1.最高检公安部发文明确15种案件立案追诉标准

日前，最高人民检察院、公安部联合下发《关于公安机关管辖的刑事案件立案追诉标准的规定(一)的补充规定》。 

《补充规定》明确了不报、谎报安全事故案，生产、销售假药案，生产、销售不符合安全标准的食品案等15种案件的立案追诉标准，删除了嫖宿幼女案的立案追诉标准。

1. SPP and MPS Issue Criteria for Launching Formal Investigation of 15 Types of Cases

Recently, the Supreme People's Procuratorate (SPP) and the Ministry of Public Security (MPS) jointly issued the Supplement to the Provisions (I) on the Criteria for Launching Formal Investigation of Criminal Cases under the Jurisdiction of Public Security Authorities.

The Supplement sets forth the criteria for launching formal investigation of 15 types of cases, involving, among others, failing to report or falsely reporting safety accidents, producing or selling counterfeit medicines, and producing or selling food not up to safety standards, and deletes the criteria for a case involving sex with an underage girl.

2.《保险销售行为可回溯管理暂行办法》发布

中国保监会近日发布了《保险销售行为可回溯管理暂行办法》，通过对保险公司、保险中介机构保险销售行为可回溯管理，记录和保存保险销售过程关键环节，实现销售行为可回放、重要信息可查询、问题责任可确认。

《办法》共计18条，主要涉及可回溯实施范围和方式、管理内容、信息安全责任、内外部监督管理措施等方面。

2. Interim Measures for the Retracing Management of Insurance Sales Conduct Issued

Recently, the China Insurance Regulatory Commission (CIRC) issued the Interim Measures for the Retracing Management of Insurance Sales Conduct for the purposes of reenacting sales processes, reviewing important information and identifying problems and responsibilities through the retracing management of the sales conduct of insurers and insurance intermediaries by keeping a record of key insurance sales processes.

The Measures contain a total of 18 articles, mainly involving the scope and manners of retracing, content of management, information security responsibility, and internal and external supervisory measures.

3.《信用保证保险业务监管暂行办法》发布

中国保监会日前印发《信用保证保险业务监管暂行办法》，对出口信用保险以外的信保业务予以全面规范。

《办法》以“负面清单”形式规定信保业务的经营范围和市场行为：一是禁止保险公司为部分融资行为提供信保产品和服务；二是禁止保险公司承保违反保险原理、超过国家规定贷款利率上限等信保业务；三是禁止保险公司与不符合互联网金融相关规定的网贷平台合作以及超额承保网贷平台信保业务。

3. Interim Measures to Regulate Credit and Guarantee Insurance Issued

Recently, the China Insurance Regulatory Commission (CIRC) issued the Interim Measures for the Supervision of Credit and Guarantee Insurance to extensively regulate credit and guarantee insurance except export credit insurance.

The Measures specify the scope of credit and guarantee insurance and market practices in the form of a "negative list": first, to forbid insurers from providing credit and guarantee insurance products and services for certain financing activities; second, to forbid insurers from underwriting credit and guarantee insurance in violation of insurance principles or in excess of the lending rate ceiling prescribed by the state; and third, to forbid insurers from cooperating with online lending platforms in noncompliance with the Internet finance provisions and excessively underwriting credit and guarantee insurance for online lending platforms.

4.商务部行政处罚办法修订案征求意见

商务部近日发布通知，就《商务部行政处罚实施办法（修订草案征求意见稿）》公开征求意见。

《意见稿》规定，商务部设立行政处罚委员会，作为商务部行政处罚案件的审理机构。商务部在执行罚款、没收违法所得等行政处罚时，应当实行罚缴分离的制度。罚款及没收违法所得应由当事人就地上缴国库。

4. MOC Requests Public Comment on the Revised Administrative Punishment Measures

Recently, the Ministry of Commerce (MOC) released a notice of requesting public comment on the Measures of the Ministry of Commerce for Implementing Administrative Punishment (Exposure Draft).

According to the Exposure Draft, the MOC will set up an Administrative Punishment Committee to hear administrative punishment cases. In executing administrative punishment such as fines and confiscation of illegal income, the MOC should separate fine from payment, that is, fines and confiscated illegal income should be directly turned over to the state treasury by the parties.

5.九部委发文要求大中城市加快发展住房租赁市场

近日，住房城乡建设部会同国家发展改革委、公安部等八部门联合印发了《关于在人口净流入的大中城市加快发展住房租赁市场的通知》。

《通知》的亮点为：明确各地要搭建住房租赁交易平台；涉及诸多细则，旨在增加租房供应；政策频出，让“租房”在住有所居中也能成为常态。

5. Nine State Agencies Require Accelerated Development of the Housing Rental Market in Large and Medium-sized Cities

Recently, the Ministry of Housing and Urban-Rural Development and other eight departments including the National Development and Reform Commission and the Ministry of Public Security jointly issued the Notice of Accelerating the Development of the Housing Rental Market in Large and Medium-Sized Cities with a Net Influx in Population.

The highlights of the Notice are: the establishment of housing rental platforms by local governments; detailed rules to increase the supply of rental housing; and policies to make "renting a home" a common choice of living.

6.九部门发文严厉查处发布虚假违法保健食品广告行为

国务院食品安全委员会办公室、工业和信息化部、公安部等九部门近日发布《食品、保健食品欺诈和虚假宣传整治方案》。

针对行业乱象，方案提出，严肃查处食品广告中虚假宣传、疾病预防治疗功效宣传等违法违规行为，对食品做虚假宣传且情节严重的，依照食品安全法有关规定，由省级以上食药监管部门决定暂停销售该食品，并向社会公布；仍然销售该食品的，由县级以上食药监管部门没收违法所得和违法销售的食品，并处二万元以上五万元以下罚款。

6. Nine Departments to Strictly Punish False and Illegal Advertising of Dietary Supplements

Recently, the Office of the Food Safety Committee of the State Council, the Ministry of Industry and Information Technology, the Ministry of Public Security and other six departments jointly issued a Plan on Combating Fraudulent and False Promotion of Food and Dietary Supplements.

According to the Plan, illegal acts such as spreading false information and claiming any disease prevention and treatment effects in food advertising should be strictly investigated and punished. If the false advertising of food is serious, the food and drug regulator at or above the provincial level should decide to suspend the sale of such food in accordance with the relevant provisions of the Food Safety Law and announce it to the public. If such food continues to be sold, the food and drug regulator at or above the county level should confiscate illegal income and the food being illegally sold and impose a fine of 20,000 yuan up to 50,000 yuan on the violator.
