公安部发出紧急通知，全国各地上访被拘留过的，可以起诉当地公安局，公安部也有行政起诉样本，有行政复议样本，紧急转发，不相信的访民自己可以去公安部领起诉样本。 中国国际政法研究院院长陈中华说：截访就是架空中央行为，司法机关必须严惩不贷！
我们知道，作为一个13亿人口的大国，特别是处于社会转型期的今天，各种矛盾的出现是十分正常的，一些矛盾在当地难以得到处理，向上一级反映也是合法的渠道，可我们的一些地方官员在错误的政绩观指导下，未能很好地解决群众的问题而引发群众与政府间的矛盾，却又不愿意将本地的问题暴露出去，就一味地采取“截访”、“控访”措施，甚至威胁上访者，从而激化上访者和政府间的矛盾。换句话说，“截访”、“控访”的力度越大，说明地方政府的心里就越是有鬼。
出现“截访”问题，也证明了当前群众上访的渠道极不顺畅，群众的一些问题难以解决并且没有说话的地方。据说北京有个著名的上访村，《南方周末》还曾对此进行过报道，租住在该村的全国各地上访者不在少数，有的已经在那里住了十几个年头，虽然这里环境恶劣，但生活费用低廉，上访者普遍过着赤贫的生活。可以肯定，这些长期上访者中，绝大多数都是有冤情的，否则谁会去受那个罪？可在地方政府普遍“截访”、“控访”的情况下，还有如此之多的人长期住在北京上访村等待有关信访部门接待，说明这些部门的信访接待机制还存在着较多的漏洞，没有真正达到关心群众疾苦、帮助百姓排忧解难的目标。
目前人民群众有冤上告到中央，中央都是转回当地查处，这样的信访制度，中央无形中变成了乡匪村霸的保护伞，致使乡村官员乡匪村霸有恃无恐地欺压百姓。有些地方官员说道，你别说告到中央，你告到联合国去我也不怕，最后还得转回来当地查处。信访，应该是群众和政府沟通的一座桥梁，是化解社会矛盾的一件利器。“截访”则正好与国家设立信访机构的初衷格格不入，也是架空中央行为，建议国家司法机关对“截访”者给予限制，追究截访者的刑事责任，必须严惩不贷。期待“截访”现象尽快消失。对上访者“截访”不但花费巨大，还造成了矛盾的积累，堵塞民意通道。只要能以“权为民所用”的真情认真去工作，不是“截”而是“护”，不是“堵”而是“疏”，就没有解决不了的问题。
得民心者得天下，这是千古不变的真理，中共中央一定要知道谁伤害老百姓就等于伤害党自己的道理。对违法“截访”人员必须严惩不贷。另外；目前的信访制度对中央自身也很不利的，中央领导人若看不到听不到人民的状况与一个眼瞎耳聋的人无异，下面人干什么都不知道，就有被架空的危险。现在的中国国家信访局不但当了中转局，还放任各地政法官员在中国国家信访局门口非法抓捕上访人，你说老百姓到何处说理？在这样的情况，社会的自卫不可避免。这种情形持续久了，很容易引起社会的暴力反抗。再者，这种暴力往往是自发的尤其是在被迫之下的自发，所以也往往是不可预期的和不可控的。
政府应该把大量的维稳的人财投入到为老百姓维权上，化解社会矛盾，国家才能稳定发展，人民才能幸福生活，党的政权才能长久。
