As a proud Texan I strongly oppose SB147 and SB552 and hope you can stand up and kill the two bills during the review process. Here are my main points:
1. These two bills are unconstitutional. They violatethe 14th Amendment, which states “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.” This law would literally take away Texas property owners’ rights to sell their property to whomever they wish.
2. These two bills violate the 14th Amendment, which states, “… nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” This law would take away Texas property owners’ rights. Further, the Constitution is not for only citizens of the United States but all people who live in this country.
3. These two bills would harm the economy: Texas is a state with a strong economy, and limiting investment in real estate could have negative consequences for the state's growth and prosperity.
4. These two bills would be ineffective: The bills may not achieve its intended goal of protecting national security, as foreign investment in real estate is likely to be a small part of the problem. Instead, the bills could be seen as a symbolic gesture that does not address the underlying security concerns.
5. These two bills are blanket ban that take away the rights of a whole group of people who call Texas home. These people are here legally and are our teachers, professors, scientists, physicians, and engineers. They are restauranteurs, merchants, and business owners. They are a part of the economic drivers of this state. The bill makes no exceptions for permanent residents with valid visas and green cards. This means the many immigrant families who live in North Texas who lack U.S. citizenship could not buy a house or a business with real property.
6. These two bills are racist, xenophobic, and discriminatory. The bills will contribute further to the legitimization of Asian hate. The bills echo the xenophobia that led to the Chinese Exclusion Act as well as the Alien Land Laws that followed.
7. The SB 147 violates Fair Housing Laws: The bills could violate fair housing laws, which prohibit discrimination on the basis of national origin, race, and other protected characteristics.
8. These two bills undermine the American free-enterprise system and the concept of personal freedom that Texas stands for.
9. These two bills are seen as unreasonable overreach of your legislative power that impacts citizens and non-citizens alike.
10. Texas shall not be a state where it arbitrarily, artificially, and unreasonably creates a two-tiered system for its residents, where one group has fewer property rights than the other group, and where all Texans have fewer rights and freedoms than citizens of other states.
