iPhone在华被判禁售！苹果：高通丧心病狂，你们继续买丨外媒说
高通和苹果的互撕大戏再度上演。
近日，美国高通公司以苹果公司侵犯其专利为由，要求对苹果实施销售禁令，并随后得到了中国福州市中级人民法院的批准。
A Chinese court ordered a ban in the country on iPhone sales in a patent dispute between US chipmaker Qualcomm and Apple, according to a Qualcomm statement Monday.
美国芯片制造商高通10日发布声明称，针对其与苹果公司的专利纠纷，中国一家法院已判决在国内禁售iPhone部分机型。
The statement said the Fuzhou Intermediate People’s Court had granted Qualcomm’s request for two preliminary injunctions against four subsidiaries of Apple, ordering them to immediately to stop selling the iPhone 6S, iPhone 6S Plus, iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X.
声明称，福州市中级人民法院授予了高通针对苹果四家中国子公司提出的两个诉中临时禁令，要求他们立即停止销售iPhone 6S、iPhone 6S Plus、iPhone 7、iPhone 7 Plus、iPhone 8、iPhone 8 Plus和iPhone X。
injunction：[由法院发出的] 禁令
据了解，这次的禁令不包括苹果的最新机型：iPhone XS、iPhone XS Plus和iPhone XR。
The phones covered by the ban make up about 10% to 15% of current iPhone sales in China, according to Daniel Ives, analyst at Wedbush Securities.
韦德布什证券公司分析师丹尼尔·艾维斯称，禁令所涵盖的机型占目前iPhone在中国销量的10%到15%。
该案所涉专利使消费者能够调整和重设照片的大小和外观，以及在手机上浏览、寻找和退出应用时通过触摸屏对应用进行管理。
The chipmaker is alleging patent violations on features that let users reformat the size and appearance of photos and manage applications on a touchscreen when navigating through phone apps.
高通执行副总裁兼总法律顾问唐·罗森伯格（Don Rosenberg）称：
“Apple continues to benefit from our intellectual property while refusing to compensate us. These court orders are further confirmation of the strength of Qualcomm’s vast patent portfolio.”
“苹果一直都在占高通专利的便宜，但却拒绝补偿。这些法律禁令进一步证明了高通庞大专利组合的优势。”
《华尔街日报》称，这是中国首次在国内禁售iPhone：
The Nov. 30 decision by a Chinese court is the first in the world's largest smartphone market that seeks to curtail iPhone sale in the country.
中国法院11月30日的这一判决，是中国这一全球最大手机市场第一次寻求在国内禁售iPhone。
苹果：高通丧心病狂，你们继续买
禁令一出，苹果立刻表示不服，要上诉。
Apple on Monday filed a request for the court to reconsider its decision.
苹果10日向法庭发起上诉，请求对判决进行重新考虑。
苹果称高通此举“丧心病狂”（a "desperate move"），自己的底子都不干净……
"Qualcomm's effort to ban our products is another desperate move by a company whose illegal practices are under investigation by regulators around the world." Apple said.
苹果说，“高通企图禁售我们的产品，这只不过是他们又一次丧心病狂的举动，这家公司自己的非法行为都还在被世界各地的监管机构调查。”
苹果表示并没有侵犯高通的专利：
Apple added that Qualcomm “is asserting three patents they had never raised before, including one which has already been invalidated.”
苹果补充说，高通“所声称的三种专利，他们从未申请过，其中的一种还已经被宣布无效。”
此外，苹果还称，相关专利并没有被应用在最新操作系统中，中国消费者还能继续买。
"All iPhone models remain available for our customers in China."
中国消费者仍可以购买到所有型号的iPhone手机。
彭博社援引相关分析师的话表示，此禁令的影响范围有限，虽然确实是苹果的新闻风险（headline risk），但不能根本上改变苹果公司在中国的业务前景。
摩根斯坦利的Katy Huberty表示：
“This injunction initially appears limited in its scope,” as it only applies to phones with the iOS11 operating system.
“这项禁令首先影响是有限的，”因为它仅适用于iOS11操作系统的手机。
“Currently, 70 percent of Apple’s device installed base operates iOS12 (21 percent operates iOS11 and 9 percent operate an older OS) and, more importantly, all devices are currently sold with iOS12.”
“目前，苹果70%的手机装的都是iOS12的系统（21%安装的是iOS11，其余9%是更久远的iOS系统）。更重要的是，目前所有售卖的系统都安装iOS12。”

尽管如此，这次禁令也让苹果的股价遭受到一些冲击，这可能影响苹果在中国本来就已经显现出颓势的销量：
Despite that, the ruling “does add to greater headline risk for the stock and we need to monitor any impact on consumer demand for Apple products in China, which is already weak.”
周一截至美东时间下午2点46分，苹果股价由跌转涨，上涨0.7%，此前下跌超2%，高通股价上涨2.68%。上周五，苹果股价今年转跌，本季度已下跌26%。
不过，《华尔街日报》则认为，这一判决出现中美贸易摩擦的大背景下，使得苹果未来在中国这一关键市场的不确定性增加（casting uncertainty over Apple's business in a critical market amid thorny trade relations between the U.S. and China）。
高通“手撕”苹果，什么仇什么怨？
据澎湃新闻早前引用彭博社的报道，这项裁决是高通、苹果两家美国公司之间，就高通收取的专利许可费有关的全球争议的一部分。
Apple and Qualcomm are suing each other in courts across the world. Billions of dollars are at stake, and each side has claimed some victories.
苹果和高通在全世界范围内相互起诉，涉及金额数十亿美元。各方都取得过一些胜利。
多年来，高通一直与苹果存在着法律纠纷。高通指控苹果侵犯专利，即当用户在浏览手机应用程序时，可以对照片的大小和外观重新格式化，并在触摸屏上管理应用程序。
苹果起诉高通则是为了迫使高通降低专利许可费。
苹果认为，高通利用其作为智能手机芯片最大供应商的地位强迫手机制造商支付费用。高通则反驳称，苹果公司在没有支付费用的情况下，使用了高通的知识产权。
两家闹翻两年，涉及诉讼数十起……
In 2017, Apple sued Qualcomm for $1 billion after the chipmaker stopped paying for the exclusive right to put its chips in iPhones. Qualcomm withheld its payments after the European Union began investigating them. The EU ultimately deemed the payments illegal, and In January 2018, the European Commission ordered Qualcomm to pay a $1.2 billion fine over the issue.
2017年，高通不再向苹果支付使用其芯片的专利费用，苹果后来和高通打了个10亿美元的官司。高通在欧盟开始对其进行调查后收回了支付款项。欧盟最终认为支付是不合法的，今年1月，欧盟委员会向高通开出12亿美元的罚单。
编者注：欧盟认为高通向苹果支付费用，使得苹果手机只能使用高通芯片违反了反垄断法。
除此之外，在一些专利相关的事项上，二者也存在不少纠纷：
Qualcomm has asked a US federal judge to ban the sale of iPhones in one case. In June, a judge in the International Trade Commission found that Apple had violated one of Qualcomm's patents related to battery-saving technology.
在一起案件中，高通曾要求美国一名联邦大法官叫停苹果手机的销售。今年6月，国际贸易委员会的一名法官发现，苹果公司曾侵犯高通一项关于省电技术的专利。
今年7月，高通称苹果将不会在iPhone中使用其调制解调器，高通也因此削减了其盈利预测。
