China ranks first in 2021 new patent grants, topping in 29 fields

Visual Capitalist recently summarizes the 2021 WIPO data that showcases which countries were granted the most new patents, along with their sector categorizations. According to the chart, out of 1,608,375 patent grants in 2021, 88% were issued to applicants from just 6 countries. China tops the chart with 607,758, accounting for 38%. In terms of sectors, China topped the chart in 29 out of 36 total fields including computer technology, electrical machinery, and digital communication. The United States came in second with 286,205 granted patents by origin. The U.S. also topped four fields of its own: medical technology, engines and turbines, basic communication processes, and unknown (for inventions that can’t be assigned to a specific field). Not far behind is Japan with 256,890 granted patents. It dominated the other nations in the fields of semiconductors, optics, as well as furniture and games, cementing its well-earned reputation of technological innovation.

Patent filings up 13.6% in India in FY22

India witnessed a significant increase in patent filings in FY22 with a 13.6 percent growth rate (year-on-year), the highest annual increase in the last decade, a report showed on Wednesday. Further, the year witnessed a rise in the share of domestic filings to 44.4 percent of total patents filed, compared to 41.6 percent in FY2021. Out of the 584,000 patents filed in India between FY2010 and FY2022, as many as 266,000 were from the technology domain, and 160,000 of these technology patents were from emerging technologies like AI, IoT, big data, cybersecurity and Blockchain. Of the total patents filed in the telecommunications sector, around 2.4 percent were related to emerging areas such as 5G and 6G.

US Supreme Court rejects computer scientist's lawsuit over AI-generated inventions

The U.S. Supreme Court on Monday declined to hear a challenge by computer scientist Stephen Thaler to the U.S. Patent and Trademark Office's refusal to issue patents for inventions his artificial intelligence system created. The justices turned away Thaler's appeal of a lower court's ruling that patents can be issued only to human inventors and that his AI system could not be considered the legal creator of two inventions that he has said it generated. Thaler told the Supreme Court that AI is being used to innovate in fields ranging from medicine to energy, and that rejecting AI-generated patents curtails American patent system's ability to optimally stimulate innovation and technological progress. Thaler has also challenged the U.S. Copyright Office's decision to deny copyright protection for art his AI created.

USPTO denies Open AI’s appealing request to speed up trademarking “GPT”

The U.S. Patent and Trademark Office denied Open AI’s appealing request to speed up the process of trademarking “GPT”  just last week, according to news released by Gizmodo. In December 2022, OpenAI applied to register a number of trademarks such as “GPT” and “ChatGPT” with the United States Patent and Trademark Office (USPTO). Another application for “GPT-4” followed in March 2023. The company has also submitted an application to expedite the procedure due to the ever-increasing number of GPT-named AI apps. However, the USPTO rejected the application as OpenAI's attorneys were unable to provide evidence to justify the need for expediting the procedure.


据Gizmodo报道,美国专利商标局上周拒绝了OpenAI要求加快“GPT”商标注册程序的上诉请求。2022年12月,OpenAI向美国专利和商标局(USPTO)申请注册一系列商标,包括“GPT”和“ChatGPT”。今年3月,OpenAI又提出了“GPT-4”的注册申请。由于以“GPT”命名的人工智能应用程序数量不断激增,OpenAI还提交了一份加快程序的申请。然而,USPTO拒绝了该申请,因为OpenAI的律师无法提供证据来证明加快程序的必要性。

Mercedes sued Lenovo for infringing its three-pointed star trademark

Mercedes-Benz Group AG filed a federal trademark lawsuit in the US District Court for the Eastern District of North Carolina last Tuesday against Lenovo Inc., alleging unlicensed usage of the three-pointed star in Lenovo' s Legion series of personal computers. Mercedes calls the Legion logo "confusingly similar" to its logo, as both feature a three-pronged star enclosed in a circle. According to court documents, this is detrimental to Mercedes because the two products travel in the "channels of commerce that overlap," referencing Mercedes' usage licenses with e-sports and gaming companies. Mercedes said it "seeks injunctive and monetary relief for trademark infringement, dilution, and unfair competition."

Hermes settles Skechers patent lawsuit over shoe soles

French luxury fashion house Hermès International SCA has settled a lawsuit brought by Skechers USA Inc that claimed Hermès sneakers infringed Skechers' patent rights, according to a Wednesday filing in Manhattan federal court. The filing said the two sides signed a confidential settlement agreement on Monday. California-based Skechers sued Hermès last year, alleging its Eclair and Envol sneakers infringe two Skechers design patents covering the undulating "Massage Fit" soles in its "Go Walk" walking shoes. Skechers said the soles of Hermès' shoes were "substantially the same" as its soles and requested an unspecified amount of money damages. Skechers has also sued Fila, Reebok, Steve Madden and other shoemakers in the past for infringing "Go Walk" design patents, in cases that later settled.

UK blocks Microsoft's $69 billion Activision deal over cloud gaming concerns

Britain will block Microsoft's $69 billion acquisition of "Call of Duty" maker Activision Blizzard over concerns it would hinder competition in cloud gaming, dealing an unexpected blow to the biggest-ever deal in gaming. The country's antitrust regulator said on Wednesday that Microsoft's commitment to offer access to Activision's "Call of Duty" franchise to leading cloud gaming platforms would not effectively remedy its concerns. Microsoft's president Brad Smith said in a statement the company remained fully committed to the acquisition and would appeal the decision, while Activision said it would "work aggressively" with Microsoft to reverse it. According to the report, Europe will decide on the Activision deal by May 22. The U.S. Federal Trade Commission is also seeking to block it.

Triller to pay Sony Music $4.5 million in US music rights case

According to news on April 27, Triller Inc has agreed to pay Sony Music Entertainment more than $4.5 million to resolve claims that Triller breached an agreement covering its use of musicians' songs on the platform, according to a Wednesday filing in Manhattan federal court. Sony Music said Triller admitted to liability and would pay the amount it owed under their contract plus interest. The label asked the court for a final judgment on the claim immediately, citing concerns about Triller's ability to pay. " Sony Music sued Los Angeles-based Triller last August, claiming it had not made any payments since that March under a 2016 content-distribution agreement.

The court comprehensively took into consideration the circumstances, nature and harmful consequences of the offense and crime of each defendant, sentenced the several defendants to substantial punishments, and found that they had constituted crimes as organizations and sentenced them to fines, which has vigorously stricken the illegal and criminal acts of selling counterfeit masks of registered trademarks and seriously disrupting the normal order of pandemic prevention and control and social order, safeguarded the overall situation of pandemic prevention and control, economic and social development and people's health, and achieved good social and legal effect.


本案系涉疫情案件。法院结合各被告人的违法犯罪情节、性质及危害后果等因素,对多名被告人判处实刑,并认定构成单位犯罪、判处罚金,有力打击了售卖假冒注册商标的口罩、严重破坏正常防疫秩序和社会秩序的违法犯罪行为,保障了疫情防控、经济社会发展和人民群众健康生活的大局,取得较好的社会效果和法律效果。


This case was selected as one of the "Top Ten Typical Cases of Judicial Protection of Intellectual Property Rights of Jiangsu Courts in 2020".
