美国联邦地区法院裁决暂缓实施TikTok下架行政令

当地时间27日,美国哥伦比亚特区联邦地区法院裁定,暂缓实施美国政府关于将TikTok从美国移动应用商店下架的行政令。这一行政令原本将在数小时内生效。

A judge in Washington has temporarily blocked a Trump administration order banning Apple and Google from offering the Chinese-owned short video-sharing app TikTok for download on their U.S. app stores. 

The ban had been set to take effect at 11:59 p.m. local time on Sunday.

据报道,哥伦比亚特区联邦地区法院于27日早些时候,以电话形式就是否暂缓实施上述行政命令举行了听证会。听证会上,该法院法官卡尔·尼科尔斯分别听取了来自TikTok和美国政府两方律师的陈词,随后做出上述裁决。

美国商务部随后发表声明称,服从该裁决。

U.S. District Judge Carl Nichols said in a brief order he was issuing a preliminary injunction to prevent the TikTok app store ban from taking effect. Nichols declined "at this time" to block other restrictions by the U.S. Department of Commerce set to take effect on November 12, which will block U.S. companies from providing internet hosting and services for the app.

美国总统特朗普8月6日签署行政令,称TikTok对美国国家安全构成威胁,将在45天后禁止任何美国个人或实体与TikTok及其母公司字节跳动进行任何交易。8月14日,特朗普再签行政令,要求字节跳动在90天内剥离TikTok在美国运营的所有权益。

9月18日,美国商务部以保护美国国家安全为由,禁止TikTok在美境内的相关交易,内容包括从9月20日午夜起,禁止通过美国移动应用商店发布或维护TikTok等。9月19日,美国商务部将针对TikTok的禁令延迟至9月27日午夜起实施。

The restrictive orders by the commerce department were a response to one of two executive orders signed by President Donald Trump – the one to block U.S. companies' transactions with ByteDance Ltd. – TikTok's parent company in Beijing. The other is to takeover TikTok's U.S. operations.

The department on September 18 issued an order banning U.S. transactions with TikTok and messaging app WeChat starting September 20, from which any provision of service to distribute or maintain the WeChat or TikTok mobile applications, constituent code, or application updates through an online mobile application store in the U.S. will be prohibited.

On September 19, it announced an order to delay TikTok's U.S. app store ban, saying that the decision was taken "in light of recent positive developments."

在一次又一次遭受美国政府打压后,TikTok此次总算迎来令人欣慰的裁决结果。

在此过程中,美方始终打着“国家安全”的幌子肆意施行经济霸凌,哪怕指责毫无真凭实据、做法受到外界广泛反对。

此前,“商业内幕”网站等多家媒体就曾指出,美方一再指责TikTok盗窃公民信息、威胁国家安全,却从未提供任何证据。美国《连线》月刊记者路易·马萨吉斯也在深入调查后得出结论:“TikTok的数据收集行为对一个以广告为基础的公司而言并无特别之处。”

Sunday's ruling is a victory for TikTok after it challenged the ban as unconstitutional and a violation of due process.

U.S. officials have alleged national security concerns over the short-video sharing app due to its Chinese ties, although TikTok has reiterated many times that all its data is stored on servers in the U.S., with a backup in Singapore, while making efforts to deal with the U.S. government's security concerns.
