News from Chinanews, The Medical Products Administration of Hainan Province held a press conference on the 26th 2019, announcing that from now on, the responsible person of enterprises registered in the territory within the scope of the administrative region of Hainan Province can apply for the first record of importing non-special-use cosmetics in Hainan Province.

It is reported that since November 9, 2018, the State Medical Products Administration (hereinafter referred to as NMPA) issued the "Announcement on the Implementation of Filing Management of Imported Non-Special-Use Cosmetics on a National Scale (No. 88 of 2018)" and announced that Starting from November 10, 2018, the first importing of non-special-use cosmetics will be managed by the current approval management and pilot free trade pilot zone for record management, will be adjusted to the unified national record management.


Ji Jinling, director of the Cosmetics Supervision Department of the Hainan Provincial Medical Product Administration, introduced that Hainan Province has included the management of the registration of imported non-special-use cosmetics as a key work in the implementation of the “General Plan of the China (Hainan) Pilot Free Trade Zone” by the State Council. The implementation of the filing management of imported non-special-purpose cosmetics is of great significance to improving the business environment of Hainan and advancing the construction of the Hainan Free Trade Zone (Port) and the International Tourism Consumption Center.


She introduced that after the notification filing of imported non-special-use cosmetics was implemented, the approval time was greatly reduced from 3 to 5 months to 5 working days, which greatly improved the efficiency of product importing and marketing and allowed domestic consumers to enjoy the latest global cosmetics simultaneously. In addition, the implementation of the domestic responsible person system, where the domestic responsible person assumes product safety responsibility, is conducive to the protection of consumer rights and interests.


According to Zhang Xiancheng, a staff member of the Operation Headquarters of China Exempt Group (Hainan), Hainan's duty-free shops selling cosmetics had to be imported into Hainan only after it was first imported by other Chinese ports.


According to the relevant departments of the Medical Products Administration of Hainan Province, the application filing process for the first import of non-special-use cosmetics is as follows: 


The enterprise shall entrust the domestic responsible person to log in to the “Imported Non-Special-Use Cosmetics Filing Management System” to register an account, submit electronic information materials for product filing that meet the requirements, and submit it to the Provincial Medical Products Administration Administration of the Hainan Provincial Government Service Center. The filing is completed after the electronic information is consistent with the paper information. The domestic responsible person can print the record information voucher through the system and go to the customs for importing procedures.


The domestic responsible person refers to an enterprise legal person with a registered address in Hainan Province authorized by an overseas cosmetics manufacturing enterprise to be responsible for importing and operation of products and to bear the corresponding product quality and safety responsibility according to law. 


The domestic responsible person shall establish a quality and safety system for imported non-special-use cosmetics, strengthen product traceability and quality management, assume product safety responsibilities, and ensure that the import and operation of cosmetics meet the requirements of regulations and standards. In the event of product quality and safety issues, the relevant information should be proactively disclosed to the society and recalled in a timely manner. 


Will the implementation of the filing management of imported non-special-use cosmetics, simplify import procedures, will it lower product quality and safety standards and requirements? 


"It's the exact opposite. By strengthening the supervision after the fact, the main responsibility of the company has been further strengthened." Ji Jinling, director of the Cosmetics Supervision Department of the Hainan Provincial Medical Products Supervision Bureau, said that the Medical Products regulatory department organized the review of the filing information within 3 months after the product was registered Supervision and inspection, and on-site inspection if necessary. 


In addition, it will strengthen the risk control of imported products and establish a departmental coordination and disposal mechanism. The Medical Products regulatory authorities and the customs shall deal with the problem products found in the after-event supervision in accordance with their respective functions according to law.


As DFE Founder Jason Cao explained, importing cosmetic product, from the launch date to the on-counter date at offshore duty free shop, has to follow the procedure of local (imported market) which will take 6-9 months with cost USD1500-USD1700 per item in the past practice. For make-up lines, it's really a big cost of both money and timing. The product with HP completed after 6 months is always out of season. Although beauty brands in the past few years have arranged to declare in advance according to the characteristics of the Chinese market (requesting approval), it is still often difficult to keep up with the pace of brand global listing.


The new rules make it clear that after the person responsible for the first import of non-special-use cosmetics is filed in Hainan Province, the brand can synchronize the time to the new products launch with the global plan, and even given Chinese consumers' pursuit of new products, they can give priority to launching in Hainan. 


A brand manager from LVMH Group ’s Travel Retail Team told DFE, “This is an important advantage. The optimization of the offshore duty-free importing process will be a great advantages, as offshore duty-free and airport ’s duty-free synchronization after that, brands can also consider providing exclusive new launch to form a necessary market differentiation. "

In recent years, Hainan's cosmetics imports have maintained rapid growth. According to Haikou Customs, Hainan imports of 4.82 billion yuan in the first ten months of this year, a year-on-year increase of 84.4%. It is worth mentioning that in the first three quarters of this year, among Hainan's offshore duty free shopping consumption, cosmetics consumption amounted to 5.09 billion yuan, accounting for 55%. 


DFbelieves that comparing with major airport duty-free shops in China, the supply of offshore duty-free beauty products in the past was relatively less items and time-lagging. The implementation of the new policy will greatly change the supply efficiency of Hainan offshore duty free market. It will better meet the needs of the consumption demand of island tourists and further enhances the contribution of beauty products to the island's tax exemption.
