1. “两官”法修订

2019年4月23日，中华人民共和国第十三届全国人民代表大会常务委员会第十次会议表决通过关于修改《中华人民共和国法官法》和《中华人民共和国检察官法》的决定，修订后的《中华人民共和国法官法》和《中华人民共和国检察官法》自2019年10月1日起施行。

修订后的《法官法》共8章69条，《检察官法》共8章70条。“两官”法在落实司法责任方面作出多项规定，明确提出“法官和检察官在职权范围内对所办理的案件负责”，并设立惩戒委员会，负责从专业角度审查认定“两官”是否存在办理案件违反职责的行为。

同时，修改后的“两官”法在立法目的中增加对法官、检察官的监督，并在法官、检察官应当履行的义务中增加规定“对履行职责中知悉的商业秘密和个人隐私予以保密”，并相应规定了违反规定的法律责任。

新法分别增加“维护法官合法权益”与“维护检察官合法权益”的表述，在关于惩处对法官、检察官实施打击报复行为的规定中分别增加规定法官、检察官的“职业尊严和人身安全受法律保护”，并细化侵害法官、检察官人身权益的情形。

1. Judges Law and Public Procurators Law Revised

On April 23, 2019, the 10th Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China passed the Decision on Revising the Judges Law of the People's Republic of China and the Public Procurators Law of the People's Republic of China as revised, which will come into force as of October 1, 2019.

The Judges Law including a total of 69 articles in eight chapters and the Public Procurators Law including a total of 70 articles in eight chapters set forth several provisions on the implementation of the judicial responsibility system, under which judges and procurators should be responsible for the cases they handled within the scope of their functions and powers, and disciplinary action committees should be established to take charge of examining and determining whether judges and procurators commit any acts against duties in handling cases from the professional point of view.

Meanwhile, the revised two Laws add the supervision over judges and procurators in legislative purpose part, add provisions in the obligation part on keeping confidential all the trade secrets and personal privacy to which they have access in performing their duties, and prescribe the legal liability for violations of regulations accordingly.

The new Laws separately add such statements as “safeguarding the lawful rights and interests of judges” and “safeguarding the lawful rights and interests of procurators”, respectively add “professional dignity and personal safety shall be protected by law” to the provisions on punishing the retaliation against judges and prosecutors, and detail the circumstances of infringing upon personal rights and interests of judges and prosecutors.

2. 《关于修改〈上市公司章程指引〉的决定》发布

4月17日，证监会正式发布《关于修改〈上市公司章程指引〉的决定》，并自发布之日起施行。

此次修改《上市公司章程指引》，主要围绕存在特别表决权上市公司章程的规范、落实《公司法》关于上市公司股份回购的新规定、进一步完善上市公司治理相关要求等方面，作出8处完善。

此外，《决定》还强调证监会将继续完善上市公司治理相关规则，指导证监局、沪深证券交易所加强日常监管和自律管理。

2. Decision to Amend Guidelines on Bylaws of Listed Companies Issued

On April 17, 2019, the China Securities Regulatory Commission (CSRC) issued the Decision to Amend the Guidelines on the Bylaws of Listed Companies, effective from the date of issuance.

The Decision mainly focuses on the bylaws of the listed companies issuing shares with special voting rights, the implementation of the new provisions of the Company Law on the repurchase of shares by listed companies, and further improvement on requirements for the corporate governance of listed companies, among others.

In addition, the Decision emphasizes that the CSRC should continue the improvement on relevant rules for corporate governance of listed companies, and provide guidance to all local CSRC offices and Shanghai and Shenzhen Stock Exchanges in strengthening routine supervision and self-regulation.

3. 《加强网购和进出口领域知识产权执法实施办法》发布

2019年4月8日，市场监管总局会同公安部、农业农村部、海关总署、国家版权局、国家知识产权局等部门印发了《加强网购和进出口领域知识产权执法实施办法》。

《实施办法》针对当前网购和进出口领域侵权行为线上线下一体化运作，跨区域、链条化等特点，提出6个方面工作措施：一是依法加强执法监管；二是拓宽线索来源渠道；三是强化执法协调联动；四是大力推进行刑衔接；五是完善社会共治机制；六是建立工作保障制度。

3. Implementation Measures for Strengthening Intellectual Property Law Enforcement in the Fields of Online Shopping and Import and Export Issued

On April 8, 2019, the State Administration for Market Regulation, the Ministry of Public Security, the Ministry of Agriculture and Rural Affairs, the General Administration of Customs, the National Copyright Administration and, the National Intellectual Property Administration jointly issued the Implementation Measures for Strengthening the Intellectual Property Law Enforcement in the Fields of Online Shopping and Import and Export.

In light of the characteristics of the infringement act emerging in the fields of online shopping and import and export such as online and offline integrated operation, across regions, and chain-based development, the Measures put forward the following work measures in six aspects: strengthening the law enforcement supervision according to the law; broadening the source channels of clues; reinforcing the concerted actions in law enforcement; vigorously advancing the connection between agency law enforcement and criminal justice; improving the social co-governance mechanism; and establishing the job security system.

4. 《全国人民代表大会常务委员会关于修改〈中华人民共和国建筑法〉等八部法律的决定》发布

2019年4月23日，第十三届全国人民代表大会常务委员会第十次会议通过了《全国人民代表大会常务委员会关于修改〈中华人民共和国建筑法〉等八部法律的决定》。

第十三届全国人民代表大会常务委员会第十次会议决定对《中华人民共和国建筑法》《中华人民共和国消防法》《中华人民共和国电子签名法》《中华人民共和国城乡规划法》《中华人民共和国车船税法》《中华人民共和国商标法》《中华人民共和国反不正当竞争法》《中华人民共和国行政许可法》作出修改。

《中华人民共和国商标法》的修改条款自2019年11月1日起施行，其他法律的修改条款自本决定公布之日起施行。

4. Decision to Amend Eight Laws Including the Construction Law Issued

On April 23, 2019, the Decision of the Standing Committee of the National People's Congress to Amend Eight Laws Including the Construction Law of the People's Republic of China was adopted at the 10th Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China.

As decided at the 10th Session of the Standing Committee of the Thirteenth National People's Congress, the Construction Law, the Fire Protection Law, the Electronic Signature Law, the Urban and Rural Planning Law, the Vehicle and Vessel Tax Law, the Trademark Law, the Anti-Unfair Competition Law, and the Administrative License Law are amended.

The amendment to the Trademark Law of the People's Republic of China should come into force on November 1, 2019, and the amendments to other laws should come into force as of the date of issuance of this Decision.

5. 《关于促进国家大学科技园创新发展的指导意见》发布

3月29日，科技部、教育部印发《关于促进国家大学科技园创新发展的指导意见》。

《指导意见》要求，要牢固树立新发展理念，以培育经济发展新动能为目标，以优化创新创业生态为主线，以功能拓展和服务能力提升为着力点，强化“创新资源集成、科技成果转化、科技创业孵化、创新人才培养、开放协同发展”五大功能，通过增加科技成果有效供给，为深化大众创业万众创新，推动经济发展质量变革、效率变革、动力变革作出新贡献，有力支撑现代化经济体系建设。

《指导意见》强调，要坚持资源集成、坚持改革创新、坚持开放协同、坚持分类指导，促进国家大学科学园创新发展。为此，要围绕集成高端科技创新资源、推动科技成果转移转化、促进科技创业繁荣发展、构建开放融合发展格局、加强政策引导支持、加强组织保障等方面开展工作。

5. Guiding Opinions on Promoting Innovative Development of State University Science Parks Issued

On March 29, 2019, the Ministry of Science and Technology and the Ministry of Education issued the Guiding Opinions on Promoting the Innovative Development of State University Science Parks.

The Opinions call for efforts to firmly develop the new development concept with the aim of creating new economic growth drivers, and with the optimization of the innovation and entrepreneurship ecology as the main line, to enhance the five functions of “integrating innovative resources, transforming scientific and technological achievements, incubating science and technology startup, cultivating innovative talents, and opening the coordinated development” with the focus on function expansion and service capacity promotion, to increase the effective supply of scientific and technological achievements for deepening business startups and innovations by the general public and promoting the changes in the quality, efficiency, and momentum of economic development, and to strongly support the establishment of a modern economic system.

The Opinions stress that integration of resources, reform and innovation, open collaboration, and classified guidance should be adhered to in the promotion of innovative development of state university science parks. To this end, the work should be conducted in terms of centering on the integration of high-end scientific and technological innovation resources, promoting the transfer and transformation of scientific and technological achievements, advancing the prosperous development of scientific and technological entrepreneurship, establishing the open and integrated development pattern; enhancing policy guidance and support, and strengthening organizational guarantees.

6. 《学生资助资金管理办法》发布

4月21日，财政部、教育部等五部门联合印发《学生资助资金管理办法》。

《办法》对普通高中教育、中等职业教育、高等教育等学生资助资金的资助范围标准、资金分担、预算安排、管理监督，以及申请、评审、发放等事项作出全面系统规定。

《办法》主要修订内容包括：一是全面梳理整合14项资金管理办法，形成贯穿学生资助各环节的统一的资金管理办法。二是明确要求各地在分配相关资金时，进一步向贫困地区和贫困人口倾斜，并做好家庭经济困难学生认定工作，确保应助尽助。三是调整了部分学生资助资金中央与地方分档分担比例，适当增加中央财政的支出责任。四是要求各地建立健全全过程预算绩效管理机制，做好绩效监控、绩效评价，强化绩效结果运用，提高资金使用效益。

6. Measures for the Administration of Student Aid Funds Issued

On April 21, 2019, the Ministry of Finance, the Ministry of Education, and other three departments jointly issued the Measures for the Administration of Student Aid Funds.

The Measures comprehensively and systematically address issues concerning scope and standards, fund sharing, budget arrangement, administration and supervision, application, review, and granting of student aid funds for ordinary high school education, secondary vocational education, and higher education.

The Measures mainly include: (1) The uniform administrative measures for funds covering each link of the financial aid granted to students are formed by comprehensively reviewing and integrating 14 administrative measures for funds; (2) When allocating relevant funds, all localities should provide more support for poor areas and populations, and do a good job in the accreditation of students from families with financial difficulties, in a bid to help all students that merit assistance; (3) The ratio of sharing part of student aid funds between central and local governments in different brackets is adjusted by appropriately increasing expenditure responsibilities of the central finance; (4) All localities should establish and improve the whole-process budget performance and management mechanism, effectively conduct the performance monitoring and evaluation, and strengthen the utilization of performance results, in an effort to improve the cost-efficiency of the funding.
