川普“社死”背后,隐藏着令全世界所有人恐惧的大趋势

按:“三权”做不到、甚至冷战和“热战”中美国所有敌人都未曾做到的事(让美国总统“社交死亡”),互联网巨头通过联手垄断,在短短72小时内做到了,这难道还不令美国人、令全世界所有人恐惧吗?


特朗普“社死”的警示:

该给互联网巨头套上“笼头”了

直到当地时间1月6日傍晚之前,特朗普在推特等社交媒体平台上仍是摧枯拉朽般的“超级存在”:千军万马在他的信息引导下从四面八方风聚云合,将看似戒备森严、神圣不可侵犯的国会大厦瞬时占领,平素神通广大的国会议员匆匆作鸟兽散。


然而一切也就到此为止,骚乱几日后,“推特总统”的推特消失了。


事实上“被消失”的远不仅仅是推特:据不完全统计,截至当地时间11日,对特朗普及其支持者采取屏蔽、删号等措施的网络服务平台,包括推特、Facebook等15家。


这15家实际上可细分为两个层次:提供“大平台”服务的“超级巨头”(苹果、谷歌、亚马逊,它们屏蔽特朗普及其支持者的方式,是将或威胁仍不愿加入“删除特朗普”行列的应用,从其应用商店或Web服务器上删除),和提供网络社交互动服务的平台(如Facebook和推特),比较“另类”的则是一些看似不甚相关的应用,如Shopify是一个网店平台,却在72小时内关闭了一些售卖特朗普竞选“周边”的网店;又如Stripe是个在线支付平台,它宣布将不再为继续筹款的特朗普竞选团队和密切政治支持者提供政治献金等的支付服务。


不难看出,此次“数码帝国”针对特朗普的“闪电战”,呈现出典型的“纲举目张”态势“大平台”和推特等顶级垄断性社交媒体平台联手,并利用自己的“准入”筹码逼迫一众中小网络社交媒体为“保平台”加入本方阵营,最终以令人瞠目结舌的高效率,让特朗普在72小时内从网络平台的“超级麦霸”变成了“社交消失”的“网络哑巴”。


事实上“被消失”的不仅是特朗普本人及其一家老小,被“株连”的还包括一些著名的特朗普支持者。


但与此同时,一个微弱、但迅速变大的质疑声开始响起:互联网巨头的手臂,是否太大、太长、太快了?如果说特朗普及其狂热支持者的所言所行、所作所为是在煽动暴力、甚至实施暴力,那么这种超越一切、凌驾一切、不容置疑和反抗的一手遮天式的“定点清除”,难道不同样是一种暴力,甚至是一种更可怕、更难以规避和抗拒的暴力?



首先,不少人认为,特朗普及其狂热支持者的许多言论的确“出格”,针对这些“出格”之处采取措施,是毫无问题的,但作为一个网民,特朗普有合法使用网络、使用社交媒体平台正常发言的基本权利,他的妻儿老小和众多支持者也同样如此,在1月6日后的“群殴”中,许多特朗普从未注册过的平台也加入战团,一些很少发表过激言论的亲友也被“连带”,这是否有“瓜蔓抄”之嫌?


其次,直到1月20日,特朗普还是美国的法定最高行政长官、武装部队总司令,国会、联邦最高法院、他的副总统……构成美国联邦最高权力平衡的“三权”在这天之前,事实上无法剥夺他的这些权限(尽管八旬老人佩洛西不依不饶地推动弹劾,但谁都知道仅剩这几天根本无法成功),但“三权”做不到、甚至冷战和“热战”中美国所有敌人都未曾做到的事(让美国总统“社交死亡”),互联网巨头通过联手垄断,在短短72小时内做到了,这难道还不令美国人、令全世界所有人恐惧吗?


第三,特朗普的竞选团队仍然是合法实体,他和他的支持者通过正当程序谋求政治献金的行为也并不逾矩,兜售选举“周边”不仅不违法,更未必和特朗普本人有什么直接关联,迄今也没有任何立法或司法机关对上述实体及其行为加以指摘,然而互联网巨头们却“领先一步”进行“无差别围剿”,且大有蔓延深化、“株连九族”的势头这难道不令人不寒而栗吗?


尽管1月6日后舆情和政治空气一度一边倒,但仍有不少人“站出来”质疑互联网巨头的行为。


歌手希尔森1月9日在Instagram上表示,不赞同网络巨头对特朗普的围剿,她认为“如果互联网巨头可以轻易对一个世界第一大国元首进行封口行动,一旦它们将这种行为转移针对一个普通人,后果会如何可想而知”。她的言论在歌迷和评论家中激起热烈争论,最终迫使希尔森删帖——但希尔森的“闭嘴”让更多人感到更加可怕:在此之前,希尔森并未表现出对政治的特别兴趣,或对某个政党、政治家、政治主张的明显倾向,如果这样一个“素人”仅因言论“不合时宜”就难以被“兼容”,所谓“普通人的言论自由”又在哪里?


传媒学教授祖克曼等专家指出,必须慎重对待此次出现的网络社交媒体平台自我筛选动态,并在国会进行充分讨论,且不能任由任何单方面对何为“合适的言论和言论自由”作出解读,否则“将是十分危险的信号和趋势”。


甚至民主党内也开始出现冷静的声音。


一贯支持民主党内左翼旗手桑德斯的左翼社会活动家拉塔科夫斯基在1月8日呼吁“停止为互联网巨头封杀特朗普欢呼”,因为“它们曾为特朗普推波助澜,如今却以其‘煽动暴力’为由让他们的声音迅速消失——但倘若下次它们认定的‘煽动暴力’者是我们呢?‘煽动暴力’固然应该惩罚,但谁给了这些互联网巨头裁定何为‘煽动暴力’的、不容置疑的权力”?在他们看来,互联网巨头和平台加强自律当然是必要的——但对它们的监管同样是必要的。


正如一些欧盟、东亚甚至印度网友所指出的,互联网巨头的“72小时闪电战”,对美国以外国家朝野的震撼和警示作用更为直接和明显:一旦这些互联网巨头倚仗自己的网络垄断力和“自由裁判权”,为某个美国政治势力在自己的国家“开路”,或者索性,这些互联网巨头仅仅自己打算在异国他乡“任性”一把,比美国或特朗普弱小的多的国家、实体和个人,又将如何自卫?


答案只有一个:给互联网巨头套上“笼头”。


在此方面,欧盟堪称先知先觉者。


早在2004年,欧盟就通过了世界上最早的《数字服务法》,从而成为全球首个对数字化市场、产品和服务实施立法、依法监管的大市场。


但时过境迁,16年后的今天,全球互联网巨头,尤其包括苹果、Facebook、谷歌、亚马逊等在内的美国互联网公司,往往利用自己在市场的优势地位,采用诸如通过恶意并购消除潜在市场竞争对手、借助市场垄断地位搜集用户个人信息等手段,从而令对手难以与之竞争。它们还利用欧美间税率及监管的差异,见缝插针,规避税收,牟取暴利,而“古色古香”的2004年版《数字服务法》对这些行为徒呼奈何,欧盟本土互联网企业则在这种力量不均等竞争中宛如螳臂当车,一触即溃。


鉴于此,在欧盟委员会主席冯德莱恩亲自牵头推动下,欧盟竞争专员、反托拉斯负责人、丹麦政治家韦斯特格和欧盟内部市场专员、数码领域负责人、法国企业家布雷顿领衔组成专门委员会,负责制订新版数字服务和数字市场法规,以期替代旧版,堵塞监管漏洞,限制全球互联网公司在欧盟市场上的“为所欲为”。


2020年12月15日,两位欧盟专员向欧盟委员会递交了《数字服务法》和《数字市场法》草案,这被认为是正式启动对境外、尤其美国互联网巨头强化监管的标志性事件。


两个新版法案草案的推出,标志着主张“罚就是管”、被称作“税务女士”的韦斯特格,和主张“欧洲第一”、认为欧盟和各成员国政府应采取积极介入措施“自上而下”保护自身数字化市场和业内企业的布雷顿这两位“欧洲数码监管支柱”几经磨合,终于联手出击。而在“互联网巨头闪电战”发生后,法、德两国政府有关人士不约而同表示,应“加快推动两个法规在欧盟各国落实生效的速度”,以应对随时可能发生的“美国互联网巨头突袭”。


事实上,针对全球互联网巨头“无法无天”、尤其千夫所指的用户信息滥用和恶意收购等“托拉斯”行为,近期全球各主要市场都不约而同加大监管力度:日本、印度、俄罗斯,以及正忙于“脱欧”的英国,都拿出了各自版本针对互联网巨头的“紧箍咒”。如果说,在“闪电战”之前,针对上述国家的这类行为,坊间非议声尚多,但在特朗普“被消失”后,对此表示“充分理解”者明显增多了不少。


耐人寻味的是,特朗普本人其实也曾做过这方面努力。


2020年5月,特朗普曾签署行政令,要求官员重新审查美国《通信规范法》第230条赋予社交媒体平台的豁免权。一旦推特和Facebook等社交媒体平台被认为不公平地通过某些手段控制用户言论,如封号或删帖,联邦监管机构将更易对其进行问责。不过这一尝试被淹没在选举年的党争和一片混乱中。


“必须抑制互联网巨头的无法无天”事实上已渐成美国跨党派、跨阶层、跨地域的共同认识。


许多人都注意到,当选总统拜登在互联网巨头发动针对特朗普及其支持者“定点清除闪电战”过程中及之后,均保持了绝对缄默——或许他也不得不正视互联网巨头超越“世界第一公权力”的“超级裁判权”,并正在思考着1月20日接班之后,自己应就此作何应对。


美式“言论自由”,默克尔也看不下去了

推特、脸书等美国互联网巨头“封杀特朗普”如火如荼之际,一些欧洲国家发现事情有些不对劲。美国Politico网站11日报道称,德国总理发言人表示,默克尔总理对特朗普推特账号被冻结的方式持保留态度,并补充称,应该由立法者(而非私营企业)决定针对“言论自由”的必要限制。
 
在美国互联网巨头的“联合绞杀”下,在一个标榜“言论自由”的国家,总统被“堵住了嘴”。
 
“封号”时机惹争议
 
对于“封号”,科技巨头们给出的理由看起来相当正义。推特解释称,领导人账户“并非完全凌驾于我们的规定之上”,不得利用推特煽动暴力。
 
但路透社注意到,脸书和推特等公司以前可不敢这样对待特朗普,反而对他很是“宽待”,即便特朗普所发帖文违反规定,也以其“关乎公共利益”为由加以保留。
 
有分析称,表面上看,社交媒体此时封禁美国领导人账号是制止传播暴力的合理正当行为,但实际上却夹杂不少政治私心。
 
 
曾在奥巴马执政时期担任白宫通讯联络办公室主任的珍妮弗·帕尔米利指出,社交媒体公司们决定对特朗普采取更多措施的那天,正好跟他们得知国会所有能监管他们的委员会都将被民主党掌控是同一天。
 
“伸缩自如”的美式“言论自由”,在全世界面前露了怯。
 
据美联社报道,墨西哥总统洛佩斯·奥夫拉多尔批评说:“我不喜欢任何人被剥夺在推特或脸书网站上发布信息的权利。我不同意这种做法,我不接受。”
 

法国财长勒梅尔(Bruno Le Maire)在法国国营广播电台“France Inter”采访中说,他震惊于推特自己关闭这个账号,认为“数字寡头是悬在所有国家和民主制度头上的威胁之一”。
 
欧洲议会最大跨国党团“欧洲人民党”主席韦伯(Manfred Weber)也表态称,“欧盟一定不能任由脸书和推特来决定其平台(内容)可接受范围。”
 
“我们不能留着让美国大型科技公司来决定,我们该讨论或不该讨论什么,以及在‘民主’交流中可以或不可以说什么。”
 
“清算潮”仍在继续
 
值得注意的是,美国互联网巨头对特朗普及其支持者的“清算潮”仍在继续。除了特朗普本人,他的一批亲信,如迈克尔·弗林、西德尼·鲍威尔等一大批人,以及特朗普的不少支持者的推特账号也遭到封禁。
 
据路透社报道,当地时间1月11日晚,美国社交媒体推特表示,自上周五(8日)以来已封停了70000多个帐户,这些帐户主要用于分享所谓QAnon阴谋论内容。
 
推特公司表示:“这些帐户被用于大规模分享与QAnon相关的有害内容,并且主要致力于在整个推特上传播这种阴谋论。”
 
“清算潮”在美国国内也掀起了关于“言论自由”的舆论风暴。
 
推特上,保守派人士相信“奥威尔的1984已经降临美国”,而《华盛顿邮报》则在1月12日发表“套娃式”评论抨击:“那些叫嚷‘奥威尔’的保守党才是真正的‘奥威尔份子’”。
 
《费城询问报》称,大规模的“封号”引发了人们质疑,到底什么样的言论可以是受保护的,以及社交媒体公司在规范在线交流中的作用。宾夕法尼亚大学传播学助理教授莱尔克斯(Yphtach Lelkes)认为,推特封禁特朗普账号的做法可能会加剧主流社交媒体平台保守派之间的不信任感。
 

“近期的事态发展凸显了少数社交媒体公司的巨大影响力。”《纽约时报》称,美国许多法律界人士对事态发展感到不安,这些公司在很大程度上不受问责制的影响,并在言论立场上存在很大的随意性。
 
美国公民自由联盟(ACLU)律师凯特·鲁恩(Kate Ruane)表示:“我们理解当前对于永久封禁特朗普账号的意愿,但是当脸书和推特这样的公司行使不受限制的权力将人们从平台上赶走时,这应该引起所有人的关注,而这些平台对于数十亿人来说,是他们表达观点必不可少的途径。”
 
“国会山之乱暴露了我们民主国家的脆弱性,而监管不足的科技公司可能对我们生存构成威胁。”Politico网站在10日的另一篇文章中将推特封禁特朗普账号称作“美国社交媒体的911时刻”。
 
文章称,就像911事件标志全球安全范式转变一样,20年后的今天人们在见证数字平台在民主制度中的颠覆作用。
 
有分析认为,如果说国会骚乱让世界重新认识了美式民主,那么总统被封号事件则让世界重新认识了美式“言论自由”。

They had arrived in San Francisco, where their ship was decommissioned, and Paul bet that he would find himself a wife within two weeks. He was a taut, tattooed engine mechanic, six feet tall, with a passing resemblance to James Dean. But it wasn’t his looks that got him a date with Clara Hagopian, a sweet-humored daughter of Armenian immigrants. It was the fact that he and his friends had a car, unlike the group she had originally planned to go out with that evening. Ten days later, in March 1946, Paul got engaged to Clara and won his wager. It would turn out to be a happy marriage, one that lasted until death parted them more than forty years later. Paul Reinhold Jobs had been raised on a dairy farm in Germantown, Wisconsin. Even though his father was an alcoholic and sometimes abusive, Paul ended up with a gentle and calm disposition under his leathery exterior. After dropping out of high school, he wandered through the Midwest picking up work as a mechanic until, at age nineteen, he joined the Coast Guard, even though he didn’t know how to swim. He was deployed on the USS General M. C. Meigs and spent much of the war ferrying troops to Italy for General Patton. His talent as a machinist and fireman earned him commendations, but he occasionally found himself in minor trouble and never rose above the rank of seaman. Clara was born in New Jersey, where her parents had landed after fleeing the Turks in Armenia, and they moved to the Mission District of San Francisco when she was a child. She had a secret that she rarely mentioned to anyone: She had been married before, but her husband had been killed in the war. So when she met Paul Jobs on that first date, she was primed to start a new life. Like many who lived through the war, they had experienced enough excitement that, when it was over, they desired simply to settle down, raise a family, and lead a less eventful life. They had little money, so they moved to Wisconsin and lived with Paul’s parents for a few years, then headed for Indiana, where he got a job as a machinist for International Harvester. His passion was tinkering with old cars, and he made money in his spare time buying, restoring, and selling them. Eventually he quit his day job to become a full-time used car salesman. Clara, however, loved San Francisco, and in 1952 she convinced her husband to move back there. They got an apartment in the Sunset District facing the Pacific, just south of Golden Gate Park, and he took a job working for a finance company as a “repo man,” picking the locks of cars whose owners hadn’t paid their loans and repossessing them. He also bought, repaired, and sold some of the cars, making a decent enough living in the process. There was, however, something missing in their lives. They wanted children, but Clara had suffered an ectopic pregnancy, in which the fertilized egg was implanted in a fallopian tube rather than the uterus, and she had been unable to have any. So by 1955, after nine years of marriage, they were looking to adopt a child. Like Paul Jobs, Joanne Schieble was from a rural Wisconsin family of German heritage. Her father, Arthur Schieble, had immigrated to the outskirts of Green Bay, where he and his wife owned a mink farm and dabbled successfully in various other businesses, including real estate and photoengraving. He was very strict, especially regarding his daughter’s relationships, and he had strongly disapproved of her first love, an artist who was not a Catholic. Thus it was no surprise that he threatened to cut Joanne off completely when, as a graduate student at the University of Wisconsin, she fell in love with Abdulfattah “John” Jandali, a Muslim teaching assistant from Syria. Jandali was the youngest of nine children in a prominent Syrian family. His father owned oil refineries and multiple other businesses, with large holdings in Damascus and Homs, and at one point pretty much controlled the price of wheat in the region. His mother, he later said, was a “traditional Muslim woman” who was a “conservative, obedient housewife.” Like the Schieble family, the Jandalis put a premium on education. Abdulfattah was sent to a Jesuit boarding school, even though he was Muslim, and he got an undergraduate degree at the American University in Beirut before entering the University of Wisconsin to pursue a doctoral degree in political science. In the summer of 1954, Joanne went with Abdulfattah to Syria. They spent two months in Homs, where she learned from his family to cook Syrian dishes. When they returned to Wisconsin she discovered that she was pregnant. They were both twenty-three, but they decided not to get married. Her father was dying at the time, and he had threatened to disown her if she wed Abdulfattah. Nor was abortion an easy option in a small Catholic community. So in early 1955, Joanne traveled to San Francisco, where she was taken into the care of a kindly doctor who sheltered unwed mothers, delivered their babies, and quietly arranged closed adoptions. Joanne had one requirement: Her child must be adopted by college graduates. So the doctor arranged for the baby to be placed with a lawyer and his wife. But when a boy was born—on February 24, 1955—the designated couple decided that they wanted a girl and backed out. Thus it was that the boy became the son not of a lawyer but of a high school dropout with a passion for mechanics and his salt-of-the-earth wife who was working as a bookkeeper. Paul and Clara named their new baby Steven Paul Jobs. When Joanne found out that her baby had been placed with a couple who had not even graduated from high school, she refused to sign the adoption papers. The standoff lasted weeks, even after the baby had settled into the Jobs household. Eventually Joanne relented, with the stipulation that the couple promise—indeed sign a pledge—to fund a savings account to pay for the boy’s college education.
