The EU requested on Wednesday the establishment of panels at the World Trade Organization for two of its ongoing disputes related to trade restrictions and high-tech patents with China. The high-tech patents disputes concerns Standard Essential Patents(SEPs). The EU said Chinese courts had since August 2020 issued "anti-suit injunctions" that prevent European companies from seeking redress over SEPs in non-Chinese courts, and information on some important cases has not been published. The EU, who has brought the disputes to WTO twice since last year, said that if the WTO granted its request, the panel would likely be formed in early 2023, with proceedings lasting up to one and a half years. According to the report, the EU also held with the United States the third ministerial-level meeting on Monday of their Trade and Technology Council (TTC), designed to enhance regulatory cooperation and present a united front against China. “Chinese court’s ruling on global FRAND rate has sparked widespread concern among Western patentees. Fundamentally, the dispute is the fight for the pricing power of intellectual property rights.” said a person familiar with the matter.


欧盟委员会周三发表了一份声明,表示已就贸易限制和高科技专利两项内容,向世界贸易组织(WTO)提出设立专家组的请求。其中高科技专利纠纷涉及标准必要专利。欧盟称,自2020年8月以来,中国法院颁发“禁诉令”,阻止欧洲企业在非中国法院就标准必要专利纠纷寻求赔偿。此外,中国未公布部分重要SEP案件的判决信息。自去年起,欧盟已经两次就该争端诉诸WTO解决。欧盟表示,如果WTO同意其请求,专家小组可能将于2023年初成立,小组诉讼程序可长达一年半。据报道,欧盟还同时于本周一与美国举行了贸易技术理事会(TTC)的第三届部长级会议,旨在加强监管合作,形成对抗中国的统一战线。知情人士称,中国法院对全球FRAND费率的判决引发了西方专利权人的广泛担忧。这一争端的本质是西方权利人对知识产权的定价权的争夺。

Taiwan's trademark certificates to go digital from January 2023

台湾商标证书将从2023年1月起实现数字化



The Taiwan Intellectual Property Office (TIPO) has announced that it will finally offer trademark and patent applicants the option of receiving their certificates electronically from 2023. This marks another critical step for TIPO towards going green and paperless. According to TIPO’s announcement, applicants will be able to choose between an electronic or paper certificate from 1 January 2023. The option will arise upon payment of the application’s registration fee in the case of trademarks – or issue fee and first annuity in the case of patents. If an applicant initially opts for the new electronic option, they can still acquire a traditional paper certificate on payment of a second fee at a later date. However, it will not be possible to proceed the other way around. The electronic certificate will be issued in downloadable PDF format to applicants upon receipt of TIPO’s notice of issuance. It will feature fraud-proof designs alongside a QR code that will link to TIPO’s webpage and show up-to-date information on the trademark or patent. While it is unclear how long this two-track system will last, many believe that TIPO’s ultimate goal is to eliminate the paper copy option altogether.

EU Unified Patent Court Now Won't Launch Until June

欧盟统一专利法院开放时间再次延期至明年6月



The EU Unified Patent Court has again postponed its planned opening from April 1 to June 1 next year, saying Monday that it wanted to give patent applicants additional preparation time to equip themselves with the authentication tools they will need to use the case management system(CMS), the digital platform which enables users to file documents with the court. Access to the CMS is via smart cards issued through EU Trust Service Providers. The UPC website provides a link to a list of organizations issuing the required smart cards. However, “it seems that there have been problems with these providers. In view of these problems, the launch of the UPC has been delayed in order to give users more time to obtain the required access tools,” according to insiders. At the same time, the UPC confirmed in a statement that it expects no further delay and all other aspects of the preparatory work including appointment and training of the UPC Judges were all proceeding to schedule, and would not cause the opening of the court to be delayed.

Huawei and OPPO Sign Global Patent Cross-licensing Agreement

On Dec 9, Huawei and OPPO announced the signing of a global patent cross-licensing agreement, which covers standard essential patents(SEPs), including 5G. "After more than 20 years of continuous innovation, Huawei has developed multiple high-value patent portfolios in the global marketplace in domains like 5G, Wi-Fi, and audio/video codecs," said Huawei. According to industry insiders, Huawei is a major contributor to 5G SEPs, and OPPO has also contributed its share in the field of wireless standards. The signing of the agreement between the two sides is a positive signal of China's intellectual property protection system to become mature and is conducive to the sound development of China's domestic innovative technology market. It is reported that in 2022, nearly 20 global manufacturers in the field of smartphones, smart cars, and IoT industries with about 350 million 5G phones and 15 million connected vehicles will be licensed by Huawei.

Nokia smartphone maker HMD files EU antitrust complaint against VoiceAge EVS

Nokia smartphone maker HMD has filed a complaint to EU antitrust regulators last Thursday against VoiceAge EVS's patent practices and royalty rates, according to a statement on the company’s website. "VoiceAge EVS’ royalty rates, as available on its website, exceed the average royalty rates actually collected globally by almost all far larger licensors. HMD seek the authorities to intervene in issues such as over-standardization, requirements for open standards and apparent non-FRAND demands and behaviour," the company said. According to the report, HMD and VoiceAge EVS are also fighting in courts in Germany, the United States and Brazil over various patents for technology related to voice calls.

Pfizer, BioNTech countersue Moderna over COVID-19 vaccine patents

Pfizer Inc and its German partner, BioNTech SE, fired back at Moderna Inc on Monday in a patent lawsuit over their rival COVID-19 vaccines, seeking dismissal of the lawsuit in Boston federal court and an order that Moderna's patents are invalid and not infringed. Moderna first sued Pfizer in August, accusing the company of violating its rights in three patents related to innovations that Moderna said it pioneered before the COVID-19 pandemic. In its lawsuit, Moderna asked for an undisclosed amount of money damages. Pfizer's vaccine made over $26.4 billion for the New York-based company in the first nine months of 2022, while Moderna sold over $13.5 billion worth of its vaccine over the same period, according to company filings with the U.S. Securities and Exchange Commission.

Nike Sues Competitor, Alleging Sale of Knockoff Sneakers

Nike has filed a lawsuit in the Central District of California against Gnarcotic LLC over its Dunk sneakers. Nike accuses the defendant of trademark infringement, false designation of origin, and unfair competition. It is reported that Nike reached out to Gnarcotic in July of this year. Nike said that “Since notifying Gnarcotic of its infringement in July of this year, Nike has attempted to reach a resolution with Gnarcotic. Gnarcotic made representations that it would cease selling products that infringe Nike’s intellectual property.” However, Gnarcotic allegedly continued to violate its trademarks. Nike therefore seeks an injunction, monetary compensation, as well as any profits made from the alleged trademark violations.


耐克在加州中区对Gnapal有限责任公司提起诉讼,指控其侵犯耐克Dunk运动鞋的商标、提供虚假原产地信息、进行不公平竞争等。据悉,耐克在今年7月联系了Gnarcotic,Nike表示,“自从今年7月通知Gnarcotic侵权以来,耐克一直试图与该公司达成和解。Ganapol表示将停止销售侵犯耐克知识产权的产品”。然而,Gnarcotic一再继续侵犯其商标。因此Nike请求法院下达禁令。Nike同时要求金钱赔偿,以及因涉嫌侵犯商标而获得的任何利润。

French watchdog orders Amazon to pay $3.5 mln in penalties

A French watchdog has ordered U.S. e-commerce giant Amazon.com to pay 3.3 million euros ($3.5 million) in penalties for failing to modify contractual provisions related to third-party sellers by the deadline it set, the watchdog said on Wednesday. France's DGCCRF consumer fraud watchdog said in a statement Amazon had been ordered to make the changes, aimed at correcting imbalances in contractual terms between Amazon's online marketplace and third-party sellers, by March 22. "we disagree with the DGCCRF on its findings, decisions and related penalty, and are challenging each of them in court," Amazon said in a written statement.


法国一家监管机构周三表示,已下令美国电子商务巨头Amazon.com支付330万欧元(约合350万美元)的罚款,原因是其未能在规定的最后期限前修改有关第三方卖家的合同条款。法国DGCCRF消费者欺诈监管机构在一份声明中表示,亚马逊已被命令在3月22日之前做出这些改变,旨在纠正亚马逊在线市场和第三方卖家之间合同条款上的失衡。亚马逊在一份书面声明中表示:“我们不同意DGCCRF的调查结果、决定和相关处罚,并将在法庭上提出挑战”。

This case is China's first foreign-related IP dispute case in which an overseas dispute resolution institution participates and which is successfully settled through the mediation under the cooperation between Pudong Court and WIPO Arbitration and Mediation Shanghai Service. Pudong Court and WIPO Arbitration and Mediation Shanghai Service have carried out in-depth cooperation on dispute resolution of foreign-related IP case, fully explained the contents of entrusted mediation work to Chinese and foreign parties in the mediation process, and established a good communication channel among the Parties and the international mediation organization, thus securing the effect of resolving the foreign-related IP dispute.


本案系浦东法院通过与WIPO仲调上海中心合作,成功调处的全国首例境外争议解决机构参与调解的涉外知识产权纠纷。浦东法院与该中心就涉外知识产权案件的纠纷化解工作开展深度合作,在调解过程中向中外当事人充分释明委托调解工作内容,在当事人与国际调解组织间建立了良好的沟通渠道,确保了涉外知产纠纷处理效果。
