1.《关于办理实施“软暴力”的刑事案件若干问题的意见》发布
4月9日,最高人民法院、最高人民检察院、公安部、司法部联合印发《关于办理实施“软暴力”的刑事案件若干问题的意见》。
意见指出,“软暴力”是指行为人为谋取不法利益或形成非法影响,对他人或者在有关场所进行滋扰、纠缠、哄闹、聚众造势等,足以使他人产生恐惧、恐慌进而形成心理强制,或者足以影响、限制人身自由、危及人身财产安全,影响正常生活、工作、生产、经营的违法犯罪手段。
根据意见,“软暴力”违法犯罪手段通常的表现形式有:侵犯人身权利、民主权利、财产权利的手段;扰乱正常生活、工作、生产、经营秩序的手段;扰乱社会秩序的手段;其他符合意见规定的“软暴力”手段。
意见指出,为强索不受法律保护的债务或者因其他非法目的,雇佣、指使他人采用“软暴力”手段非法剥夺他人人身自由构成非法拘禁罪,或者非法侵入他人住宅、寻衅滋事,构成非法侵入住宅罪、寻衅滋事罪的,对雇佣者、指使者,一般应当以共同犯罪中的主犯论处;因本人及近亲属合法债务、婚恋、家庭、邻里纠纷等民间矛盾而雇佣、指使,没有造成严重后果的,一般不作为犯罪处理,但经有关部门批评制止或者处理处罚后仍继续实施的除外。
1. Opinions on Handling of Criminal Cases Involving “Soft Violence” Issued
On April 9, 2019, the Supreme People’s Court, the Supreme People’s Procuratorate, the Ministry of Public Security and the Ministry of Justice jointly issued the Opinions on Several Issues Concerning the Handling of Criminal Cases Involving “Soft Violence”.
The Opinions point out that "soft violence" refers to such illegal and criminal means as nuisance, entanglement, making noise, and gathering people to show strength in relevant places or to others adopted by offenders with the aim of seeking unlawful interests or gaining unlawful influence, which are sufficient to cause fear or panic to another person and finally psychological coercion, or to affect or restrict the freedom of the person, endanger the safety of the person and property, or affect normal life, work, production, or operation.
As specified in the Opinions, the common forms of illegal and criminal means of "soft violence" are as follows: means of infringing upon personal rights, democratic rights, and property rights, means of disrupting the order of normal life, work, production, and operation, means of disturbing public order, and other "soft violence" means consistent with the Opinions.
Under the Opinions, whoever, to forcibly collect debts unprotected by law, or for any other unlawful purpose, employ or instigate any other person to commit acts illegally depriving another person of personal freedom by means of “soft violence” which constitutes the crime of unlawful detention, or illegally intruding into others' residences, or picking quarrels and provoking troubles to the extent that the crime of intruding into a house or the crime of picking quarrels and provoking troubles is committed should generally be treated as the principal offender in joint crime; and the employment or instigation, as a result of civil conflicts such as legal debts of himself or his close relatives, marriage, family, and neighborhood disputes, without serious consequences arising therefrom, should not generally be treated as a crime, unless the employment or instigation continues to be implemented after being criticized and stopped, or handled and punished by the relevant authorities.
2.内地与香港签署仲裁程序协助保全安排
4月2日,最高人民法院和香港特别行政区政府律政司在香港特区签署《关于内地与香港特别行政区法院就仲裁程序相互协助保全的安排》。
《安排》共十三条,对保全的范围、香港仲裁程序的界定、申请保全的程序、保全申请的处理等做了全面规定。《安排》将在最高人民法院公布司法解释和香港特区完成内部程序后,同时在两地生效实施。实施后,两地法院将可通过预防性救济措施来保障仲裁裁决的顺利执行,以更加有效地维护当事人的合法权益。
2. Mainland and Hong Kong Sign Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings
On April 2, 2019, the Supreme People’s Court (SPC) and the Department of Justice of the Government of the Hong Kong Special Administrative Region (HKSAR) signed the Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the Hong Kong Special Administrative Region in Hong Kong.
With a total of 13 articles, the Arrangement elaborates on the scope of interim measures, definition of arbitral proceedings in Hong Kong, procedures for applying for interim measures, and processing of applications for interim measures, among others. The Arrangement should come into force on both sides after the promulgation of a judicial interpretation by the SPC and the completion of the internal procedures in the HKSAR. After the implementation, courts of the two places can guarantee the smooth enforcement of arbitral awards through preventive relief measures in a bid to more effectively safeguard the lawful rights and interests of parties concerned.
3.《关于进一步做好2019年农资打假工作的意见》发布
3月19日,最高人民检察院印发《关于进一步做好2019年农资打假工作的意见》。
《意见》要求,各地检察机关要积极履行职责,依法严惩农资类犯罪活动。明确以农村和城乡接合部、农资经营集散地、种养殖生产基地、菜篮子产品主产区为重点地区,以涉及假冒伪劣种子、农药、肥料、兽药、饲料和饲料添加剂、农机等犯罪为重点领域,以生产、销售伪劣产品罪,生产、销售伪劣农药、兽药、化肥、种子罪,假冒注册商标罪,非法经营罪等为重点罪名,充分发挥批捕、起诉、立案监督、审判监督等职责开展工作。
《意见》指出,各地检察院在办理农资类案件时,要注重多方借力。此外,各地检察机关对办案中发现的社会管理薄弱环节,要适时有针对性地制发检察建议,堵塞社会管理漏洞,促进农村工作的健康发展。
3. Opinions on Further Efforts to Combat Counterfeit Agricultural Materials in 2019 Issued
On March 19, 2019, the Supreme People’s Procuratorate issued the Opinions on Further Effectively Conducting the Work of Cracking Down on Counterfeit Agricultural Materials in 2019.
The Opinions require all local procuratorial authorities to actively perform their duties, and severely punish criminal activities involving agricultural materials as legally required. To be specific, they should maximize their role in the performance of duties of approval of arrest, initiation of criminal proceedings, supervision over the case acceptance, and trial supervision by focusing on such areas as rural areas and urban-rural fringes, operating and distributing centers of agricultural materials, planting and breeding production bases, and major producing areas of products included in the “Shopping Basket Project”, centering on key fields involving crimes as concerns counterfeit and shoddy seeds, pesticides, fertilizers, veterinary medicines, feeds, and feed additives, among others, and taking crimes of producing or selling shoddy products, crimes of producing or selling shoddy pesticides, veterinary medicines, fertilizers, and seeds, crimes of counterfeiting a registered trademark, and crimes of illegal business operation, among others, as key charges.
According to the Opinions, the procuratorial authorities in all regions should pay attention to seeking a joint force in handling cases concerning agricultural materials. In addition, they should prepare and issue pertinent procuratorial recommendations in due time for weak links of social administration as discovered in handling cases in order to plug the loophole in social administration and promote the healthy development of rural work.
4.《关于推进全过程工程咨询服务发展的指导意见》发布
近日,国家发展改革委、住房城乡建设部联合印发《关于推进全过程工程咨询服务发展的指导意见》。
《指导意见》从鼓励发展多种形式全过程工程咨询、重点培育全过程工程咨询模式、优化市场环境、强化保障措施等方面提出一系列政策措施。一是明确了培育发展全过程工程咨询的两个着力点。二是明确了投资决策综合性咨询的内容和方式。三是明确了工程建设全过程咨询的内容和条件。四是明确了全过程工程咨询服务酬金计取方式。
此外,《指导意见》明确了推进全过程工程咨询服务发展的部门职责分工,以及加强政府监管和行业自律的措施,确保全过程工程咨询服务持续健康发展。
4. Guiding Opinions on Promoting the Development of Whole-Process Engineering Consulting Services Issued
On March 15, 2019, the National Development and Reform Commission and the Ministry of Housing and Urban-Rural Development jointly issued the Guiding Opinions on Promoting the Development of Whole-Process Engineering Consulting Services.
The Guiding Opinions put forward a series of policy measures in terms of encouraging the development of whole-process engineering consultation in multiple forms, focusing on the cultivation of the whole-process engineering consultation modes, optimizing the market environment, and strengthening safeguard measures, among others, specifying two key areas in developing the whole-process engineering consultation, contents and methods of comprehensive consultation for investment decision-making, contents and conditions of engineering consultation throughout the whole process, and ways to calculate or charge remuneration for whole-process engineering consulting services.
The Guiding Opinions also clarify the division of duties of relevant departments in promoting the development of whole-process engineering consulting services, and the measures for enhancing government supervision and industry self-regulation in a bid to ensure the sustained and sound development of whole-process engineering consulting services.
5.《商业银行净稳定资金比例信息披露办法》发布
2019年3月4日,银保监会发布《商业银行净稳定资金比例信息披露办法》。
根据《办法》,净稳定资金比例等于可用的稳定资金与所需的稳定资金的比值,最低监管标准为不低于100%。适用净稳定资金比例监管要求的商业银行应按办法要求披露净稳定资金比例相关信息。具体包括以下两类:一是资产规模不小于2000亿元人民币的商业银行;二是经银行业监督管理机构批准,资产规模小于2000亿元人民币但适用流动性覆盖率和净稳定资金比例的商业银行。
《办法》对经银保监会根据《商业银行资本管理办法(试行)》核准实施资本计量高级方法的银行与非高级法银行在定量信息,定性信息和信息的披露频率方面提出了不同要求。同时,根据《办法》,商业银行首次披露净稳定资金比例信息时,应披露最近3个季度相关信息,未对历史数据过度追溯。
此外,《办法》还要求商业银行保证净稳定资金比例对外披露数据与监管报送数据之间的一致性;如有重大差异,应及时向银行业监督管理机构解释说明。
5. Measures for Disclosure of Information on Net Stable Funding Ratio by Commercial Banks Issued
On March 4, 2019, the China Banking and Insurance Regulatory Commission (CBIRC) issued the Measures for the Disclosure of Information on Net Stable Funding Ratio by Commercial Banks.
According to the Measures, the net stable funding ratio (NSFR) equals the ratio of available stable funds to the necessary stable funds with the minimum regulatory standard being not less than 100%. The commercial banks subject to the regulatory requirements for the NSFR should disclose the relevant information on the NSFR as required by the Measures, which includes commercial banks with the asset size of not less than 200 billion yuan, and those with the asset size of less than 200 billion yuan but subject to the liquidity coverage ratio (LCR) and the NSFR with the approval of the banking regulatory authority.
The Measures put forward different requirements for the banks approved by the CBIRC to adopt the advanced capital measurement method in accordance with the Administrative Measures for the Capital of Commercial Banks (for Trial Implementation) and the banks adopting the non-advanced method in terms of quantitative information, qualitative information, and frequency of information disclosure. The Measures also state that when commercial banks disclose information on the NSFR for the first time, they should disclose relevant information in the most recent three quarters without excessive historical data disclosure required.
In addition, commercial banks should ensure the consistency between the NSFR disclosed to the public and the data submitted by regulatory authority; if there are major differences, they should explain to the banking regulatory authority in a timely manner.
