安杰业绩 | 最高法院二审重大逆转！安杰知产团队成功助力仁创公司获得发明专利侵权纠纷案胜诉

近日，最高人民法院就仁创生态环保科技股份有限公司（简称仁创公司）与北京英辉创业建筑材料厂（简称英辉建材厂）侵害发明专利权纠纷一案作出终审判决，撤销一审判决，支持上诉人仁创公司的诉讼请求。安杰律师事务所于二审阶段接受仁创公司的委托，在一审重大不利的情况下，经过充分的准备和出色的庭审发挥，成功实现逆转，获得二审胜诉。

AnJie Intellectual Property team achieved a major victory at the Supreme People’s Court. Recently, the Supreme People’s Court made the final judgement on the patent infringement case of Rechsand Ecological Environment Protection Science and Technology Co., Ltd.(“Rechsand”) v. Beijing Yinghuichuangye Construction Material Factory (“Yinghui Construction”), the court reversed the judgement of the first instance court and upheld our client’s claims. After receiving an unfavorable judgement at the first instance court, AnJie was brought on to handle the appeal and represent Rechsand at the Supreme People’s Court. With adequate case preparation and excellent court hearing performance, our Intellectual Property team successfully secured a big win for our client in the second instance trial.

案情简介

仁创公司是一家高科技创新型企业，致力于“砂产业”开发，在行业内处于领先地位。本案涉及仁创公司拥有名为 “复合透水砖”的自主创新专利，其生产出的复合透水砖产品具有耐磨性强、透水速度快、使用寿命高、高性价比等优势，深受业内欢迎，仁创公司的透水砖产品已成功运用于奥运下沉广场、西单大街，北土城地铁等大型公共场所。英辉建材厂未经仁创公司许可，擅自实施涉案专利，生产、销售透水砖产品。仁创公司为此向法院提起诉讼，一审法院经审理作出了对仁创公司不利的判决，认为英辉建材厂不侵权，驳回仁创公司诉讼请求。仁创公司在一审败诉的不利情况下，二审阶段委托安杰知产团队代理诉讼。

Rechsand is an innovative high-tech enterprise dedicated to the sand industry and has been in a leading position in the industry. This case involves a patent named “composite water permeable brick” owned by Rechsand. The composite water permeable bricks are prevailing in the industry because of the good quality and reasonable price. Yinghui Construction implemented the above patent, produced and sold the composite water permeable bricks without Rechsand’s permission. Rechsand filed a lawsuit against Yinghui Construction at the first instance court but received an unfavorable judgment. The court dismissed Rechsand’s claims and held that there was no patent infringement in this case. Under such an adverse situation, AnJie Intellectual Property team was retained to prepare for the appeal.

Former Judges Nick (Qinghui) Liu and Zhixing Chen took the lead and formed the litigation team in the second instance trial. With a comprehensive case analysis, evidence selection and preparation and moot court rehearsal, our IP litigation team formulated a well-rounded strategy and did an excellent job in the court hearing, and successfully persuaded the collegiate panel of the Supreme People’s Court to uphold Rechsand’s claims, which fully demonstrated the professionality and reliability of our IP team.
