Teacher Sues for 900K after Taking Sick Leave for 25 Years

A middle school teacher in Jiamusi, Heilongjiang province, discovered that her teaching job records were inaccessible a day before her retirement in 2020. What happened?‍‍‍‍‍

The teacher, Yao Zhirong, graduated from the Department of Physical Education at Qiqihar Normal University in July 1983 and started teaching at No. 12 Middle School in Jiamusi.

Yao took sick leave in 1997 and went to Beijing for treatment. She never returned to work after she was later told by the school's accountant that she could no longer be paid on sick leave. 

23 years later, a day before her scheduled retirement day in 2020, she found that she could not access her employment and salary records. She reported the matter to the relevant departments for clarification.

In 2022, the Education Bureau of Jiamusi City informed her that her employment and salary were terminated before the records were transferred from Xiangyang District to the Municipal Education Bureau in 2004.  ‍‍‍

She was told that the bureau could not satisfy her demands of restoring her employment status and repaying her salary accumulated over the 25 years.‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍

Yao says the school's accountant only told her that she could no longer receive a salary because she was on sick leave, they did not inform her that her employment was also terminated.

The teacher then filed an administrative lawsuit with the Jiamusi Intermediate Court, requesting the Jiamusi Education Bureau to restore her work as a teacher, handle the retirement procedures for her as an in-service public teacher, and compensate her with a total of 900,000 yuan of unpaid salary from January 2001 to July 2022.

On August 29, 2022, the court ruled that Yao's lawsuit did not fall within the scope of administrative litigation by the People's Court and was dismissed. 

Yao Zhirong appealed.

On the afternoon of April 24th, the second instance of this case was held but did not reach a verdict.

The case has had a mixed reaction online but many commenters expressed that they fail to comprehend the teacher's actions.‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍‍

"Please, compensate for all the 25 years of classes that you have not taught." Commented one social media user.‍‍‍‍‍‍‍

"It's until the day she was retiring that she remembered that she once was a teacher, legend" Quipped another.‍‍‍

"So, one can ask for sick leave for 25 years?" Asked another social media user.‍
