Food Delivery Giant Meituan Fined 3.5 Billion Yuan For Breaking Anti-Monopoly Law

China levied a $533 million fine on Meituan after a months-long probe found the food-delivery behemoth had violated anti-monopoly regulations.

The State Administration for Market Regulation imposed a 3.44 billion yuan fine on Meituan, amounting to 3% of its 2020 domestic revenue, according to a statement Friday. The company will also have to return 1.29 billion yuan of deposits stemming from exclusivity arrangements. Billionaire Wang Xing’s firm was told to improve its commissions mechanism, ensure the legal rights of restaurant partners and step up protections for its delivery riders.


China’s first big antitrust penalty against a tech company was imposed in April on Alibaba, the e-commerce titan co-founded by Jack Ma, one of the richest people in the world. The government’s market watchdog, the State Administration for Market Regulation, fined Alibaba $2.8 billion for preventing the merchants on its shopping sites from selling on other platforms.


The same agency announced shortly after that it was investigating reports of similar practices at Meituan.

经查，2018年以来，美团滥用在中国境内网络餐饮外卖平台服务市场的支配地位，以实施差别费率、拖延商家上线等方式，促使平台内商家与其签订独家合作协议，并通过收取独家合作保证金和数据、算法等技术手段，采取多种惩罚性措施，保障“二选一”行为实施，排除、限制了相关市场竞争，妨碍了市场资源要素自由流动，削弱平台创新动力和发展活力，损害平台内商家和消费者的合法权益，构成《中华人民共和国反垄断法》第十七条第一款第（四）项禁止“没有正当理由，限定交易相对人只能与其进行交易”的滥用市场支配地位行为。
根据《中华人民共和国反垄断法》第四十七条、第四十九条规定，综合考虑美团违法行为的性质、程度和持续时间等因素，2021年10月8日，市场监管总局依法作出行政处罚决定，责令美团停止违法行为，全额退还独家合作保证金12.89亿元，并处以其2020年中国境内销售额1147.48亿元3%的罚款，计34.42亿元。同时，向美团发出《行政指导书》，要求其围绕完善平台佣金收费机制和算法规则、维护平台内中小餐饮商家合法利益、加强外卖骑手合法权益保护等进行全面整改，并连续三年向市场监管总局提交自查合规报告，确保整改到位，实现规范创新健康持续发展。

Xiaomi Takes Lead in Central and Eastern Europe's 5G Smartphone Market

China's leading smartphone producer Xiaomi's 5G mobile phone shipments in Central and Eastern Europe led the local market in the third quarter of 2021, with a massive 42-percent market share, surpassing Apple and Samsung, according to a report released by Strategy Analytics, a market research agency on Wednesday.
Xiaomi recorded an annualized shipment growth rate of more than 5,700 percent, the report said. 


The growth of other Chinese smartphone manufacturers was also strong. In the third quarter, realme and OnePlus ranked fourth and fifth in Central and Eastern Europe markets in terms of 5G mobile phone shipments, with market shares of 7.2 percent and 2.5 percent, respectively.

21 days Quarantine for travelers to Guangzhou

All passengers inbound for Guangzhou, Guangdong province, must be quarantined at designated venues for three weeks starting on Friday, according to a statement released by the provincial anti-COVID-19 headquarters.
The new policy and requirements, which will be in effect until Oct 20 aim to ensure a coronavirus-free China Import and Export Fair to be held in this southern metropolis in the coming weeks, it said.

Previously all inbound passengers were required to be quarantined in designated facilities for two weeks.

Meanwhile all the fair visitors and participants who come from, or had visited, a medium- or high-risk area within 14 days will be required to show a negative test result obtained within 48 hours to enter into the exhibition halls of the fair, and they must report their health condition and itinerary to local health departments, neighborhood committees and hotels within 12 hours after arrival in Guangzhou.

Free nucleic acid tests are available for the people who have been granted certificates to enter into the exhibition halls of the fair.

Inbound passengers whose destination is not Guangzhou will be asked not to leave Guangzhou for other cities on the Chinese mainland until after they have completed quarantine in Guangzhou, the statement said.
Those who must leave Guangzhou for other mainland cities are allowed to depart only from the city's Baiyun International Airport and Guangzhou South Railway Station, one of the country's high-speed railway hubs, between Oct 14 and 20.
The airport and railway station have opened special channels for foreign passengers to leave the city.


The 130th Canton Fair — the largest trade event held in the country — will officially kick off in Guangzhou both online and offline on Friday, Oct 15. The event is held twice a year in Guangzhou, in spring and fall.

广东省新冠肺炎防控指挥办疫情防控组发布关于第130届广交会期间全省新冠肺炎疫情防控工作的通告：为确保第130届广交会顺利举办，经省新冠肺炎防控指挥办同意，决定10月8日至10月20日期间，进一步加强全省新冠肺炎疫情防控工作，现就有关要求通告如下。
一、持有广交会证件人员在广东省各地进行核酸检测，均纳入“应检尽检”范围，各核酸检测点应提供优先快捷便利服务。
二、对目的地为广州市的国外入境人员，健康管理措施调整为21天集中隔离。
三、10月14日至20日期间，目的地为外省并在广东省完成14天集中隔离的入境人员，原则上不从广州交通站场离开广东省；如确需从广州交通站场离开的，应选择从白云机场或广州南站，通过专用通道离粤。
四、近14天内有中高风险区所在地市旅居史的来粤返粤人员，应持有48小时内核酸检测阴性证明，抵粤后12小时内向所在村（居）委、单位或所住宾馆报告。
五、对国内中高风险区、发生源头不明本地疫情地区所在的县（市、区）来粤返粤人员实施14天“应隔尽隔”措施。
六、全省所有电影院、游艺厅、棋牌室、网吧、超市、农贸市场等人员聚集的密闭场所应加强人员流量管控、清洁通风消毒。所有入场人员应主动配合落实测温扫码戴口罩等健康管理措施。
自10月21日起，恢复原疫情防控政策。
