成了闭环。


300亿巨额亏损,触目惊心,背后是多少家庭的血和泪?



对于此次踩雷事件,投资者当然要为自己的投资行为负责,甚至亏损的大部分损失要自己扛下来,但中行自身的责任也不小。


除了产品设计缺陷,风控不作为,风险警示不够,向一般理财用户兜售高风险产品等违规的地方,更大的责任在于,中国的资本账户尚未对外开放,个人投资海外证券期货市场是被严格禁止的,中行为何可以突破政策红线代理外盘期货业务?是谁授权的?这种金融创新,难道不构成非法经营吗?


A股都有各种门槛来保护中小投资者,原油外盘期货这种极高风险的市场,反而毫无门槛的去给国外送韭菜,该产品的决策者其心可诛!


若继续阴谋论的恶意揣测,上述种种缺陷和问题,金融专业人士不可能不明白。中行有没有内部人跟空头大鳄“里应外合”恶意串通的可能性,毕竟是300亿的巨额国家财富,而且还要兑换成美元赔给人家。在中国历史上,这种金融卖国贼并不稀缺!


若不想背上卖国贼的骂名,中国银行就应该有点儿骨气,带上投资者一起到美国,状告芝加哥交易所任意修改规则,公告时间不足,风险警示不够等相关责任。


如果是新规则下的IT系统失灵,或者存在恶意操纵,甚至是交易所联手空头坐庄下套,我们完全可以主张那个时间段的交易无效。这在历史上也是有先例的,比如著名的327国债事件。


不过,说实话,刀锋认为起诉成功的概率极低。这些五花八门的金融衍生品,本来就是西方人发明的,各种规则充满陷阱和机关,我们有什么资本跟人家斗智斗勇呢?

中行原油宝的舆论还在发酵……大家都在争执:究竟是投资者的错?还是中行的错?


中证君采访多位事件“亲历者”及资深业内人士,力求揭示此事的来龙去脉、是非对错。


聚焦一:

“原油宝”到底是个啥?

资深期货人士Y先生解释,“原油宝”是双向交易机制,可以买,也可以卖。中行没有交易所的职能,所以大量多头和空头的交易,中行会打包起来,净风险头寸拿到境外交易所去做。比如你买了1000万原油宝,中行就去CME交易所开仓1000万等值的原油期货。


中国农业大学经济管理学院教授、中国期货市场创始人之一常清对中证君表示,对于原油宝产品,银行实际是绕了弯子,集合了散户的钱在国外做期货。中行虽然做的是交割月的现货,但实际还是期货的一个月份。


针对此产品的特点,中行也有介绍。

聚焦二:

为什么会出现“倒欠”?中行有权追偿吗?


对于中行的类似“欠费”短信,不仅投资者感到震惊,不少银行投资人士也称这属于“活久见”。


某大行投资人士表示,以往投资最多只是亏损本金,那是因为大家默认的资产价格最低是0。尽管期货市场有保证金这个形式,但保证金也最多亏完而已。这次资产价值直接变成了负值,亏损就可能无穷大。


公众号“秦小明”解释:“由于原油高额的存储成本,如果你买它进入交割,将耗费巨大的交易成本来接货。这种交易成本就包括了仓储和运输等成本以及你倒掉的话面临的环保罚款成本。负价格,即是这些成本的体现。”


关于追偿问题,《中国银行股份有限公司个人账户商品业务交易协议》中,第十四条关于银行追索权有明确规定:


“因各类原因产生客户交易专户透支、资金不足的事实时,客户负有及时补足资金的义务,客户同意银行有权暂时冻结其签约账户,客户应在银行通知的时间内补足交易专户内的资金。”


因此,有分析人士认为追偿是合乎规定的。Y先生认为:“做原油宝的投资就是在做期货。既然涉及到期货交易,那必然会有追缴保证金这一项。中行在境外交易所穿仓,那就有向投资者追偿的权利。”


聚焦三:

为什么有这么多人涌入中行原油多头?


据多位市场人士解释,疫情冲击需求叠加石油价格战,石油价格不断创出新低,这是大量投资者涌入“纸原油”市场的背景。同时,国内适合普通投资者的原油投资工具匮乏,银行“纸原油”投资是除了股票、期货产品之外的主要选择,为不少投资者所熟知。


投资者T先生告诉中证君,他长期从事投资,股票、期货、黄金和比特币等都交易过,总体来说有赚有赔。对原油走势也一直在关注。“虽然疫情对需求有影响,但毕竟作为自然资源,用一点少一点,价格不可能维持在低位。因此,国际油价30美元的时候我就琢磨投资方式了。”


“从事纸原油交易,是我一个朋友介绍的,他近期赚了几百万,让我也很心动。但是之前接触不多,所以当时只是选择性买了几十桶。现在想来这个决定真是不幸中的万幸。截至到4月22日,我账户倒欠2万元。而我那个朋友,亏惨了。”T先生表示。


至于为什么选择中国银行的“原油宝”产品,他表示,之前也对比过工行、建行、交行等产品,后来觉得中国银行国际化程度最高,对国际市场也最熟悉。


聚焦四:

交割为何那么晚?制度有无漏洞?


Y先生表示,投资者不懂期货合约的展期性质,以为买了原油宝就不用去管。实际上中行给投资者提前展期的权利了,只是大多数投资者并没有用,所以被动地在最后交易日由中行展期,导致大量亏损。


“秦小明”认为,中行选择在最后交易日移仓,事实上是对接了NYMEX(纽约商品交易所)对于美国原油各个月份的最后交易日的规定。从逻辑上,这种设计实际上更能与国际油价市场无缝对接,使得投资者在美国原油到期前,可以充分自主地选择何时移仓。


“其他银行提前了5天来移仓,似乎避免了这次巨亏。但如果暴跌到负价的行情发生在倒数第6天呢?”有市场人士告诉中证君,“在投资者中的空头看来,这样的移仓或许是没有问题的。”


常清在接受中证君采访时表示:“深谙期货交易的人都知道,做交割月的品种,需要人才支撑,得有专业的研究支持。挂钩之后不能随便再动头寸,也是它这种傻瓜交易方式带来的。”


但常清不能理解的是:这种傻瓜式交易背后的意义是什么?“这种傻瓜式交易在平时是没有问题的,但就怕极端行情。”


有期货人士表示,临近交割月份的合约交易流动性较差,可能会产生平仓价位滑点较大、平仓无法成交、出现交割违约等风险,中行本应考虑在内。


聚焦五:

是否进行了充分的风险提示?谁来买单?


中行表示,在原油宝产品介绍中,已对风险进行了提示。

然而今年3月以来,原油价格波动剧烈。4月8日,芝商所公告了一份关于结算价调整计划的文件,声称“对于任何月份的WTI原油期货,当它的结算价低于8美元/桶时,WTI期货期权的结算价计算模型将从原来的模型切换到Bachelier模型”。


4月15日,芝商所又发布了测试公告称,如果出现零或者负价格,CME的所有交易和清算系统将继续正常运行,所有常规交易和头寸处理都可以在清算中执行,即已经完成了测试准备。


Y先生表示:“中行制度设计上考虑不周也是比较明显的——对原油价格为负没有提前考量,对CME的公告完全无视,对投资者没有提前强调这些风险。CME修改结算系统,将坐标轴改为正负数,就应该知道原油价格可能为负数。没有期货背景知识,碰这些东西就会很痛苦。”


一位资深法律人士对中证君表示,在个人投资者参与“原油宝”交易前,个人投资者需签署《中国银行股份有限公司个人账户商品业务交易协议》,该协议中风险揭示项下规定“个人账户商品交易业务要求投资者为风险评级在平衡型以上,可与银行签订有关产品协议。”这个“平衡型”风险评级离普通人的认知相距甚远。


从法律层面,该人士认为,需要关注以下三点:


一是中行在根据监管要求对投资者进行“了解客户”的适当性审查时,是否真正了解投资者可以承受的风险,其涉及的问卷是否考虑到了除本金损失之外,还要再补足交割款的情况;


二是要求投资者风险为”平衡型“的要求是否妥当,“补足交割款”如此巨大的风险显然不是平衡型投资者所能承受;


三是中行在对产品风险定级方面,是否已经充分认识到了产品的复杂性和风险,是如何给该产品确定风险等级的。


不过,投资者也并非“无辜”。


Y先生表示:“做交易首先要了解规则。杠杆本身没错,你不懂规则,强行抄底,仓位大,就会被人盯上。只不过这次发生在境外交易所,而且中行作为代理银行,背了锅,实际上是个人投资者的无知闹了这个笑话。当然中行是有责任的,制度设计上风险考虑不周。”


在媒体对事件的报道中,一部分原油宝投资者也坦言,没有仔细阅读合同,对交易规则没有研究。


聚焦六:

海外资本收割中国投资者?CME预谋已久?


原油宝事件中,有人提出,CME随意改规则(允许价格为负),没有给予会员与客户缓冲期,存在不妥。


对此,常清认为,CME此举恰恰是面对市场的灵活调整。原油和铜等其他大宗商品不同,不便储存,又不能像牛奶一样倒掉,库存不够的话,只能贴钱卖。允许期货价格为负数,说明它的市场化程度比较高。


而美国原油期货交割制度下的库容问题,恰恰是此次问题的核心。有业内人士指出,促狭的库容空间下,多头即便交割也无处寻找库容存放交割原油,其交割制度的弊端再次暴露。


这次事件凸显了中国期货市场的制度优势,但国内投资者要在境外市场抄底原油,也说明了定价权旁落,凸显了中国期货市场做大做强的重要性。


聚焦七:有何启示?


对于投资者而言,“银行推荐的不熟悉的理财或者产品,没有背景知识不要去买。”Y先生说。


一位从事期货投资者教育的人士告诉中证君:“我们做投资者教育,整天跟投资者讲市场有风险、投资需谨慎,很多人当作耳旁风。亏钱,从另一层面理解是最好的风险教育。不熟不做,不是一句空话。”


部分期货人士称,这次事情出来以后,有很多不知内情的人更加“谈期色变”,其实是不专业的人做了专业的事情,期货工具本身不应该背这个锅。


从产品设计来看,有期货人士指出,原油宝类似一个长期持有的期货头寸,而且一般来说费用比期货公司高。


但为什么期货机构不能提供,而是由银行来做这类产品?


业内人士表示,监管对期货理财产品创新一直的态度是偏谨慎的。期货公司虽然有专业能力和资源,但没有做这类业务的资格。而类期货交易一直缺乏统一监管,处于“五龙治水”的局面。


常清也认为其中有资源错配的成分。“这从侧面也对国内期货市场提了个醒。国内期货市场没有灵活适应投资者的工具可以提供,广大散户想要分享价格变动的好处,却没有靠谱的工具。这种傻瓜交易在国内专业的期货公司也可以做,而且研究和风控经验和力量更为充足。”


他认为,从监管理念上,也许是时候该调整理念以提升对投机客户的服务。“这部分流动性做好,也有助解决目前大企业套保面临的流动性不足难题。”

They had arrived in San Francisco, where their ship was decommissioned, and Paul bet that he would find himself a wife within two weeks. He was a taut, tattooed engine mechanic, six feet tall, with a passing resemblance to James Dean. But it wasn’t his looks that got him a date with Clara Hagopian, a sweet-humored daughter of Armenian immigrants. It was the fact that he and his friends had a car, unlike the group she had originally planned to go out with that evening. Ten days later, in March 1946, Paul got engaged to Clara and won his wager. It would turn out to be a happy marriage, one that lasted until death parted them more than forty years later. Paul Reinhold Jobs had been raised on a dairy farm in Germantown, Wisconsin. Even though his father was an alcoholic and sometimes abusive, Paul ended up with a gentle and calm disposition under his leathery exterior. After dropping out of high school, he wandered through the Midwest picking up work as a mechanic until, at age nineteen, he joined the Coast Guard, even though he didn’t know how to swim. He was deployed on the USS General M. C. Meigs and spent much of the war ferrying troops to Italy for General Patton. His talent as a machinist and fireman earned him commendations, but he occasionally found himself in minor trouble and never rose above the rank of seaman. Clara was born in New Jersey, where her parents had landed after fleeing the Turks in Armenia, and they moved to the Mission District of San Francisco when she was a child. She had a secret that she rarely mentioned to anyone: She had been married before, but her husband had been killed in the war. So when she met Paul Jobs on that first date, she was primed to start a new life. Like many who lived through the war, they had experienced enough excitement that, when it was over, they desired simply to settle down, raise a family, and lead a less eventful life. They had little money, so they moved to Wisconsin and lived with Paul’s parents for a few years, then headed for Indiana, where he got a job as a machinist for International Harvester. His passion was tinkering with old cars, and he made money in his spare time buying, restoring, and selling them. Eventually he quit his day job to become a full-time used car salesman. Clara, however, loved San Francisco, and in 1952 she convinced her husband to move back there. They got an apartment in the Sunset District facing the Pacific, just south of Golden Gate Park, and he took a job working for a finance company as a “repo man,” picking the locks of cars whose owners hadn’t paid their loans and repossessing them. He also bought, repaired, and sold some of the cars, making a decent enough living in the process. There was, however, something missing in their lives. They wanted children, but Clara had suffered an ectopic pregnancy, in which the fertilized egg was implanted in a fallopian tube rather than the uterus, and she had been unable to have any. So by 1955, after nine years of marriage, they were looking to adopt a child. Like Paul Jobs, Joanne Schieble was from a rural Wisconsin family of German heritage. Her father, Arthur Schieble, had immigrated to the outskirts of Green Bay, where he and his wife owned a mink farm and dabbled successfully in various other businesses, including real estate and photoengraving. He was very strict, especially regarding his daughter’s relationships, and he had strongly disapproved of her first love, an artist who was not a Catholic. Thus it was no surprise that he threatened to cut Joanne off completely when, as a graduate student at the University of Wisconsin, she fell in love with Abdulfattah “John” Jandali, a Muslim teaching assistant from Syria. Jandali was the youngest of nine children in a prominent Syrian family. His father owned oil refineries and multiple other businesses, with large holdings in Damascus and Homs, and at one point pretty much controlled the price of wheat in the region. His mother, he later said, was a “traditional Muslim woman” who was a “conservative, obedient housewife.” Like the Schieble family, the Jandalis put a premium on education. Abdulfattah was sent to a Jesuit boarding school, even though he was Muslim, and he got an undergraduate degree at the American University in Beirut before entering the University of Wisconsin to pursue a doctoral degree in political science. In the summer of 1954, Joanne went with Abdulfattah to Syria. They spent two months in Homs, where she learned from his family to cook Syrian dishes. When they returned to Wisconsin she discovered that she was pregnant. They were both twenty-three, but they decided not to get married. Her father was dying at the time, and he had threatened to disown her if she wed Abdulfattah. Nor was abortion an easy option in a small Catholic community. So in early 1955, Joanne traveled to San Francisco, where she was taken into the care of a kindly doctor who sheltered unwed mothers, delivered their babies, and quietly arranged closed adoptions. Joanne had one requirement: Her child must be adopted by college graduates. So the doctor arranged for the baby to be placed with a lawyer and his wife. But when a boy was born—on February 24, 1955—the designated couple decided that they wanted a girl and backed out. Thus it was that the boy became the son not of a lawyer but of a high school dropout with a passion for mechanics and his salt-of-the-earth wife who was working as a bookkeeper. Paul and Clara named their new baby Steven Paul Jobs. When Joanne found out that her baby had been placed with a couple who had not even graduated from high school, she refused to sign the adoption papers. The standoff lasted weeks, even after the baby had settled into the Jobs household. Eventually Joanne relented, with the stipulation that the couple promise—indeed sign a pledge—to fund a savings account to pay for the boy’s college education.
