之前的华为出现了胡玲举报HR领导的事件，甚至还引来了华为创始人任正非亲自批复，表示要保护当事人。然而最终还是以胡玲离开华为告终，让人不禁唏嘘。
而就在今天，网络上再次出现一份关于华为离职员工李洪元裁决书，在脉脉平台上，有网友爆料华为前员工李洪元离职获得赔偿后，又被起诉敲诈勒索，被羁押251天，近日因证据不足被释放。
先来看一下刑事赔偿判定书的部分重点，捋一下该华为员工的遭遇。
1、 李洪元2005年入职华为担任工程师，离职前在逆变器销售管理部工作，2018年1月31日离职，在华为工作13年之久，主动离职与辞退离职尚未知晓。
2、 离职过程中，因为补偿金额发生争议，HR何承东跟他商谈，李洪元最终拿了2N裁员补偿，13年工龄一共是331576.73元。
3、 2018年3月8日，李洪元离职近40天后，华为向其转款补偿金，值得注意的是，补偿金是部门秘书私人账户转账，同时备注转款原因离职经济补偿。
以下为不起诉意向书（部分）内容：前边的一系列流程都很正常，而之后的事情就比较令人感到意外了。离职然后补偿，但华为的HR并没有停手，他们起诉李洪元敲诈勒索，于2018年12月16日被拘留，幸亏人民法院认定犯罪事实不清，证据不足，认定不符合起诉条件，关押251天后李洪元重回自由。
在法院的宣判文中，深圳龙岗法院表示：深圳市公安局移送审查起诉的犯罪嫌疑人李xx涉嫌敲诈勒索罪一案退回公安机关第二次补充侦查。深圳市公安局就何xx与李xx有过多少次正面接触、双方沟通的内容、接触的时间、地点等关键性问题进行了补充侦查，并于7月10日提交了《补充侦查报告》，何xx的补充询问笔录，客观反映了其在与李xx商谈离职补偿问题时，李xx根本不存在敲诈勒索的行为。为此，鉴于李xx的行为根本不构成犯罪或者依法不应追究刑事责任的实际情况，依照《刑事诉讼法》第一百七十三条第一款及第一百七十一条第四款之规定，对华为该员工作出法定不起诉的决定。
以下为不起诉意向书（部分）内容：
经本院审查并通过补充侦查，仍然认为深圳市公安局认定的犯罪事实不清，证据不足，不符合起诉条件。于2019年8月22日决定对李xx不起诉。对赔偿请求人李洪元予以国家赔偿，包括人身自由损害赔偿金79300.94元，精神损害抚慰金27755元，两项合计107522. 94元。向李xx原工作单位、其父亲李xx所在的工作单位发函、为其消除影响、恢复名誉。
