惊魂之后,7百多原油宝投资人着手集体起诉中国银行

投资人贾伟(为保护被报道人隐私,本文使用化名)炒原油期货栽了,买入中国银行原油宝成为了噩梦的开始!全仓进入的贾伟,经历了“失控”96小时;而一帮投资人在建聊天群惊魂48小时后,已准备诉讼。

贾伟称,4月20日下午5点左右,他向中国银行拨去了一通电话询问移仓时间后,他便全仓进入。然而,中国银行后来的公告却是要以-37.63美元的价格结算,这让贾伟感觉十分气愤。连续4天时间,他在银行奔走无果后,转向求助监管部门,期待能有一个合理的处理。

原油宝投资人迅速地建起了众多维权群,其中一个群里,一个准备集体诉讼的登记表上,已有723人填写了信息。

有人赶在交易停止前买入

做投资两年多的贾伟不仅投资期货,还投资股票、基金等产品,总体来看,收益还算不错。他自认为对期货比较了解,没有想到这次在原油宝上会遭得这么惨。

据贾伟本人讲,4月14日下午两点左右,他在中国银行APP买入做多原油2005合约10手。“看到原油期货行情一直在跌,我就不断加仓买入。”记者看到,贾伟在4月14日16:33、21:17两个时间点又分别加仓11手、37手。4月15日、4月17日,贾伟仍然在加仓,共计加入110手。

其实,贾伟最开始投资原油期货并不是在中国银行,而是在工商银行。记者看到,4月15日上午9点,工商银行短信通知:北美原油产品份额价格调整后,剩余资金不足以开仓最小交易数量。他告诉每日经济新闻记者,“我是在工商银行买原油期货,但是行情大跌工商银行进行了限制仓位,然后我就试了一下中国银行的原油宝,结果发现中国银行不限制仓位。于是大部分资金就陆续买入了中国银行原油产品。”

没有想到的是,买入中国银行原油宝成为了贾伟噩梦的开始。

4月20日,原油期货仍然在下跌。贾伟称,看到这样的行情,心里有些慌了,因为担心原油继续跌被套牢,他急忙给中国银行打了一个电话,咨询是否以4月20日22:00的价格移仓?得到肯定的答案后,他再次加仓207手。令人没有想到的是,当晚5月WTI原油期货合约价格狂跌306%,首次跌至负值,CME官方结算价收报-37.63美元/桶。

关于银行客服电话告知在4月20日22:00移仓一事,贾伟并没有向记者提供电话录音,但向记者提供的电话短信截图显示,中国银行曾在周日(4月19日)通知,“将于4月20日22:00停止交易和启动移仓”,不过,“启动移仓”也没有明确是否立即移仓。

对此贾伟感到很冤,“我给他打电话的原因就是要确认是不是十点钟进行移仓,然后我进行加仓,等他们完成移仓后,我接下来的一个点位就比较好,盈利的几率就会更大。但客服也没有说2020年4月20日22:00后账户就不能进行操作了。”他告诉记者,自己还在工商银行买了原油,工商银行到指定的时间点就直接移仓了,因为当时也有短信提示,很快就直接从05合约移仓到06合约,不会影响接下来的操作。

4月21日,最让贾伟担心的一幕还是出现了:中国银行将原油保证金冻结。他打电话给中国银行上海支行咨询,对方表示,回答不了,还让打客服电话。但贾伟说他就是根据客服电话的指示才来到支行的。看到双方相互踢皮球,无奈之下只得离开。

4月22日,贾伟的原油宝账户被清零。他再次打电话向客服咨询,对方回复,“是以-37.5美金进行结算,而不是2020年4月20日22:00的价格结算”,关于此前咨询确定是以20日22:00的相关情况只能向上级汇报,但贾伟一直没有等到一个明确的说法。焦灼之下,贾伟只好再次走到中国银行一家支行咨询,但仍然一无所获。

贾伟说,让他费解的是,“中国银行原油宝的产品是有80%的强平线的(此前电话咨询,亏损到80%即平仓),也就是说我买的5万多原油,就是最大亏损也是只有4万元人民币,不可能全部亏损完还要再给中国银行补11万多元。为什么其他的银行能瞬间移仓(比如工商银行)而中国银行需要那么久的时间,最后导致的亏损还让我们投资者自己去负责?”

他向记者表示,“我对于期货还是比较熟悉的,第一点:移仓动作必须要在行情波动慢的时候,而且动作要快,因为接下来的行情是我们大家都不能预判的,工商银行就是在早上完成移仓,这个时间点美盘休市,对于客户没有多大损失,而中国银行选择在美盘交易最激烈的时候移仓,且动作很难。最要命的是(芝商所)在4月15日发布了原油可能为负数(的公告),中国银行依然不为所动,还要在交易的最后一天移仓。”

4月23日、24日,四处寻求说法无果后,贾伟开始寄希望于监管部门。他向记者表示,希望中国银行能给个说法:为什么不在4月20日22:00立马进行移仓?为什么没有工作人员事后跟我们联系并且工作人员的态度让人很难受?要求中国银行以2020年4月20日22:00的2005原油期货价格赔付他3万多元。

维权群已有723人抱团准备诉讼

4月22日12点,记者被投资人拉进了名为“中行原油”的微信维权群,在记者进群后不久,群内成员很快从几十人上升百余人。

“买了30万,要赔中行多少?”

“真的要赔啊,不可能吧?”

“为什么不给我平仓,中行有说法吗?”

群内一条接着一条的消息在刷屏,每一名入群的投资者都无法相信本以为很“稳”的中行原油宝不仅让他们本金尽失,还倒欠银行几十上百万元。

很快,微信群无法通过二维码进入,只能先来的人邀请后面的人加群。不少投资人在群内分享自己加的其他维权群,短短半小时时间,记者就被拉进三个群。

其中,最大的一个微信维权群已经达到了500人的上限。群内不断有人询问“有山东的吗?”“有广东的吗?”“拉我进深圳的群。”

也有人在群内反应,要找律师、召集媒体、准备好资料去监管部门举报,但是附和的人多,实际操作的人少。

到了4月22日下午,群内逐渐有了统一的声音:“第一阶段指导意见:1、请大家积极将受害者拉进群,2、打电话投诉中行,诉求请中行按照(20日)22时的结算价平仓,以及追究后续损失的权利。3、在各大媒体曝光中行的违规行为。4、请大家减少抱怨,积极收集有利证据。”

但是绝大多数投资人,还是无法相信自己背负了几十万元“负债”。

4月23日凌晨,虽然已经到了休息的时间,但是群里依旧有很多投资人在讨论如何维权,如何才能让中行承担应尽的责任。

“拉群目的是搜集证据,集思广益,理清思路,理性维权;请尽量减少无关聊天、情绪化表达;请有律师、宣传、财经专业背景的人士,运用自己的专业能力,提出可靠的解决方案;新入群朋友备注损失数;大家保留好手上现有的证据。”群内发布了一条又一条规范。

凌晨2:30,有投资人在群里发了自己中国银行保证金平仓亏损197万的短信,立即有人建议把钱从中国银行转走。此后,不断有投资人表示自己收到了保证金被划走的短信或微信提醒。

恐惧、气愤的情绪在群内又蔓延开来。

时间到了23日上午,此时保证金被划走已经成为了群里重点讨论的话题,从中国银行转走自己资金的人也越来越多。

团结、集体诉讼、向监管部门举报也成为群内共识。同时,维权群内开始统计表格,统计投资人姓名、所处位置、购买量、损失金额。

4月23日10点,维权群@所有人,发布了群公告:“已经对接了知名律所,对投资人‘追求全部本金’的诉求进行受理,律所服务费用为追回金额的15%左右,追回后支付;同时,需要投资人收集证据、参加填写表格。”

整整一天时间,群内不断有投资人在统计表上填了自己的信息。

4月24日,不断有投资者在群内发照片,称自己已经给监管寄了投诉信。也有投资人分享了自己的投诉信。记者注意到,截至4月24日下午16点,统计表格上已经有723人填写了自己的信息。

So by 1955, after nine years of marriage, they were looking to adopt a child. Like Paul Jobs, Joanne Schieble was from a rural Wisconsin family of German heritage. Her father, Arthur Schieble, had immigrated to the outskirts of Green Bay, where he and his wife owned a mink farm and dabbled successfully in various other businesses, including real estate and photoengraving. He was very strict, especially regarding his daughter’s relationships, and he had strongly disapproved of her first love, an artist who was not a Catholic. Thus it was no surprise that he threatened to cut Joanne off completely when, as a graduate student at the University of Wisconsin, she fell in love with Abdulfattah “John” Jandali, a Muslim teaching assistant from Syria. Jandali was the youngest of nine children in a prominent Syrian family. His father owned oil refineries and multiple other businesses, with large holdings in Damascus and Homs, and at one point pretty much controlled the price of wheat in the region. His mother, he later said, was a “traditional Muslim woman” who was a “conservative, obedient housewife.” Like the Schieble family, the Jandalis put a premium on education. Abdulfattah was sent to a Jesuit boarding school, even though he was Muslim, and he got an undergraduate degree at the American University in Beirut before entering the University of Wisconsin to pursue a doctoral degree in political science. In the summer of 1954, Joanne went with Abdulfattah to Syria. They spent two months in Homs, where she learned from his family to cook Syrian dishes. When they returned to Wisconsin she discovered that she was pregnant. They were both twenty-three, but they decided not to get married. Her father was dying at the time, and he had threatened to disown her if she wed Abdulfattah. Nor was abortion an easy option in a small Catholic community. So in early 1955, Joanne traveled to San Francisco, where she was taken into the care of a kindly doctor who sheltered unwed mothers, delivered their babies, and quietly arranged closed adoptions. Joanne had one requirement: Her child must be adopted by college graduates. So the doctor arranged for the baby to be placed with a lawyer and his wife. But when a boy was born—on February 24, 1955—the designated couple decided that they wanted a girl and backed out. Thus it was that the boy became the son not of a lawyer but of a high school dropout with a passion for mechanics and his salt-of-the-earth wife who was working as a bookkeeper. Paul and Clara named their new baby Steven Paul Jobs. When Joanne found out that her baby had been placed with a couple who had not even graduated from high school, she refused to sign the adoption papers. The standoff lasted weeks, even after the baby had settled into the Jobs household. Eventually Joanne relented, with the stipulation that the couple promise—indeed sign a pledge—to fund a savings account to pay for the boy’s college education.
