孟晚舟未能获释，各方都表态了

温哥华当地时间27日上午，加拿大不列颠哥伦比亚省高等法院裁定，华为公司副董事长、首席财务官孟晚舟符合引渡的“双重犯罪”标准，引渡程序将持续。

这意味着孟晚舟仍未获得自由，她将留在加拿大参加后期的相关听证，并等待新的审判结果。

所谓“双重犯罪”，指的是加拿大法律规定，被引渡者受到指控的行为不仅要违反引渡国法律，在加拿大也必须构成犯罪。

代表美方要求引渡孟晚舟的加拿大检控方强调，孟晚舟涉及银行欺诈，而欺诈这个罪名在加拿大的法律中是存在的，因此符合“双重犯罪”原则。加拿大法院支持了这一说辞。

A Canadian court ruled on Wednesday extradition proceedings against Meng Wanzhou, a senior Huawei executive, can proceed.

According to Justice Heather Holmes of the British Columbia Supreme Court, the fraud charges against Meng satisfied the extradition requirement of "double criminality", meaning Meng is accused of the considered crime in Canada as well.

漫长的软禁

2018 年 12 月 1 日，孟晚舟搭乘飞机从香港前往墨西哥。在温哥华转机时，她被加拿大警方应美国政府司法互助要求逮捕。

最初，加拿大并未明确指出逮捕孟晚舟的理由。华为公司也在当时发表声明称，“华为并不知晓孟晚舟有任何不当行为”。

逮捕的缘由很快被公开，在孟晚舟的保释听证会上，加拿大司法部指控其“隐瞒华为和伊朗的业务往来”，“对汇丰银行欺诈”，以规避美国对伊朗的制裁。

但华为与孟晚舟从未承认过任何相关指控。

虽然在听证会上，加拿大检方曾请求法庭不予批准保释，但孟晚舟最终还是获得了保释的机会。

孟晚舟向加拿大保释庭法官表示，愿意戴上电子脚镣接受监视，且愿意交出护照以换取保释。 

12 月 11 日，孟晚舟获不列颠哥伦比亚省高等法院准许保释，此后开始了她长达一年半的软禁生涯。

Meng Wanzhou, Huawei's chief financial officer and the daughter of the company's founder Ren Zhengfei, was arrested by Canadian police on December 1, 2018, at Vancouver International Airport.

The U.S. is accusing Meng of fraud linked to a violation of U.S. sanctions against Iran and want her to face trial in New York.  Both Meng, 48, and Huawei have repeatedly denied any wrongdoing.

On December 11, 2018, she was released on bail by a British Columbian court. Since then, she has worn a GPS ankle bracelet and has been subject to 24-hour supervision by a private security firm at her Vancouver home with her husband.

华为发声：将继续支持孟女士寻求公正判决和自由

针对法院裁定结果，华为作出声明，对裁决结果表示失望，并表示“将继续支持孟女士寻求公正判决和自由。”

Huawei said in a statement that it was "disappointed" by the ruling.

"We have always believed that Ms. Meng is innocent, and we will continue to support Ms. Meng in seeking a fair judgment and freedom," the statement said. "We expect that Canada's judicial system will ultimately prove Ms. Meng's innocence."

Huawei is disappointed in the ruling today by the Supreme Court of British Columbia, we have repeatedly expressed confidence in Ms. Meng's innocence. Huawei continues to stand with Ms. Meng in her pursuit for justice and freedom.

We expect that Canada's judicial system will ultimately prove Ms. Meng’s innocence. Ms. Meng’s lawyers will continue to work tirelessly to see justice is served.

中国驻加拿大大使馆回应：坚决反对加方有关决定

中国驻加拿大大使馆周三在推特上发布声明回应称，中方对有关决定表示强烈不满和坚决反对，并已向加方提出严正交涉。

声明表示，美、加滥用其双边引渡条约，对孟晚舟女士任意采取强制措施，严重侵害了中国公民的合法权益。

声明还指出，美国的目的是为了打压华为以及其他中国高科技公司，而加拿大在整个事件中充当了美国的帮凶。

大使馆强调，中国政府坚决捍卫中国公民及企业的正当、合法权益，并敦促加方认真对待中国的严正立场以及关切，立即释放孟晚舟女士，允许其返回中国，不要一意孤行。

The spokesperson of the Chinese Embassy in Canada published remarks on Twitter expressing China's firm opposition to the decision.

The tweet said the U.S. and Canada had abused their bilateral extradition treaty, and their actions had gravely violated the lawful rights of Meng.

"The purpose of the United States is to bring down Huawei and other Chinese high-tech companies, and Canada has been acting in the process as an accomplice of the United States," the spokesperson commented.

The Chinese government is firmly resolved to protect the legitimate and lawful rights and interests of Chinese citizens and companies, the spokesperson wrote, while again urging Canada to take China's solemn position and concerns seriously, and immediately release Meng to allow her safe return to China.

外交部此前表态：这是一起严重的政治事件

5月26日的外交部例行记者会上，针对加拿大环球邮报记者就孟晚舟案件的多次追问，发言人赵立坚表示，中方在孟晚舟事件上的立场是一贯的、明确的。美加两国滥用其双边引渡条约，对中国公民任意采取强制措施，严重侵犯中国公民的合法权益，这是一起严重的政治事件。 

赵立坚表示，加方应当切实纠正错误，立即释放孟晚舟女士，并确保她平安回到中国，以免中加关系持续受到损害。

While responding to queries over Meng’s case Tuesday, Chinese spokesperson Zhao Lijian lambasted the case as “a serious political incident”, demanding “the Canadian side should correct its mistake, immediately release Ms. Meng and ensure her safe return to China so as to avoid any continuous harm to China-Canada relations.”

法律专家解读裁决：加拿大司法独立性受质疑 

中国社会科学院法学研究所研究员、法律专家支振锋在接受《环球时报》采访时表示，加拿大法庭裁定的结果是“不公平”的。支振锋认为，该裁决会让中加两国关系变得“有史以来最糟糕”。

在孟晚舟案件裁决之前，支振锋曾表示，这个案子过于复杂，牵涉了太多的政治因素， 但如果加拿大司法系统真如它向来夸赞的彻底独立，不受政治影响，从纯法律的观点来看，孟晚舟很可能会立即获释。

This ruling foreshadows the “worst-ever” China-Canada ties, Zhi Zhenfeng, a legal expert at the Chinese Academy of Social Sciences in Beijing, told the Chinese state-owned newspaper Global Times.

He called the ruling “unjustified.”
