China released first regulation for HR agencies,safer job market

China recently introduced its first regulation on the management of human resources agencies, aiming to tighten supervision and ensure a safer job market for the public.



The regulation, set to take effect on August 1, applies to human resources agencies and organizations across main land China. This includes entities involved in collecting and publishing job information, offering human resources management consultation, employment or entrepreneurship guidance, as well as those providing labor dispatching services.


The new regulation clarifies the legal responsibilities of human resources agencies and organizations. For instance, they are required to establish a job information management system to verify the authenticity and validity of job information provided by employers. If any illegal employment behavior is detected, the agencies must suspend or terminate their services.



Furthermore, human resources agencies are prohibited from finding jobs for children under the age of 16. They are also not allowed to transfer or falsify licenses or provide job services to employers without proper licenses.


Protecting job seekers' privacy and personal information is another key aspect emphasized in the regulation. The agencies must prevent illegal activities such as theft and sale of personal information. Additionally, they should refrain from monopolization, unfair competition, or actions that harm the interests of the State and individuals in the field of human resources training.


Guo Sheng, CEO of recruitment portal Zhaopin, expressed his satisfaction with the release of the regulation. He highlighted the importance of administrative authorization, service standards, and supervision in the human resources industry. Zhaopin aims to enhance communication and coordination with human resources departments while promoting standardized development within the industry.

The Ministry of Human Resources and Social Security acknowledged that the majority of human resources agencies have operated honestly and in compliance with laws and regulations. The new regulation will contribute to improving these agencies and safeguarding the rights of both agencies and workers.


To ensure full implementation of the regulation, the ministry plans to enhance guidance for local human resources bureaus. Their objective is to foster a positive development in the industry, aligning with the natural law of survival of the fittest and enhancing the overall service capacity. Additionally, they will continue to improve industry supervision to standardize the human resources market and promote healthier development.


In recent years, human resources platforms and agencies have become the primary recruitment channels for employers in China. The country currently has approximately 63,000 human resources agencies, including well-known platforms like Zhaopin and Liepin. As of the end of 2022, these agencies have served 5,268 employers and provided job-hunting services to 310 million individuals.
