法官,您再好好审审吧,判得太轻了

2021年2月1日晚,南京,正值下班高峰时间,一名年轻女子因为在地铁门口摆摊,东西被城管没收了。女子抱着城管号啕大哭,边哭边哀求。女子被没收的东西并不多。但这也许就是她今年春节希望的一部分。否则,她绝对不会在众目睽睽之下,如此失态地痛哭。
 
同样是春节前,今日头条,一条短视频。说的是一个人去金店抢劫,得手后却不逃。反而让店员报警。原来他抢劫的目的就是为了过年去坐牢。因为,这年,在外面他确实是没办法过了。 

养尊处优的那些先生们永远想像不到老百姓们的生活究竟艰难到了什么程度。当然,穷人们也想像不到富人们的生活究竟奢靡到了什么程度。尽管我们生活在同一个年代,同一个空间。但是,贫富之间的差距已经远远超越了我们的想像。 

正常情况下,绝对不会有人做梦都想着要去坐牢,而且还特别想多坐几年牢。但是,这一切却确确实实地发生了。百度一下,这样的案例近年来时有发生。没有了自由,生命是毫无价值的。但是,到底是什么原因把一个人生生逼到了想去坐牢的地步?自由什么时候变得如此廉价?这绝对是前所未有的事。纵然有一万个树人也无法写出这其中的悲伤! 

湖南省衡阳市祁东县灵官村有个老人名叫付达信。他做梦都想去坐牢。因为他的生活太艰难了。付达信5岁时父亲去世,后来母亲也去世了。由于家里生活比较困难,付达信一辈子都没有结婚。付达信有个80多岁的二哥跟他同村务农,日子过得也非常艰难。


因为岁数大了,干不动农活,付达信将村里分给他的八分地退了回去。当然,这八分地不退回去也养不活他。对农村了解的朋友都知道这八分地每年需要投入多少,只能产出多少。为了养活自己,付达信批发烤烟丝和小鱼虾加工后再出售,每天可以挣两三元钱。但是,如果卖不掉,那是要亏本的。 

由于生活太艰难,付达信于2003年找到县民政局反映自己的困难。到 民政局后他才知道自己是五保户,而村里一直给每个五保户发放补助。不过,给五保户发放补助是正能量,如果追问在付达信去县民政局前为什么没有 收到补助就是负能量了。于是,打住。 


从县民政局回来后,付达信每年可以领到300元的补助,到2007年涨到了600元。不过,一年600元平均下来每天也就1.6元。这1.6元能干什么,大家都很清楚。于是,对于付达信而言,生活就是一场苦难,尽管他是一名光荣的五保户。 

付达信的生活贫困 到了什么程度?村里给各家各户安装电表通电,而付达信拿不出600元装电表的钱,因此他家是不通电的。有急事时就点蜡烛。不过,付达信很少点蜡烛。因为“那东西太贵,比吃饭还贵。”。而且,截止付达信抢劫时,付达信已经两年没有吃上肉了。 

活不下去啊!付达信曾经在报纸上看到过一则新闻:一个病人为了治病,犯罪入狱,在监狱中实现了病有所医。于是,付达信准备坐牢,去监狱实现老有所养。他坚定地认为,坐牢肯定比自己现在的生活强。于是,付达信准备去北京实现自己坐牢的远大理想。他捡垃圾卖钱买车票。实在没钱时就逃票,辗转到了天津,最后终于到了北京。 

一开始他是想抢一个警察的。他看到那个警察在买矿泉水,他认为如果抢警察,警察可以直接把他带进牢房。一条龙服务,比较省事。结果,因为他年纪大了,又饿得头昏眼花腿发软,结果没等到他走到跟前 ,那个警察已经买好水转身离开了。 

他第一次成功抢劫的是一个女人。当时那个女人手上拿着几百元钱在北京站售票窗口排队买票。付达信拿出一把水果刀(因为这把水果刀特别小,付达信后来一直被狱友们嘲笑),从那个女人手上抽出了一百元。那女人回头一看,只见瘦小干枯的付达信站在她的身后,手里攥着缺了一个角的百元钞票,笑眯眯地对她说:“你喊抢劫。”“神经病!”中年妇女认为碰上了一个神经病,自认倒霉嘟囔着转身继续排队。“我当时这个气啊,想她怎么不喊啊,如果一喊,警察来了不就行了嘛。”付达信说。第一次抢劫钱抢到了,但人却没能进去,付达信失败了。 


付达信第二次抢劫的是一个女大学生。失败是成功之母。汲取第一次抢劫没有被抓进去的沉痛教训。付达信这一次用手紧紧拉着那个女大学生的双肩包坚决不肯松手。嘴里还不停地嚷嚷着:“把包给我”。那个女大学生一开始以为这个风一吹就要倒的干瘦老头是和自己 开玩笑的。但看到付坚决不肯松手,而且手上还紧紧握着一把小小的水果刀后才报了警。警察来了后把付达信带走了。付达信成功了。他终于如愿以偿。让我们为付达信的成功而欢呼!审问时,付达信要求办案民警把自己的罪行写得严重些,“希望能够多判几年”。他非常期待在监狱开始他“不愁吃不愁穿”的“好日子”。
 
然而,他失望了。法官最终只判了他2年有期徒刑并处6000元罚金。法院认为,由于意志以外的原因付达信抢劫并未得逞,是犯罪未遂,而且归案后认罪态度较好,因此法院依法对其减轻处罚。听到判决结果,付达信失望极了。他不断哀求法官:“法官,您再好好审审吧,判得太轻了。”


法官当然不会听他的。于是付达信决定出狱后:“实在不行就再抢劫,然后再回监狱里养老”。付达信说,他知道这样不好,应该靠劳动养活自己,不应该给政府添麻烦,但是他已经69岁了,实在干不动高强度、重体力的农活了。如果他在企业,60岁就可以退休安享晚年了。但是现在,他69岁了还要为每天的生计而发愁。别说他每年有600元的五保户补贴,给你600元,让你生活一年试试?! 

在牢中的付达信是非常幸福的。他不愁吃,不愁穿。一日三餐居然能吃饱饭了,在牢中,他还吃到了两年以来的第一顿肉。吃肉时他将肉含在嘴里一点点地嚼,让整个口腔里充满肉的味道,一个劲地吧唧嘴,舍不得咽下去。他每次吃饭时都是一小口一小口地吃,像吃黄金一样弥足珍贵。 

付达信的脸色逐渐红润了起来。短短3个多月,他就胖了10斤。在监狱中,付达信居然还吃到了甜酒冲鸡蛋。这是他出狱后经常向本村老人炫耀的资本。因为这些老人别说吃甜酒冲鸡蛋,他们连看都 没有 看到过。对于付达信来说,监狱中的日子简直美极了。付达信说:“我很知足,希望这样的日子能够长一些。” 

更重要的是,在监狱中,付达信终于享受到了免费的医疗保健。他在监狱中做了有生以来的第一次体检。体检结果是“脑血管硬化、骨质增生、双肾结石、前列腺炎。”平时付达信生病了随时可以到狱内医院就诊,病重了还会有专人来照顾。监狱里的医院看不好时,还可以去监狱外面的大医院诊治。这是付达信坐牢前做梦也想不到的美事。这一切,在监狱中终于全部实现了。而他在监狱外时,生病了全是熬。熬得好,一场病过去了。熬不好,一辈子就过去了。 

在监狱里,付达信感受到了久违的温暖,重燃了对生活的希望。对于付达信这样老无所养的穷人而言,监狱简直就是他们梦中的天堂。所以,狱中的付达信总是希望时间过得慢些,再慢些。让他在监狱中的幸福变得更悠长一些。但是,好景不长,付达信被减刑了,尽管付达信根本不愿意接受减刑。这个世界就是这样,你想坐,未必让你坐。你不想坐,未必不坐。 

一年半后,付达信提前出狱,当地政府特事特办把他送进了衡阳市祁东县灵官镇敬老院。如果不是因为“入狱养老”的事情闹得全国皆知,付达信是根本没有 资格住进敬老院的。在祁东县,大约有九成,一万名以上的五保老人未能住进敬老院。 

但是,对于 敬老院。付达信说:“这里的生活赶不上监狱。”付达信非常怀念监狱里的快乐生活,可是他已经没有体力靠抢劫再回到监狱那个“安乐窝”了。 

像付达信这样失去劳动能力却没有收入,没有积蓄,没有子女赡养,又进不了敬老院的高龄老人全国有多少?和企业员工一样,他们在不同的岗位,用不同的方式同样为社会奉献了一辈子。至少他们曾经也是消费者。只要是消费者他们就是纳税人。


像付达信这样的农民,没有他们价格低廉的粮食,我们得去喝西北风填饱肚皮。喝西北风还得起早呢!现在他们老了,失去劳动能力了,没有收入,没有积蓄,没有子女赡养,又进不了敬老院,你让他们如何活下去?靠他们享受的目前每月大约二百至五六百元的低保?而且低保是不保病的。何况截至2018年6月底,全国城乡只有4833.9万人纳入了低保。那些没有纳入低保的呢?他们该如何活命? 

当付达信们在生活的漩涡中苦苦挣扎时,当他们在生活的压力下痛苦地呻吟时,我们怎么能够如此心安理得?我们不能让他们美好幸福的生活只在我们的口号里和新闻中!社会财富就是一锅饭,他们得到的少了,那么一定是有人多占了。 

同样是奉献一辈子,但是我们却生生划分出了无数个森严的等级。同样是赤条条地来到这个世界上,我们却生生分出了高低贵贱。即使是低保,不同的地区也执行着不同的标准。同样的地区,城市和农村也执行着不同的标准。平等那二个字我们天天都能看到,我们天天也能听到。但是,我们却丝毫感觉不到! 

还记得四川三台县那个78岁还发广告求职,每月一千,管吃管住就行的丁奶奶吗?还记得山东潍坊那个56岁双腿残疾的刘兰山吗?因小儿麻痹致双腿残疾的他靠开出租车养活自己94岁的老娘。还记得哈市那个104岁的老母亲吗?她靠卖菜养活自己 和生病的儿子。还记得75岁的李方印吗?他是华山年龄最大的挑夫…… 

给父母最好的爱就是为他们争取一个公平合理的养老机制。而让每个老人有尊严地活着则是我们这一代人不可推卸的责任。更何况,我们每个人都有衰老的那一天!

But it wasn’t his looks that got him a date with Clara Hagopian, a sweet-humored daughter of Armenian immigrants. It was the fact that he and his friends had a car, unlike the group she had originally planned to go out with that evening. Ten days later, in March 1946, Paul got engaged to Clara and won his wager. It would turn out to be a happy marriage, one that lasted until death parted them more than forty years later. Paul Reinhold Jobs had been raised on a dairy farm in Germantown, Wisconsin. Even though his father was an alcoholic and sometimes abusive, Paul ended up with a gentle and calm disposition under his leathery exterior. After dropping out of high school, he wandered through the Midwest picking up work as a mechanic until, at age nineteen, he joined the Coast Guard, even though he didn’t know how to swim. He was deployed on the USS General M. C. Meigs and spent much of the war ferrying troops to Italy for General Patton. His talent as a machinist and fireman earned him commendations, but he occasionally found himself in minor trouble and never rose above the rank of seaman. Clara was born in New Jersey, where her parents had landed after fleeing the Turks in Armenia, and they moved to the Mission District of San Francisco when she was a child. She had a secret that she rarely mentioned to anyone: She had been married before, but her husband had been killed in the war. So when she met Paul Jobs on that first date, she was primed to start a new life. Like many who lived through the war, they had experienced enough excitement that, when it was over, they desired simply to settle down, raise a family, and lead a less eventful life. They had little money, so they moved to Wisconsin and lived with Paul’s parents for a few years, then headed for Indiana, where he got a job as a machinist for International Harvester. His passion was tinkering with old cars, and he made money in his spare time buying, restoring, and selling them. Eventually he quit his day job to become a full-time used car salesman. Clara, however, loved San Francisco, and in 1952 she convinced her husband to move back there. They got an apartment in the Sunset District facing the Pacific, just south of Golden Gate Park, and he took a job working for a finance company as a “repo man,” picking the locks of cars whose owners hadn’t paid their loans and repossessing them. He also bought, repaired, and sold some of the cars, making a decent enough living in the process. There was, however, something missing in their lives. They wanted children, but Clara had suffered an ectopic pregnancy, in which the fertilized egg was implanted in a fallopian tube rather than the uterus, and she had been unable to have any. So by 1955, after nine years of marriage, they were looking to adopt a child. Like Paul Jobs, Joanne Schieble was from a rural Wisconsin family of German heritage. Her father, Arthur Schieble, had immigrated to the outskirts of Green Bay, where he and his wife owned a mink farm and dabbled successfully in various other businesses, including real estate and photoengraving. He was very strict, especially regarding his daughter’s relationships, and he had strongly disapproved of her first love, an artist who was not a Catholic. Thus it was no surprise that he threatened to cut Joanne off completely when, as a graduate student at the University of Wisconsin, she fell in love with Abdulfattah “John” Jandali, a Muslim teaching assistant from Syria. Jandali was the youngest of nine children in a prominent Syrian family. His father owned oil refineries and multiple other businesses, with large holdings in Damascus and Homs, and at one point pretty much controlled the price of wheat in the region. His mother, he later said, was a “traditional Muslim woman” who was a “conservative, obedient housewife.” Like the Schieble family, the Jandalis put a premium on education. Abdulfattah was sent to a Jesuit boarding school, even though he was Muslim, and he got an undergraduate degree at the American University in Beirut before entering the University of Wisconsin to pursue a doctoral degree in political science. In the summer of 1954, Joanne went with Abdulfattah to Syria. They spent two months in Homs, where she learned from his family to cook Syrian dishes. When they returned to Wisconsin she discovered that she was pregnant. They were both twenty-three, but they decided not to get married. Her father was dying at the time, and he had threatened to disown her if she wed Abdulfattah. Nor was abortion an easy option in a small Catholic community. So in early 1955, Joanne traveled to San Francisco, where she was taken into the care of a kindly doctor who sheltered unwed mothers, delivered their babies, and quietly arranged closed adoptions. Joanne had one requirement: Her child must be adopted by college graduates. So the doctor arranged for the baby to be placed with a lawyer and his wife. But when a boy was born—on February 24, 1955—the designated couple decided that they wanted a girl and backed out. Thus it was that the boy became the son not of a lawyer but of a high school dropout with a passion for mechanics and his salt-of-the-earth wife who was working as a bookkeeper. Paul and Clara named their new baby Steven Paul Jobs. When Joanne found out that her baby had been placed with a couple who had not even graduated from high school, she refused to sign the adoption papers. The standoff lasted weeks, even after the baby had settled into the Jobs household. Eventually Joanne relented, with the stipulation that the couple promise—indeed sign a pledge—to fund a savings account to pay for the boy’s college education.
