Wife run away with 70K bride-price the 2nd day of marriage

After officially registering her marriage with Yao--a young man from Fuzhou--  in 2013, Miss Mo took the bride-price and disappeared the next day. Seeing that he could not find his "wife", Yao applied to several different departments to cancel the marriage registation for several years but his request was constantly rejected. All the departments said that since they could not find any evidence of fraud, coercion and so on, they can not cancel the marriage registration.


After seven years trying to cancel his marriage-- and finding out that his "wife" is  married to 5 different men at the same time-- finally, he was able to cancel his marriage. So, what happened?



In early December 2013, Mr. Yao was introduced to a woman whose first name is Mo, after a few days they went to Minhou County Civil Affairs Bureau and registered a marriage certificate. That day Mr. Yao also gave Mo 70,000 RMB as bride price. Unfortunately, Mo disappeared the next day.



After his wife disappeared, Yao immediately reported the case to the police. Alas, the police believed that the marriage certificate provided by Yao was a legitimate formal marriage certificate issued by the Civil Affairs Department, without any evidence of fraud they can't just cancel it. 


Yao then applied to the Civil Affairs Bureau to cancel the marriage certificate. However, the Civil Affairs Bureau told him that only those who were forced to register the marriage could apply to cancel the marriage according to Marriage Registration Ordinance. Since Yao and Mo were not coerced into registering their marriage, his request was rejected.



Yao is not a rich person, and after being cheated 70K, his life became much more difficult. During these years, Yao had another girlfriend and together they have two young children. Due to the fact that officially he is  married to Mo, he can not register for marriage with his current girlfriend. Furthermore, their children who have reached the age of starting school, can't get registered for school.


On May 24, 2019, Yao filed lawsuit against the court of Xincheng County of the Guangxi Zhuang Autonomous Region, the registered hometown of Mo. The court found out that Mo and someone named Qi had registered marriage certificate on July 26, 2010. In addition, this Mo is not the Mo who had registered with Yao, so Yao had to withdraw the lawsuit.


Yao filed a lawsuit again to Xincheng County Court on August 21, 2019, requesting to declare his marriage with Mo invalid. After hearing, the court established that Yao and the real Mo did not know each other, and the two did not go through the marriage registration procedures. Therefore, it can be concluded that there is no marriage relationship between Yao and the real Mo, so the divorce can not be judged and the lawsuit was rejected.


Yao then filed an administrative lawsuit against the Civil Affairs Bureau on January 3, 2020, requesting the court to cancel the marriage certificate. But the court rejected the case because the prosecution period exceeded five years. Yao filed an appeal and still was rejected.



In July this year, Yao went to the procuratorate of Minhou County and asked for the information on his wife Mo, the prosecutor found that the pictures of Mo on the marriage registration and the identity card were different. Through further inquiry, he found that Mo had 5 active marriage registrations in Guangxi, Zhejiang, Shanxi, Fujian and Anhui at the same time.


The new finding helped Yao prove the fact that Mo falsely registered marriage in many places to cheat the men betrothal gifts, thus establishing that his marriage with her consituted elements of fraud. 



In order to solve the administrative dispute as soon as possible, Minhou County procuratorate held a public hearing on September 16. At the hearing, it was concluded that after investigation and verification by the procuratorial organs, Yao and "Mo" marriage registration was erroneous. Minhou County Civil Affairs Bureau said on the spot that it would cancel the marriage registration according to law.
