New York lawyer Spencer Sheehan has filed more than 100 lawsuits against household names such as McDonald’s and Dr Pepper over items from soda drinks and ice cream to milk.
Mr Sheehan compared real vanilla to a Chanel handbag and the alternatives to knock-offs.
McDonald’s lawyers maintain that vanilla is a flavour, much like rocky road or tutti frutti.
Several other firms have also defended the claims by saying customers do not expect actual vanilla in their vanilla soy milk or flavoured Greek yoghurt as long as it tastes like the real thing.
But Mr Sheehan said: ‘Just because you can’t tell the difference between something real and something fake, that doesn’t make it OK.’
The same lawyer has sued firms in the past for making the Portuguese sweet bread known as Hawaiian rolls outside of the Pacific Island and over ‘carrot-cake doughnuts’ that do not come from real carrots.
Mr Sheehan told the Wall Street Journal that the lawsuits started in 2019 after he saw the can of root beer with the words, ‘Made with aged vanilla’.
He said: ‘I looked at it and said, “Yeah, I don’t think it’s correct, or completely truthful”.’
