今年4月初,上海市税务局第一稽查局依法受理了关于郑爽涉嫌偷逃税问题的举报。国家税务总局高度重视,指导天津、浙江、江苏、北京等地税务机关密切配合上海市税务局第一稽查局,针对郑爽利用“阴阳合同”涉嫌偷逃税问题,以及2018年规范影视行业税收秩序以后郑爽参加的演艺项目和相关企业及人员涉税问题,以事实为依据,以法律为准绳,依法依规开展全面深入检查。
日前,上海市税务局第一稽查局已查明郑爽2019年至2020年未依法申报个人收入1.91亿元,偷税4526.96万元,其他少缴税款2652.07万元,并依法作出对郑爽追缴税款、加收滞纳金并处罚款共计2.99亿元的处理处罚决定。国家税务总局坚决支持上海市税务局第一稽查局对郑爽偷逃税案件依法严肃进行处理,要求各级税务机关对各种偷逃税行为,坚持依法严查严处,坚决维护国家税法权威,促进社会公平正义。近年来,税务部门持续加强对高收入人群、高风险行业的税收监管,会同相关部门深入开展影视行业税收秩序综合治理。针对当前影视行业个别从业人员偷逃税的新手法,税务部门将与广电、电影等行业主管部门密切协作,加强对影视企业和从业人员的法治宣传教育,保障影视企业和从业人员合法权益,完善跨部门常态化联动监管机制,持续提升精准监管能力,加大“双随机、一公开”抽查力度,严厉查处和曝光各类恶意偷逃税行为,进一步规范影视行业税收秩序,弘扬社会主义核心价值观,促进影视行业长期健康规范发展。
【上海市税务部门依法对郑爽偷逃税案件进行处理】
今年4月初上海市税务局第一稽查局依法受理关于郑爽涉嫌偷逃税问题的举报后,在国家税务总局指导督办下,在天津、浙江、江苏、北京等地税务机关配合协助下,针对郑爽利用“阴阳合同”涉嫌偷逃税问题,以及2018年规范影视行业税收秩序以后郑爽参加的演艺项目和相关企业及人员涉税问题开展全面深入检查。
经查,郑爽于2019年主演电视剧《倩女幽魂》,与制片人约定片酬为1.6亿元,实际取得1.56亿元,未依法如实进行纳税申报,偷税4302.7万元,其他少缴税款1617.78万元。同时查明,郑爽另有其他演艺收入3507万元,偷税224.26万元,其他少缴税款1034.29万元。以上合计,郑爽2019年至2020年未依法申报个人收入1.91亿元,偷税4526.96万元,其他少缴税款2652.07万元。
郑爽上述行为违反了2018年以来中央宣传部、文化和旅游部、国家税务总局、国家广播电视总局、国家电影局等部门三令五申严禁影视行业“天价片酬”“阴阳合同”等要求,偷逃税主观故意明显,严重扰乱税收征管秩序,违反了相关税收法律法规,税务部门依法予以从严处理。
上海市税务局第一稽查局依据《中华人民共和国税收征收管理法》《中华人民共和国个人所得税法》《中华人民共和国增值税暂行条例》等相关法律法规,对郑爽追缴税款、加收滞纳金并处罚款共计2.99亿元。郑爽在税务部门送达行政处理处罚决定书时未提出异议,表示不复议不起诉,并已在规定期限内缴清全部税款和滞纳金。税务部门正依法督促其在规定期限内缴清罚款。
税务部门同时检查发现,本案举报人之一张恒作为郑爽《倩女幽魂》项目的经纪人,涉嫌策划了1.6亿元约定片酬的拆分合同、设立“掩护公司”等事宜,并直接操作合同具体执行、催款收款等活动,帮助郑爽偷逃税款。上海市税务局第一稽查局已依法对张恒进行立案检查,并将依法另行处理。此外,相关企业存在涉嫌为郑爽拆分合同、隐瞒片酬提供方便,帮助郑爽偷逃税款等涉税违法行为,税务部门也已依法另行立案处理。
很多媒体说“郑爽被罚2.99亿”,其实是不准确的。因为这2.99亿中,并不都是罚款,还有追缴的税款、加收的滞纳金。对改变收入性质偷税部分处以4倍罚款,计3069.57万元;对收取所谓“增资款”完全隐瞒收入偷税部分处以5倍“顶格”罚款,计1.88亿元。追缴的,本身就是她必须要缴纳的。真正属于被“罚”的部分,应该是2.1亿多。如果这么严谨地看的话,相当一部分媒体都说错了,包括不少知名媒体。《中华人民共和国刑法》第二百零一条规定,纳税人有逃避缴纳税款行为的,经税务机关依法下达追缴通知后,补缴应纳税款,缴纳滞纳金,已受行政处罚的,不予追究刑事责任;但是,五年内因逃避缴纳税款受过刑事处罚或者被税务机关给予二次以上行政处罚的除外。
本案中,郑爽首次被税务机关按偷税予以行政处罚且此前未因逃避缴纳税款受过刑事处罚,相应的税款及滞纳金已在规定期限内全部缴清。若其能在规定期限内缴清罚款,则依法不予追究刑事责任;若其在规定期限内未缴清罚款,税务机关将依法移送公安机关处理。
税款和滞纳金已缴清,如果能在规定期限内缴清罚款,还是可以免于坐牢。
郑爽的案件,显然将让很多明星重新审视避税和逃税的关系。避税可以,但避成了逃税,后果很严重。
国家广电总局也明确,坚决支持税务部门的处理决定,各机构也不得邀请郑爽参与制作节目,停止播出郑爽已参与制作的节目。新华社则援引有关人士的话说,税务部门作出的处罚决定体现了法律和社会效果的统一,维护了法律的权威,彰显了社会公平正义,警示影视从业者加强自律,带头承担社会责任。以前,名气就是钱,挣钱太容易;现在,执法如山,罚款不留情。
郑爽凉凉,国家广电总局封杀:不得邀请参与制作节目!国家广电总局今天表示,坚决支持税务部门对演员郑爽偷逃税案件的处理决定。
北京世纪伙伴文化传媒有限公司和郑爽严重违反电视剧制作成本配置比例要求,在申请电视剧《倩女幽魂》发行许可时隐瞒真实情况、提供虚假材料,依据《广播电视管理条例》《互联网视听节目服务管理规定》《电视剧内容管理规定》等法规规定,国家广电总局决定:不得播出电视剧《倩女幽魂》(发行许可证号:(京)剧审字(2020)第018号);各级广播电视播出机构、广播电视视频点播业务开办机构和网络视听节目服务机构不得邀请郑爽参与制作节目,停止播出郑爽已参与制作的节目。
国家广电总局表示,偷逃税、“阴阳合同”、“天价片酬”违反法律法规,扰乱行业秩序,冲击社会公平正义底线,广电总局对此“零容忍”。
广电总局将进一步加强演艺人员片酬规范管理,加强行业管理和队伍教育,对违法违规的演艺人员和相关机构坚决严肃追责处理,促进行业健康发展。
结语:当初郑爽与张恒两人撕逼大战、互放大瓜时都很爽,大有鱼死网破的架势,这也算是求锤得锤了。但是,明星们的这种违法行为,不能靠夫妻反目、相互举报才知道和查处。

He was deployed on the USS General M. C. Meigs and spent much of the war ferrying troops to Italy for General Patton. His talent as a machinist and fireman earned him commendations, but he occasionally found himself in minor trouble and never rose above the rank of seaman. Clara was born in New Jersey, where her parents had landed after fleeing the Turks in Armenia, and they moved to the Mission District of San Francisco when she was a child. She had a secret that she rarely mentioned to anyone: She had been married before, but her husband had been killed in the war. So when she met Paul Jobs on that first date, she was primed to start a new life. Like many who lived through the war, they had experienced enough excitement that, when it was over, they desired simply to settle down, raise a family, and lead a less eventful life. They had little money, so they moved to Wisconsin and lived with Paul’s parents for a few years, then headed for Indiana, where he got a job as a machinist for International Harvester. So by 1955, after nine years of marriage, they were looking to adopt a child. Like Paul Jobs, Joanne Schieble was from a rural Wisconsin family of German heritage. Her father, Arthur Schieble, had immigrated to the outskirts of Green Bay, where he and his wife owned a mink farm and dabbled successfully in various other businesses, including real estate and photoengraving. He was very strict, especially regarding his daughter’s relationships, and he had strongly disapproved of her first love, an artist who was not a Catholic. Thus it was no surprise that he threatened to cut Joanne off completely when, as a graduate student at the University of Wisconsin, she fell in love with Abdulfattah “John” Jandali, a Muslim teaching assistant from Syria. Jandali was the youngest of nine children in a prominent Syrian family. His father owned oil refineries and multiple other businesses, with large holdings in Damascus and Homs, and at one point pretty much controlled the price of wheat in the region. His mother, he later said, was a “traditional Muslim woman” who was a “conservative, obedient housewife.” Like the Schieble family, the Jandalis put a premium on education. Abdulfattah was sent to a Jesuit boarding school, even though he was Muslim, and he got an undergraduate degree at the American University in Beirut before entering the University of Wisconsin to pursue a doctoral degree in political science.
