1.《中央国有资本经营预算支出管理暂行办法》发布

中国财政部近日发布了《中央国有资本经营预算支出管理暂行办法》，自2017年1月1日起施行。

《办法》包括总则、支出范围、预算编制和批复、预算执行、转移支付、决算、绩效管理、监督检查、附则等9章，共计44条。《办法》规定，投资运营公司和中央企业负责向中央单位申报支出计划建议，编制本公司（企业）支出决算，推动解决国有企业历史遗留问题，开展国有资本投资运营，组织实施相关事项，按照财政部、中央单位要求开展绩效管理等。《办法》还规定，中央国有资本经营预算支出除调入一般公共预算和补充全国社会保障基金外，主要用于以下方面：解决国有企业历史遗留问题及相关改革成本支出；国有企业资本金注入；其他支出。

1. Interim Measures for the Expenditure Management of the Central State Capital Operations Budget Issued

The Ministry of Finance recently issued the Interim Measures for the Expenditure Management of the Central State Capital Operations Budget, effective from January 1, 2017.

The Measures have a total of 44 articles in 9 chapters: general provisions, scope of expenditures, budget preparation and approval reply, execution of budget, transfer payment, final accounts, performance management, supervisory inspection, and supplemental provisions. The Measures provide that investment and operation companies and central enterprises are responsible to recommend expenditure plans to central entities, prepare their own final accounts of expenditures, propel the resolution of historical issues involving state-owned enterprises, conduct state capital investment and operations, organize and implement relevant matters, and carry out performance management as required by the Ministry of Finance and central entities. According to the Measures, the expenditures in the central state capital operation budget are mainly used for the resolution of historical issues involving state-owned enterprises and cost of relevant reforms; the input of capital to state-owned enterprises; and other expenditures, in addition to any inclusion in the general public budget and replenishing the national social security fund. 

2.《专利优先审查管理办法（征求意见稿）》发布

近日，国家知识产权局发布《专利优先审查管理办法（征求意见稿）》，拟将优先审查制度的适用范围扩大至实质审查阶段的发明专利申请、实用新型和外观设计专利申请，发明、实用新型和外观设计专利申请的复审以及发明、实用新型和外观设计专利的无效宣告案件。

《征求意见稿》根据不同的专利类型以及程序特点分别设定相应的答复期限和结案期限，应当自优先审查请求获得同意之日起，发明专利申请在一年内结案，专利复审案件七个月内结案，发明和实用新型专利无效宣告案件五个月内结案。

2. Measures for Prioritized Patent Examination (Consultation Paper) Issued

The State Intellectual Property Office (SIPO) is requesting public comments on the Measures for the Administration of Prioritized Patent Examination (Consultation Paper), in an effort to expand the applicable scope of prioritized examination to invention, utility model, and industrial design patent applications at the stage of substantive examination, the reexamination of invention, utility model and industrial design patent applications, and the invalidation declaration cases of invention, utility model and industrial design patents.

The Consultation Paper sets reply and conclusion time limits according to the types of patents and their procedural features. Invention patent applications should be concluded no more than one year, patent reexamination cases should be concluded within seven months, and invalidation declaration cases of invention and utility model patents should be concluded within five months, after the prioritized status is granted. 

3.《网络医疗器械经营违法行为查处办法（征求意见稿）》发布

国家食品药品监督管理总局日前发布《网络医疗器械经营违法行为查处办法（征求意见稿）》，向社会征求意见。

《意见稿》提出，从事网络医疗器械经营的企业和网络医疗器械交易服务第三方平台未按规定备案的，由设区的市级及以上地方食品药品监督管理部门责令改正，并处5000元以上3万元以下罚款。

3. Measures for Investigating and Punishing Illegal Online Trade in Medical Devices Issued

The China Food and Drug Administration (CFDA) is requesting public comments on the Measures for Investigating and Punishing Illegal Online Trade in Medical Devices (Consultation Paper).

According to the Consultation Paper, enterprises trading in medical devices online and third-party platforms providing services for online trade in medical devices should, if failing to undergo recordation as required, be ordered by the local food and drug administration at the level of a districted city or above to take corrective action and face a fine of 5,000 yuan up to 30,000 yuan.

4.两部门联合发文加强近期住房及用地供应管理和调控

住建部和国土部近日联合发布《关于加强近期住房及用地供应管理和调控有关工作的通知》。

《通知》包括合理安排住宅用地供应、科学把握住房建设和上市节奏、加大住房保障力度以及强化地方主体责任4部分内容。

《通知》要求保证住宅用地供应平稳有序。各地要根据商品住房库存消化周期，适时调整住宅用地供应规模、结构和时序，对消化周期在36个月以上的，应停止供地；36-18个月的，要减少供地；12-6个月的，要增加供地；6个月以下的，不仅要显著增加供地，还要加快供地节奏。《通知》还要求，各地要建立购地资金审查制度，确保房地产开发企业使用合规自有资金购地。

4. Two Ministries Jointly Issue a Notice to Strengthen Regulation of Housing and Land Supply

Recently, the Ministry of Housing and Urban-Rural Development and the Ministry of Land and Resources jointly issued a Notice on Strengthening the Current Administration and Regulation of Housing and Land Supply.

The Notice is divided into four parts: reasonably arranging residential land supply, scientifically controlling the pace of housing construction and marketing, providing more housing security, and reinforcing the accountability of local governments.

The Notice requires stable and orderly supply of residential lands. Local governments should, based on the digestion period of the commercial housing stock, adjust the size, structure, and time of residential land supply in good time. If the digestion period lasts more than 36 months, the supply of land should be halted; if it lasts between 18 and 36 months, a cut should be made in the land supply; if it lasts between 6 and 12 months, more land should be supplied; and if it lasts less than 6 months, the supply of land should increase significantly and at a faster pace. According to the Notice, local governments should establish a land purchase funds review system to ensure that real estate developers use their own legitimate funds to buy lands.

5.人社部发文逐步实现工伤医疗费用联网实时结算

人社部办公厅日前印发了《关于进一步做好建筑业工伤保险工作的通知》。

《通知》指出，各级人社部门要进一步发挥好牵头作用，会同有关部门加强和完善联席会议、联合督查、信息共享、定期会商等行之有效的部门协作机制。在项目参保模式下，要高度重视管理服务创新，优化流程，减少环节，提高效率，逐步开辟绿色通道、专门窗口，提供一站式服务，逐步实现工伤医疗费用联网实时结算。

5. Notice on Gradually Achieving the Real-time Online Settlement of Medical Expenses for Job-Related Injuries Issued

Recently, the General Office of the Ministry of Human Resources and Social Security (MOHRSS) issued a Notice on More Effectively Conducting Work on Job-Related Injury Insurance in the Construction Industry.

According to the Notice, human resources and social security departments at all levels should redouble efforts to lead the relevant departments in strengthening and improving the joint meeting, joint supervisory inspection, information sharing, regular consultation, and other effective inter-department coordination mechanisms. Under the mode of project insurance, great importance should be attached to innovating in management services, optimizing processes, reducing links, improving efficiency, setting up green channels and special windows in due time, and providing one-stop services, so as to gradually achieve the real-time online settlement of medical expenses for job-related injuries.

6. 五部委：鼓励高校内设机构取消行政级别

近日，教育部、中央编办、发展改革委、财政部、人力资源社会保障部联合印发了《关于深化高等教育领域简政放权放管结合优化服务改革的若干意见》。

《意见》的具体改革措施为落实和扩大高校专业设置自主权；探索实行高校人员总量管理；政府部门不统一组织高校人员聘用考试；将职称评审权下放到高校；科技成果转化奖励收入不纳入绩效工资。

6. Five Ministries Encouraging Removal of Administrative Ranks of Positions in Establishments of Higher Education Institutions

Recently, the Ministry of Education, the State Commission Office of Public Sectors Reform, the National Development and Reform Commission, the Ministry of Finance, and the Ministry of Human Resources and Social Security jointly issued the Several Opinions on the Profound Reform to Simplify Administrative Procedures, Decentralize Powers, Combine Decentralization and Proper Control, and Provide Better Services in the Higher Education Sector.

Concrete reform measures in the Opinions are to implement and expand higher education institutions' autonomy to offer specialty courses; explore the total quantity management of personnel in higher education institutions; put a halt to examinations organized by governmental departments for higher education institutions to hire staff; delegate the power of professional title assessment to higher education institutions; and exclude rewards for the commercialization of science and technology achievements from the performance-based wages.

7. 最高法通知要求进一步扩大量刑规范化范围

近日，最高人民法院下发通知，要求全面深入推进量刑规范化改革，进一步扩大量刑规范化范围。

从4月1日起实施修订后的《关于常见犯罪的量刑指导意见》，从5月1日起在全国第二批试点法院对危险驾驶等8个罪名进行量刑规范改革试点。

7.SPC Requires Further Expansion of the Scope of Sentencing Standardization

Recently, the Supreme People's Court (SPC) issued a notice to accelerate the sentencing standardization reform in both width and depth and further expand the scope of sentencing standardization.

The revised Sentencing Guidelines for Common Crimes will be implemented from April 1, and a pilot program of the sentencing standardization reform for eight crimes including the crime of dangerous driving will start in the second group of courts nationwide from May 1.
