王振华猥亵幼儿案,案情原本非常简单。
但是,由于王振华是有钱人,就变得非常不简单。王振华是新城控股董事长,全国劳模,“他掌控的这个商业帝国总资产高达3600亿元”。
一句古话说得好,有钱能使鬼推磨。
于是,我们就看到下面的一幕:王振华收集来了天下最豪华的律师阵容,由大名鼎鼎的法学教授陈有西领衔,果然,出手不凡,直接就为其做无罪辩护。

谁都知道,在当下的这种司法环境之下,弱者一方是非常无力的,他们没有钱没有权没有地位……只能依靠有公益心的律师出手相助,好在,国之大,总有一些坚守正义和良知的人,为弱者做最后的呐喊。
下面是受害女童代理人、上海律协未成年人权益保护业务委员会主任计时俊律师接受《中国新闻周看》采访的片段:

王振华的豪华律师团队,陈有西教授领衔的辩护方,竟然认为“五分钟内不会对女孩做那么大的伤害”,伤害一个人跟特么时间有多大关系?你们这种律师把自己的女儿扔给一个强奸犯5分钟试试,看看会发生什么?这是一个通过常识就能想明白的问题。
而且,“他们认为女孩之前有过性行为,与王振华无关”。这几乎是在赤裸裸地对受害人及家人,进行更加恶毒的伤害。这种侮辱随便放在任何一个人身上,都无法承受,无法忍受。

这个女孩,被王振华毁了一次,再被律师们,更恶毒地伤害了第二次。
我不禁想起了韩国轰动一时的“N号房”赵博士案,他通过服装模特兼职等为诱饵吸引年轻女性,拍摄性剥削视频,受害人当中包括16名未成年人。


此案震惊全国。“N号房”事件嫌犯赵主彬,恶行太重,以至于连一向不要脸的韩国律师界在关键时刻,都知道要脸了,没有一个律师愿意为其辩护。法庭指定的律师,也果断辞职。
要脸,让韩国律师界挽回了些颜面。他们以实际行动告诉世人,关键时刻,他们是要脸的。
但是,这件事情出来,不知道中国律师界有多少人羡慕这么好的机会被葬送。在这个群体中,有少数为正义挺身而出的人,也有很多衣冠禽兽,很多人渣。
对于一次能给皮条客10万元“嫖资”的王振华来说,重金购买来一个律师团队,又算得了什么?
这正是有钱人的底气。一个嫖客,一个惯犯,仅仅因为有钱,至今,对无辜的受害人,一个年仅9岁的女孩,毫无悔意,不仅毫无悔意,而且,继续冷酷地做精神上的伤害。
我知道,为坏人辩护,也是律师的职责。但是,刻意歪曲事实,冷血地伤害、凌辱被伤害的幼女,就超出了律师的底线,真的是禽兽不如了!这种恶,比王振华的恶,有过之而无不及。
也许,王振华及其律师团队,试图以这种精神上的摧残,逼死被害人和她的父母,这样,似乎就能一了百了,就能帮助恶人逃脱惩罚。我想说的是,计划再周密的恶,也难免有疏漏。
王振华恶行累累,只被判五年,已经是轻判,已经是极大的不公。


早在南宋时期,《庆元条法事类·杂门》就明确规定:“诸强奸者,女十岁以下虽和也同,流三千里,配远恶州。未成,配五百里。折伤者,绞。”

大清律例则明确规定:“奸未至十岁之幼女,斩决。”
王振华案,轻判五年,已经是对法律的践踏和羞辱,它告诉人们,在权贵可以肆意横行的时代,弱者是多么的无助。有钱人操纵法律,赤裸裸地残害弱者的把戏,人们早特么受够了!
期待正义回归,让恶人受到严惩。

王振华猥亵幼女案:

陈有西律师的辩护权已经越界

亿万富豪王振华性侵幼女案被一审法院认定罪名成立之后,为王振华作无罪辩护的陈有西律师公开发表了一份声明,在这份声明里,字里行间依然坚持认为王振华是无罪的,并表示王振华已经提起上诉,希望二审能公正判决。

看到愤怒的网友对陈有西律师一片指责,我就放心了,公愤还在,正义不死。
中国网民的整体素质是相当低下的,然而在大是大非问题上所体现出来的认知,从来没有让我失望过,这样的社会无论多么糟糕,依然有救。


法律人的思维和普通人的思维是有差距的。在很多知名律师如斯律、陈律、时律等站出来公开反对陈有西的无罪辩护时,少数人从律师的辩护权角度认为,不应当迁怒于为王振华作无罪辩护的陈有西律师。
依法为当事人辩护是律师的权利,但是任何权利都有边界,个人认为,陈有西律师已经越界了。
今天,我们就来谈谈陈有西律师辩护权越界的问题。既然是讨论,当然是一家之言,允许不同声音存在。
第一、不尊重法定程序认定的事实。

在事实认定中,有直接证据和间接证据之分,当孤立的直接证据难以认定事实时,需要间接证据相印证。因此,王振华案中必须分清直接证据和间接证据的关系。
性侵幼女案是一种特殊案件。关键直接证据只有受害女童的指认,未成年女童的言词证据是有一定证明力的,但是证明力有缺陷,这是本案事实认定的难点。在上海另一起性侵男童案中就是因为单一的未成年指认而最终认定犯罪嫌疑人无罪。
而大量的间接证据完全可以和直接证据相印证。同案犯周燕芬的供述、阴道破裂鉴定结论、监控录像、给介绍人周燕芬的转帐记录这些大量的间接证据都可以和直接证据相印证,可以从主观方面和客观方面证实王振华猥亵行为成立。
据受害女童代理律师计时俊称,王振华庭审中也承认对女童有搂搂抱抱的动作,当事供述结合其它间接证据完全可以认定为猥亵。
陈有西从事律师职业这么多年,应当对这类案件的事实认定规则非常清楚,在大量证据面前做无罪辩护,站在正义面前,请拍拍自己的良心扪心自问。

第二、荒唐的重新鉴定和专家意见。

上海司法鉴定结果是通过合法程序作出的结论,认定女童阴道撕裂,这是一份合法有效的法律文书,是认定王振华有罪的关键间接证据。
在对鉴定程序和鉴定人员没有异议的情况下,提出重新鉴定这是少数法律投机者惯用手段。北京的重新鉴定是谁提出的,有没有合法批准程序,有没有法律效力,这些问题都应该调查清楚。如果是单方面去做的重新鉴定,这里的问题又多了,一挖都是水。
所谓专家意见,我认为应当在满足三个条件下出具,一是在特殊领域,二是认定有疑点有困难,三是坚持职业道德。
对于阴道撕裂这样并非特殊领域的问题,有没有必要申请专家意见呢,在合法程序下司法鉴定结果已经出来的情况下,我认为没有必要请专家介入。在金钱控制的社会,就不靠谱的就是专家意见,在足够的诱惑下,总有一些专家会昧着良心的胡扯八道的。
主动提出重新鉴定和专家意见,这是国内一些所谓的大牌律师常用手段,企图站在权威的高度给法律施压,这样的想法是荒唐的。
第三、缺失的法律精神。
作为律师有三大职责,维护当事人的合法利益,维护法律的正确实施,维护社会公平正义。
陈有西律师作为王振华的辩护人,站在王振华的立场上说话这无可厚非,但是请尊重职业规定和法律。
美国辛普森案是一个世界经典案例,辛普森明明杀了人,最终被宣判无罪,原因是当时的办案警察作了伪证。而在王振华案件中,是在铁证如山面前辩护方又主动提出新证据以企图证实王振华无罪,这是两个性质完全不同的程序,是在扰乱法律的正确实施。
王振华身为亿万富豪,即使在看守所内依然增持股票,这种有影响力的人做出性侵幼女的恶性行为,一旦逃避法律的惩罚,将是对社会的严重伤害,纵容有权有势者为所欲为,无数未成年女童面临被性侵的危险,这哪里还能体现出社会公平正义呢。
第四、关于陈有西本人的网络评价。
陈有西是全国顶级大律师,对于法律从业者来说是充满崇拜的标杆,如果不是发生了为王振华无罪辩护这个事情,很多人依然还会崇拜他。
陈有西原本是高官的机要秘书,如果在仕途上走下去,一定会位高权重,可是他偏偏选择了做律师,并成律师集团的负责人,优秀的人干什么事情都会成功。
陈有西并不是经过普通程序从业的律师,他没有参加过司法考试,也没有法律专业背景,而是当时特殊审批的律师资格。

陈有西律师做过许多国内大案要案,最近我会重新再研究他所参与辩护的所有案件,从而全面的认识一个人,不盲目崇拜。

律师是一个良心职业,一个人的良心,就是社会的良心。

Clara, however, loved San Francisco, and in 1952 she convinced her husband to move back there. They got an apartment in the Sunset District facing the Pacific, just south of Golden Gate Park, and he took a job working for a finance company as a “repo man,” picking the locks of cars whose owners hadn’t paid their loans and repossessing them. He also bought, repaired, and sold some of the cars, making a decent enough living in the process. There was, however, something missing in their lives. They wanted children, but Clara had suffered an ectopic pregnancy, in which the fertilized egg was implanted in a fallopian tube rather than the uterus, and she had been unable to have any. So by 1955, after nine years of marriage, they were looking to adopt a child. Like Paul Jobs, Joanne Schieble was from a rural Wisconsin family of German heritage. Her father, Arthur Schieble, had immigrated to the outskirts of Green Bay, where he and his wife owned a mink farm and dabbled successfully in various other businesses, including real estate and photoengraving. He was very strict, especially regarding his daughter’s relationships, and he had strongly disapproved of her first love, an artist who was not a Catholic. Thus it was no surprise that he threatened to cut Joanne off completely when, as a graduate student at the University of Wisconsin, she fell in love with Abdulfattah “John” Jandali, a Muslim teaching assistant from Syria. Jandali was the youngest of nine children in a prominent Syrian family. His father owned oil refineries and multiple other businesses, with large holdings in Damascus and Homs, and at one point pretty much controlled the price of wheat in the region. His mother, he later said, was a “traditional Muslim woman” who was a “conservative, obedient housewife.” Like the Schieble family, the Jandalis put a premium on education. Abdulfattah was sent to a Jesuit boarding school, even though he was Muslim, and he got an undergraduate degree at the American University in Beirut before entering the University of Wisconsin to pursue a doctoral degree in political science. In the summer of 1954, Joanne went with Abdulfattah to Syria. They spent two months in Homs, where she learned from his family to cook Syrian dishes. When they returned to Wisconsin she discovered that she was pregnant. They were both twenty-three, but they decided not to get married. Her father was dying at the time, and he had threatened to disown her if she wed Abdulfattah. Nor was abortion an easy option in a small Catholic community. So in early 1955, Joanne traveled to San Francisco, where she was taken into the care of a kindly doctor who sheltered unwed mothers, delivered their babies, and quietly arranged closed adoptions. Joanne had one requirement: Her child must be adopted by college graduates. So the doctor arranged for the baby to be placed with a lawyer and his wife. But when a boy was born—on February 24, 1955—the designated couple decided that they wanted a girl and backed out. Thus it was that the boy became the son not of a lawyer but of a high school dropout with a passion for mechanics and his salt-of-the-earth wife who was working as a bookkeeper. Paul and Clara named their new baby Steven Paul Jobs. When Joanne found out that her baby had been placed with a couple who had not even graduated from high school, she refused to sign the adoption papers. The standoff lasted weeks, even after the baby had settled into the Jobs household. Eventually Joanne relented, with the stipulation that the couple promise—indeed sign a pledge—to fund a savings account to pay for the boy’s college education.
