1、《重大行政决策程序暂行条例（征求意见稿）》发布

国务院法制办公室近日公布了《重大行政决策程序暂行条例（征求意见稿）》。

《征求意见稿》分为10章，共44条。除总则、决策动议、决策执行、法律责任和附则外，将公众参与、专家论证、风险评估、合法性审查和集体讨论决定分别作为专章予以规定。

《征求意见稿》明确规定，除依法应当保密的外，涉及社会公众切身利益或者对其权利义务有重大影响的决策事项应当广泛听取意见；集体讨论决定为决策必经程序，并坚持行政首长负责制；专业性、技术性较强的决策事项，需要进行专家论证的，应当组织论证其必要性、可行性、科学性等；重大行政决策的实施可能对生态环境、社会稳定等方面造成不利影响的，应当开展风险评估；合法性审查为决策必经程序，规定未经合法性审查，或者经审查不合法的，不得提交决策机关讨论。

1. Interim Regulation on Procedures for Major Administrative Decision-Making (Consultation Paper) Issued

Recently, the Legislative Affairs Office of the State Council issued the Interim Regulation on Procedures for Major Administrative Decision-Making (Consultation Paper).

With a total of 44 articles in ten chapters, in addition to general provisions, decision-making motions, execution of decisions,legal liability and supplemental provisions, the Consultation Paper provides for public participation, expert discussion, risk assessment, legal review and collective discussion and decision in separate chapters.

According to the Consultation Paper, except for those which should be kept confidential according to the law, to make decisions concerning the public interest orhaving a material effect on the rights and obligations of the public, publiccomments should be comprehensively requested. Collective discussion and decision is a necessary decision-making process, and the accountability system of administrative heads should be adhered to. If decisions of a strong professional or technical nature need expert discussion, expert discussion should be organized to prove such decisions to be necessary, feasible and rational. If the implementation of major administrative decisions is likely to exert an adverse effect on the environment and social stability, among others, risk assessment should be carried out. Legal review is also anecessary decision-making process. If a decision has not gone through the legal review or fails the review, it should not be presented to the decision-making body for discussion.

2、《证券公司和证券投资基金管理公司合规管理办法》发布

证监会近日发布《证券公司和证券投资基金管理公司合规管理办法》，自2017年10月1日起施行。

《办法》的主要内容包括：进一步强化全员合规，厘清董事会、高级管理人员、合规负责人等各方合规管理责任。强调合规不仅是合规管理部门的职责，而是要求各个部门所有员工都要合规。要求优化合规管理组织体系，对证券基金经营机构合规系统建设、部门设置、合规人员数量和质量提出基本标准；强化合规负责人专业化和职业化水平，同时提升专业经验和法律素质要求。

2. Measures for the Compliance Management ofSecurities Companies and Securities Investment Fund Management Companies Issued

Recently, the China Securities Regulatory Commission (CSRC) issued the Measures for the Compliance Management of Securities Companies and Securities Investment Fund Management Companies, effective from October 1, 2017.

Accordingto the Measures, compliance by all employees is further strengthened, and the compliance management responsibilities of the board of directors, senior executives and chief compliance officers are specified. Compliance is not only are sponsibility of the compliance management department but also a requirement for all employees of all departments. The organizational system of compliance management should be optimized, and basic standards should be proposed for the construction of compliance system, department setup, and number and quality of compliance personnel of securities fund trading institutions. The professional and occupational capabilities of chief compliance officers should be enhanced, and there are higher requirements for their professional experiences and legal quality.

3、最高检印发《检察大数据行动指南（2017－2020年）》

最高人民检察院日前印发《检察大数据行动指南（2017-2020年）》，全国检察机关将依托大数据及智能语音等前沿科技，统筹利用以司法办案数据为核心的检察数据资源，建立检察大数据总体架构，营造大数据应用良好生态，打造“智慧检务”。

《行动指南》主要内容是：检察大数据的建设背景和发展现状，指导思想、总体思路、建设目标和发展路线图，2017年至2020年“一中心四体系”的建设任务，具体保障措施，2017年重点工作任务。其中，“一中心四体系”是指国家检察大数据中心，检察大数据标准体系、应用体系、管理体系和科技支撑体系。

3. Prosecutorial Big Data Action Guide (2017-2020) Issued by SPC

Recently, the Supreme People's Procuratorate (SPC)issued the Prosecutorial Big Data Action Guide (2017-2020). According to the Action Guide, prosecutorates across the country will rely on big data and other state-of-the-art technologies such as intelligent voice and comprehensively use prosecutorial data resources centering on case data to establish a framework of prosecutorial big data, create a good environment for the application of big data and achieve "intelligent prosecution."

The Action Guide mainly includes the construction background and development status of prosecutorial big data, guiding ideology,overall ideas, construction goal and development roadmap, tasks of constructing the "one center and four systems" from 2017 to 2020, concrete guarantee measures, and major work tasks for 2017. The concept of "one center andfour systems" means the National Prosecutorial Big Data Center and thestandard system, application system, management system and technical support system of prosecutorial big data.

4、《关于进一步加强校园贷规范管理工作的通知》发布

近日，银监会、教育部、人社部联合下发《关于进一步加强校园贷规范管理工作的通知》，要求未经银行业监管部门批准设立的机构禁止提供校园贷服务；且现阶段一律暂停网贷机构开展校园贷业务，对于存量业务要制定整改计划，明确退出时间表。

《通知》对校园贷规范管理作出了以下要求：1. 疏堵结合，维护校园贷正常秩序；2. 整治乱象，暂停网贷机构开展校园贷业务；3. 综合施策，切实加强大学生教育管理；4. 分工负责，共同促进校园贷健康发展。

4. Notice toTighten Campus Loans Issued

Recently, the China Banking Regulatory Commission, the Ministry of Education and the Ministry of Human Resources and Social Security jointly issued the Notice of Further Regulating Campus Loans, requiring that institutions established without the approval of banking regulators not to provide campus loan servicesand all Internet-based lenders stop providing campus loans for the time being. Plans should be made to take corrective action for existing loans and have aclear timetable of withdrawal.

The Notice also includes requirements that: (1) the normal order of campus loans be maintained by a combination of prohibition and exceptions; (2) chaotic practices be brought under control by suspending the campus loan services of Internet-based lenders; (3) comprehensive policies be in place to effectively educate and manage college students; and (4) appropriate authorities jointly promote the sound development of campus loans according to their respective duties.

5、政府信息公开条例修订：公开范围进一步放宽

近日，由国务院办公厅、法制办公室起草的《中华人民共和国政府信息公开条例（修订草案征求意见稿）》正式发布，将明确政府信息公开的范围，细化不公开信息的规定，进一步推进政府信息资源开放共享。

《征求意见稿》确立了“以公开为常态、不公开为例外”的原则，规定“除法律、行政法规另有规定外，政府信息应当公开”。对于不予公开的政府信息，征求意见稿将危及国家安全、公共安全、经济安全和社会稳定的信息细化为三类可不予公开的政府信息；有关行政机关内部事务的信息，以及行政机关在行政决策过程中形成的过程信息，公开后可能会影响公正决策或者行政行为正常进行的，可不予公开。

5. Regulation onOpen Government Information Revised to Expand the Scope of Public Disclosure

Recently, the Regulation of the People's Republic of China on Open Government Information (Consultation Paper) draftedby the General Office and the Legislative Affairs Office of the State Council was issued, clarifying the scope of open government information, with detailed provisions on undisclosed information, in order to further promote the opening and sharing of government information resources.

The Consultation Paper establishes the principle of "public disclosure as anormal practice and nondisclosure as an exception" and provides that except as otherwise provided in laws and administrative regulations, government information should be disclosed to the public. According to the Consultation Paper, information that poses a threat to national security, public security, economic security and social stability is divided into three categories of government information prohibited from public disclosure. Information on internal affairs of administrative agencies and process information formed in the course of decision-making of administrative agencies may be withheld from the public if public disclosure is likely to affect the impartiality of decisions or the normal administrative actions.

6、《中华人民共和国统计法实施条例》公布

《中华人民共和国统计法实施条例》近日公布，自2017年8月1日起施行。

《条例》主要内容为：一是从源头上规范统计调查活动；二是加强统计调查的组织实施；三是明确统计资料公布的主体、权限及要求；四是强化对统计违法行为的责任追究。

6. Regulation for the Implementation of the Statistics Law of the People's Republic of ChinaIssued

Recently, the Regulation for the Implementation of the Statistics Law of the People's Republic of China was issued, effective from August 1, 2017.

The Regulation is mainly: (1) to regulate statistical survey from the source; (2) to strengthen the organization and implementation of statistical survey; (3) to specify the issuers of and publication authority and requirements for statistical data; and (4) to reinforce the accountability for illegal statistical activities.

7、《关于规范开展政府和社会资本合作项目资产证券化有关事宜的通知》发布

近日，财政部联合中国人民银行、中国证监会共同发布《关于规范开展政府和社会资本合作项目资产证券化有关事宜的通知》。

《通知》主要内容为：一、分类稳妥地推动PPP项目资产证券化；二、严格筛选开展资产证券化的PPP项目；三、完善PPP项目资产证券化工作程序；四、着力加强PPP项目资产证券化监督管理。

7. Notice to Regulate Asset Securitization of PPP Projects Issued

Recently, the Ministry of Finance, the People's Bank of China and the China Securities Regulatory Commission jointly issued the Notice of Matters concerning Regulating the Asset Securitization of Public-Private Partnership Projects.

The Notice requires: (1) steady promotion of asset securitization of PPP projectsby category; (2) strict screening of PPP projects for asset securitization; (3) improvement of working procedures for asset securitization of PPP projects; and(4) strengthened supervision of asset securitization of PPP projects.
