撕裂9岁幼女阴道判五年

猥亵的何止幼女


2019年7月1日,上市公司新城控股集团董事长王振华被指控涉嫌猥亵9岁女童一经披露,震惊全国。


2020年6月16日,上海市普陀区人民法院依法不公开开庭审理,经过长达十六小时的审理,6月17日下午公开判决。



王振华被指控猥亵女童一事,众多细节在去年已经媒体披露。


周燕芬被指控为王振华物色年幼女性供其淫乐。她骗取朋友王女士的信任,谎称带小女孩到上海迪士尼游玩,实则将小的9岁,大的12岁俩女孩带到酒店。


当天,王振华来到该酒店,对9岁女童实施了犯罪,并支付了1万元现金给周某某。事发后,女童哭着给妈妈打电话,被骗的王女士连忙报警并赶到上海。根据受害女童已验伤结果,存有阴道撕裂情况,构成轻伤。
2019年7月10日,上海市普陀区人民检察院以涉嫌猥亵儿童罪依法对犯罪嫌疑人王振华批准逮捕。


2020年6月16日,上海市普陀区人民法院依法不公开开庭审理被告人王振华、周燕芬猥亵儿童案。



庭审分两天进行,整个庭审过程历时16小时。法院根据两名被告人的犯罪事实、性质、情节及社会危害程度等,经合议庭评议,当庭对被告人王振华、周燕芬作出判决:以猥亵儿童罪分别判处被告人王振华有期徒刑五年,被告人周燕芬有期徒刑四年。判决一经公开,舆论大哗。一名9岁女孩,已经被王振华伤害到阴道撕裂,竟然只被判处五年有期徒刑。


没有对比就没有轻重,网上一个经典的说词是,一个掏鸟蛋的被判决了十年,一个写黄文的判决十年,而造成9岁女孩阴道撕裂的竟然只是猥亵,而不是强奸幼女,最后只是五年!



其实对王振华的判决,在没有审判前已经有了从轻迹象。因为在定性的时候,是猥亵而不是强奸。


去年7月10日,王振华因涉嫌猥亵儿童罪被检方批准逮捕。



根据《刑法》第二百三十七条,“以暴力、胁迫或者其他方法强制猥亵他人或者侮辱妇女的,处五年以下有期徒刑或者拘役。聚众或者在公共场所当众犯前款罪的,或者有其他恶劣情节的,处五年以上有期徒刑。猥亵儿童的,依照前两款的规定从重处罚。 司法实践中:猥亵儿童罪,一般处以5年以下有期徒刑;性质恶劣的,最长可处以15年有期徒刑。 而强奸罪,最高可处以死刑。
据去年事发时众多媒体报道,周燕芬帮王振华物色幼女,这是第一起还是惯犯?从周燕芬一带就是两个女孩,留下驾轻就熟的感觉和供王振华挑选的想像空间。

在酒店一个封闭场所,造成9岁女孩阴道撕裂,究竟是猥亵还是强奸的结果?是听一面之辞还是尊重证据的还原?


到底是金钱泯灭了人性唤醒了兽性,还是财富蛊惑了正义迷失了人心?是否深究这是不是王振华一惯行径,他何以敢于如此以身犯险?
掏个鸟蛋判十年,写个黄书判十年,不是说判错了,而是应该有法必依,执法必严。
但法律面前人人平等,谁以身试法,都会受到法律同样的制裁。如果富贵阶层和普通民众,同样触犯法律,总让人感觉到法律对于普通民众更严厉,对权贵阶层更宽囿,法律的权威就会随金钱权力和地位递减。
这极不利于全民法律信仰的树立,全面依法治国的推进,还会进一步刺激对金钱和权力的贪婪。法律不能在平民面前是铜墙铁壁,在富贵面前是纸门虚掩。
真正树立起全社会的法律信仰,是要权贵阶层对法律充满敬畏。如果如此恶劣的案件,只是轻轻的五年,某个小女孩的哭泣又将会在未来某天响起。
所有有良知的都应该明白,那是祖国的花朵,我们的下一代。
救救孩子!救救孩子!
2坚决支持王振华无罪上诉

6月18日下午,新城控股原董事长王振华涉嫌猥亵幼女案王振华方辩护律师陈有西,通过个人社交平台发布声明,称王振华已经明确提起上诉,请求二审判决他无罪。



在这一瞬间,能够理解公检法的不容易啊,当然他们只要秉持法律的公正和行事的严整即可,但客观上也让人明白了,什么是里外不是人,什么是两头不讨好。


一些网民听到王振华上诉,义愤填膺,其实不必。因为如果王振华没有强奸,没有猥亵,也不是他造成阴道撕裂伤呢?那岂不是大大的冤枉。


这样的冤枉, 在一些男人身上常常发生。


一个忧郁的男人,走在僻静的小巷里,看到一个个满面愁容的失业女人,可怜巴巴地站在那里。



他自己也不过是搬红砖送外卖的苦力,些微的收入来之不易。但让他感动的是,一个面容姣好的女人,什么都不说,拿着他的手拐进了她的出租屋。


多少男人,被巨额彩礼所困,多少男人,被自己女人嫌弃。但这位菩萨般的女人,什么也不说,把他紧紧地抱在怀里,还要用身体抚慰他的心。


受人恩惠而不知回报,还算什么男人?特别看到她脸上胭脂里依稀的皱纹,他心痛之余掏出两百元钱,这时警察突然破门而入。


这怎么会是嫖娼?这明明是人间最美好的故事。故事中的女人,常常做这种好事,故事中的男人,常常帮助这些失业女人。什么?作为惯犯还要从重从严处置?


我相信王振华就遇到到如此的冤枉。通过他的辩护律师们的陈述,可以进一步确定,是大大的冤枉,王振华非但无罪,还是一位大大的慈善家,所以一定要支持他上诉。


王振华不仅是一位成功的房地产开发商,还是一位心系半边天的优秀男人,他特别对那些出身平民涉世未深的女孩子有一种天然的爱心。


从已经认定的案卷中可知,他总是默默地给那些年轻女孩子做好事,并且事了拂衣去,深藏功与名,做了好事不留名。



当然一个年轻女孩,对成年陌生男人充满戒心,所以他需要一个女人来消除疑虑,这就是本案中另一涉案人周燕芬。周燕芬时常帮王振华寻找需要帮助的对象。


这一次,周燕芬帮王振华找到了两个需要帮助的对象,一个9岁、一个12岁。王振华一看12岁的女孩年纪太小了,他是学法知法懂法的,违法的事可以做,犯罪的事不能干。


万一自己帮助了12 岁女孩,自己已是快到60岁年老体迈的爷爷了,对方年轻有力,万一感动得一定要以身相报,自己也是犯罪啊。


于是他选择那名9岁的女孩留下来,要周燕芬带着大一点的女孩去逛街。


待到周燕芬一走,他把门一关,就开始给9 岁小女孩讲《灰(da)姑(hui)娘(lang)》的童话,小女孩听得津津有味,不小心听得阴道都撕裂了。



作为上市公司老总,时间总是特别紧。王振华只讲了十分钟,就离开了宾馆。并且还给周燕芬转了十万元钱,要她转达自己的爱心。


当天晚上,小女孩告诉12岁的女孩,不是说王振华给她讲《灰(da)姑(hui)娘(lang)》,而说成了王振华是大色狼大流氓。并且打电话给妈妈,希望妈妈过来接她回家。 


第二天,小女孩听说王振华还要来给她讲童话,吓得再次打电话给妈妈,妈妈听说女儿阴道撕裂后,果断报警。


一个本来富有爱心的故事,结果被媒体渲染得完全颠倒了。王振华蒙受不白之冤,被人们谩骂,被法院判决。



王振华明明在宾馆关着门,单独跟小女孩讲了十分钟童话,并且还出资十万元表达爱心,怎么就成了猥亵呢。


至于小女孩阴道撕裂,王振华怎么知道?难道一个男人跟任何一个陌生女性在一起,都要先确认对方是否阴道撕裂?至于怀疑是王振华造成的,得有证据啊,证据在哪里?


周燕芬常常介绍年轻女孩子给王振华发生性行为,与这件事没有因果关系,何况那些性行为都是她们面对王振华爱心的回报。


特别是辩护律师陈有西,还召集了七位国内的权威法医专家、妇科专家和DNA专家,通过北京两家司法鉴定机构,对上海的门诊记录和司法鉴定意见全面否定了!不认可受害人新鲜伤痕、阴道撕裂伤和二级轻伤结论,并质疑上海鉴定机构的鉴定资格!



当然有行内人说,这是北京某些律师的惯用手法,动辄否定地方结论,还花钱请一些京城权威和机构,出具没有法律效力的书证审查和专家结论,小地方法官检察官一看估计就唬住了,只可惜这次是大上海。


唯一令人痛心的是受害人。一个单纯可爱的9岁女孩,原本打扮的漂漂亮亮,跟着自己信任的阿姨,和另一个小朋友一起前往孩子们的梦幻之都——迪士尼欢度美好时光。


然而等着她的却是一生的梦魇。案发后,女孩只要一听到“上海”二字就要哭,学习成绩从班级优秀变成倒数几名,老师并不知发生了什么事,在课堂上问她问题,常常答非所问,稍微批评孩子一句,就是眼泪汪汪。


老师专门向孩子妈妈了解情况,妈妈不知如何回答,因为她认为自己过于相信周燕芬,导致伤害发生。现在,女孩母亲已被确诊是重度抑郁。


而王振华和他的辩护律师们,都认为他无罪。也许他们知道法律的短板在哪里。


但他们应该知道,人间真正的罪过是无须法庭审判的,也并不是所有法庭审判的无罪就是真的没有罪过。如果真的有罪,认罪更是自我的救赎。


陈有西曾经给李天一、夏某做过代理律师,无一例外的都是无罪辩护。可惜的是李天一最后判得更重,夏某更是执行了死刑。


坚决支持王振华无罪上诉。

It would turn out to be a happy marriage, one that lasted until death parted them more than forty years later. Paul Reinhold Jobs had been raised on a dairy farm in Germantown, Wisconsin. Even though his father was an alcoholic and sometimes abusive, Paul ended up with a gentle and calm disposition under his leathery exterior. After dropping out of high school, he wandered through the Midwest picking up work as a mechanic until, at age nineteen, he joined the Coast Guard, even though he didn’t know how to swim. He was deployed on the USS General M. C. Meigs and spent much of the war ferrying troops to Italy for General Patton. His talent as a machinist and fireman earned him commendations, but he occasionally found himself in minor trouble and never rose above the rank of seaman. Clara was born in New Jersey, where her parents had landed after fleeing the Turks in Armenia, and they moved to the Mission District of San Francisco when she was a child. She had a secret that she rarely mentioned to anyone: She had been married before, but her husband had been killed in the war. So when she met Paul Jobs on that first date, she was primed to start a new life. Like many who lived through the war, they had experienced enough excitement that, when it was over, they desired simply to settle down, raise a family, and lead a less eventful life. They had little money, so they moved to Wisconsin and lived with Paul’s parents for a few years, then headed for Indiana, where he got a job as a machinist for International Harvester. His passion was tinkering with old cars, and he made money in his spare time buying, restoring, and selling them. Eventually he quit his day job to become a full-time used car salesman. Clara, however, loved San Francisco, and in 1952 she convinced her husband to move back there. They got an apartment in the Sunset District facing the Pacific, just south of Golden Gate Park, and he took a job working for a finance company as a “repo man,” picking the locks of cars whose owners hadn’t paid their loans and repossessing them. He also bought, repaired, and sold some of the cars, making a decent enough living in the process. There was, however, something missing in their lives. They wanted children, but Clara had suffered an ectopic pregnancy, in which the fertilized egg was implanted in a fallopian tube rather than the uterus, and she had been unable to have any. So by 1955, after nine years of marriage, they were looking to adopt a child. Like Paul Jobs, Joanne Schieble was from a rural Wisconsin family of German heritage. Her father, Arthur Schieble, had immigrated to the outskirts of Green Bay, where he and his wife owned a mink farm and dabbled successfully in various other businesses, including real estate and photoengraving. He was very strict, especially regarding his daughter’s relationships, and he had strongly disapproved of her first love, an artist who was not a Catholic. Thus it was no surprise that he threatened to cut Joanne off completely when, as a graduate student at the University of Wisconsin, she fell in love with Abdulfattah “John” Jandali, a Muslim teaching assistant from Syria. Jandali was the youngest of nine children in a prominent Syrian family. His father owned oil refineries and multiple other businesses, with large holdings in Damascus and Homs, and at one point pretty much controlled the price of wheat in the region. His mother, he later said, was a “traditional Muslim woman” who was a “conservative, obedient housewife.” Like the Schieble family, the Jandalis put a premium on education. Abdulfattah was sent to a Jesuit boarding school, even though he was Muslim, and he got an undergraduate degree at the American University in Beirut before entering the University of Wisconsin to pursue a doctoral degree in political science. In the summer of 1954, Joanne went with Abdulfattah to Syria. They spent two months in Homs, where she learned from his family to cook Syrian dishes. When they returned to Wisconsin she discovered that she was pregnant. They were both twenty-three, but they decided not to get married. Her father was dying at the time, and he had threatened to disown her if she wed Abdulfattah. Nor was abortion an easy option in a small Catholic community. So in early 1955, Joanne traveled to San Francisco, where she was taken into the care of a kindly doctor who sheltered unwed mothers, delivered their babies, and quietly arranged closed adoptions. Joanne had one requirement: Her child must be adopted by college graduates. So the doctor arranged for the baby to be placed with a lawyer and his wife. But when a boy was born—on February 24, 1955—the designated couple decided that they wanted a girl and backed out. Thus it was that the boy became the son not of a lawyer but of a high school dropout with a passion for mechanics and his salt-of-the-earth wife who was working as a bookkeeper. Paul and Clara named their new baby Steven Paul Jobs. When Joanne found out that her baby had been placed with a couple who had not even graduated from high school, she refused to sign the adoption papers. The standoff lasted weeks, even after the baby had settled into the Jobs household. Eventually Joanne relented, with the stipulation that the couple promise—indeed sign a pledge—to fund a savings account to pay for the boy’s college education.
