外交部回应章莹颖案：强烈的愤慨和谴责！凶手拒不道歉，这样的“正义”令人心痛

如果被宽恕仍不知悔改，那宽恕还有什么意义？

章家被折磨两年之后，凶手被判终身监禁。

不止一家外媒提到，克里斯滕森在听到免于一死的时候，笑了。

路透社写下了克里斯腾一家相拥的情形：

Christensen, who looked down with his eyes closed, smiled and sighed when U.S. District Judge James Shadid read the decision. He hugged and thanked his lawyers. His mother was hugged by a member of his legal team in the courtroom.

当美国地区法官詹姆斯·沙迪德宣读判决书时，克里斯滕森闭着眼睛低下头，他笑了，叹了一口气。他拥抱并感谢了他的律师。在法庭上，他的母亲和法律团队的一名成员拥抱在一起。

能够极尽残忍手段致人死地，也能够在听到免于一死的宣判时微笑、相拥致谢。我们无法理解这是怎样的生命观。

两名陪审员的决定

据《芝加哥新闻公报》报道，由12人组成的陪审团在两天内审议了超过8个小时，但最终未能就该案件达成一致决定。

在公布的陪审团意见裁定书（verdict form）上，我们可以看到两项反对死刑原因（two additional mitigators）：

有两名陪审员认为：

克里斯滕森在服用抗抑郁的药物，加上酗酒和吸毒等，这些因素共同作用会导致严重的副作用。

还有五名认为：

克里斯滕森并不善于社交，因此他并不可能雇佣他人代为实施暴力行为。

而据美国陪审团制度规定，陪审员的量刑意见将被视为优先项（preponderance）。

据一名陪审员透露，12名陪审员中10人赞成死刑，2人反对。最终因为无法达成一致而向法官求助，最后法官宣判终生监禁。

“我永远都不会认同判决”

章莹颖男友在审判结束后的新闻发布会上表示永远不会接受判决。

他说：审判结果仿佛在鼓励人们犯罪，我永远都不会认同。

For me, the result today seems to tell me that I can kill anyone and I can use all kinds of cruel methods to kill anyone I want, and I will not need to die for it. 

今天的结果仿佛在告诉我，我可以用任何残忍的方式杀害别人，却不用为之付出生命代价。

And I'd better take some drugs, some alcohol before I do it, and I'd better act as a loner, and then people will not think I’m a dangerous person. 

我最好在杀人前吸毒、酗酒，最好还装作是一个孤独的人，这样人们就不会觉得我对社会有危险。

So for me, the result today seems to encourage people to do crimes and I will never agree with that.

因而对我来说，今天的审判结果仿佛在鼓励人们犯罪，我永远都不会认同。

很多网友也对此结果表示失望和难以置信。

搞笑，我曾相信西方的司法系统。

美国的法律程序是公正的，但这个案件的结果是不公平的。

天啊。陪审团无法就死刑达成一致判决？这些人在想什么？他们是外星人吗？😡

难以置信司法系统是鼓励人犯罪的，事先服用酒精毒品药物，就没事了吗？？？这太荒谬了！还浪费纳税者的钱为凶手支付牢里的生活！

可怜的法律制度。 直到最后一刻，这个怪物依旧拒绝道歉。为什么有人会对他、而不是受害者的家人表示同情……

法官：769天来，

你没有说出一句简单的“对不起”

昨天，判决出来后，章莹颖的父亲面对媒体发表了声明，表示自己不赞同但接受判决结果。

这份声明中，章父要求凶手告诉他们女儿的下落：

“我们要求被告无条件地告知我们莹颖的下落。如果你的灵魂中还残留有任何人性，请帮助结束我们的煎熬。请让我们带莹颖回家。”

“Now that the trial is over and the jury has made its decision, we ask the defendant to unconditionally tell us what he knows about Yingying’s location,” Zhang’s father Ronggao told media through an interpreter. “If you have any humanity left in your soul, please help end our torment.”

然而，时至今日，凶手克里斯滕森依然没有交代章莹颖尸体地点，更没有对受害家属说出一句对不起。

当我们退了一万步去尝试理解、尊重各国法律，对凶手如此冷酷残忍行为的审判，令人无法忍受。

如果连这些都要宽恕，那就是对善良的践踏。

在宣布判决前，法官沙迪德称，克里斯滕森“完全没有悔意”，并且拒绝在有机会时作出任何形式的道歉。

沙迪德法官说，陪审员的审判“反映出他们的人性，而不是你的”。

尽管判决结果不尽人意，但法官宣判时的一席话感人至深，用最后机会尝试去唤醒凶手那颗冰冷的心。

以下是法官讲话的部分内容：

This inexplicable act of violence has taken its toll on so many...first and foremost the Zhang family.

这一无法形容的罪行对如此多的人造成了影响，其中受伤最深的莫过于章莹颖的家人。

The Zhang family, who may never know where their daughter’s remains now rest must live with the thought that Yingying was ripped away from them by a total stranger, thousands of miles away, fulfilling his self-absorbed and selfish fantasies with no regard, yet to this day, for anyone other than himself.

章莹颖的家人可能永远都无法知道女儿的遗体现在在哪里，他们余生都必须忍受这样的想法：莹颖在离家千里之外的地方，被一个陌生人从他们身边残忍地夺去了生命，只是为了满足这个罪犯自私的幻想。直到今天，除了他自己以外，他不尊重任何人。

Mr. and Mrs. Zhang I hope there is some comfort for you, although small by comparison, that there were many heroes that made it possible for the defendant to be caught and to be brought to justice.

许多人为了将罪犯抓捕归案并绳之以法付出了巨大的努力，章莹颖的家人们，我希望你们心中能够因此得到些许的安慰，尽管于事无补。

As for the defendant, the jury has been unable to reach a unanimous decision. In deliberating some jurors thought death was appropriate and at least one thought it wasn’t. That means by law I must impose on you a sentence of life without release in the Bureau of Prisons. There should be no second guessing the decisions of a jury. It is a cornerstone of our system. The mercy extended to you by the jury is a testament to their humanity, not your character.

至于被告，陪审团未能对判决达成一致决定。经过深思熟虑之后，部分陪审员认为被告应当被判于死刑，但至少有一名陪审员不同意这样的做法。这意味着，根据法律，我必须对你判处终身监禁不得保释。对陪审团的决定，我们不能质疑，这是我们法律制度的基石。陪审团基于人性中的善意，而非你的品性给出了这样的决定。

In effect, the failure to reach a unanimous decision is actually a death sentence, but a natural death as opposed to the death you imposed on Yingying Zhang.

实际上，未能达成一致的是死刑判决，你终将自然死去，而不是像章莹颖那样被别人夺去了生命。

As well, the defendant by his actions, harmed his own family. Forever relegating them to the guilt of wondering where they may have gone wrong, even though as much as you laid blame on your mother as a trial strategy your actions belong only to you.

被告的所作所为也伤害了他的家人。尽管你在庭审中指责你的家人犯下的过错，你的辩护将使他们永远活在愧疚中。

And all the while listening to your attorneys try to paint you as someone who is sorry for his actions the truth of your complete and total lack of remorse was not lost on anyone and emphasized one more time today when given the opportunity to speak, and not subject to any cross examination, you could have said whatever you wanted to say for as little or as long as you wished. And yet today, 769 days after you took Yingying's life, you could not muster a simple "I"m sorry.

在整个庭审的过程中，你的律师试图把你描绘成一个对自己所行感到忏悔的人，而所有人都清楚地认识到，你完全没有悔意。从始至终，你没有对被害者家人说过一句道歉的话，即使在今天，或者任何一次交叉质询中，你本可以说出任何你想说的内容，无论是长还是短。然而到今天，直到莹颖被你杀害后的第769天后，你依然无法说出一句简单的“对不起”。

And whatever self-centered opinion you have of yourself, when you are taken out of here today by the United States Marshal’s, to wait for that lonely, isolated and cold deathbed that follows your natural life in prison and maybe ... just maybe ... the moment will strike you to pick up paper and pen and write “ ‘I’m sorry”  to Mr. and Mrs. Zhang.

无论你心里是怎么想的，当你今天被带离这里，在孤独、隔绝和冷酷的狱中度过余生直至死亡的过程中，也许……只是也许……有一刻，你能良心发现，拿起纸笔，给章莹颖的父母写下：“对不起”。

在19日的中国外交部例行记者会上，对于章莹颖案件的判决，发言人耿爽表示，中方再次对凶犯的残忍行径表示强烈的愤慨和谴责，并始终主张通过法律方式让正义得到伸张，让罪犯得到惩罚。

我们一直密切关注章莹颖案审理进程，也注意到章莹颖的家人已经就此发表声明。 

We have been closely following the trial of this case and noticed that the family of Zhang Yingying already made a statement on this. 

我们再次对凶犯的残忍行径表示强烈愤慨和严厉谴责。故意非法剥夺他人生命的行为是最严重的犯罪，我们始终主张通过法律方式让正义得到伸张，让罪犯得到惩罚，让悲剧不再重演。

We once again express strong indignation and condemnation against the heinous behaviors of the murderer. The deliberate, illegal deprivation of another person's life is the severest felony. It's our consistent belief that justice should be held through legal means and the criminal should be punished so that such tragedy will not happen again.
