劳动者自愿加班,可以向用人单位主张加班费吗?

If an employee volunteers to work overtime, can he/she claim overtime pay from the employer?

劳动者自愿加班的,要视具体情况而定。从广义的角度讲,按照法律规定,加班需要用人单位与劳动者协商,而不能强迫劳动者加班,除非存在紧急情况,从这个意义上讲,合法的加班均应该是劳动者自愿的。因此,不能以劳动者是否自愿加班作为发放加班费的衡量标准。

If an employee volunteers to work overtime, it depends on the specific circumstances. In a broad sense, according to the law, overtime requires employers to negotiate with employees, but employees cannot be forced to work overtime unless there is an emergency. In this sense, legal overtime should be voluntary.Therefore, employers should not use the employee’s voluntary overtime as a premise of overtime pay.

从狭义的角度讲,用人单位在劳动者完成劳动定额或规定的工作任务后,根据实际需要安排劳动者在法定标准工作时间以外工作的,属于典型的加班。如果用人单位未安排、未要求加班而劳动者自愿加班完成一些零星工作的,或者劳动者在工作时间内,未完成劳动定额或规定的工作任务而自愿加班完成工作的,这种情况下一般不会认定为加班,用人单位无需额外支付加班工资。

From a narrow point of view, after the employer completes the labor quota or the prescribed work tasks, the employer arranges the employee to work outside the legal standard working hours according to actual needs, which is a typical overtime work. If the employer does not arrange for overtime work and the employee voluntarily works overtime to complete some sporadic work, or if the employee voluntarily works overtime to complete the work within the working hours without completing the labor quota or the prescribed work tasks, this case is generally not will be recognized as overtime, the employer does not need to pay extra overtime pay.

实践中,部分用人单位规定,单位不允许加班,所有的加班均属劳动者自愿,用人单位无需支付加班费,即使该规定经过民主制定和公示程序,我们理解,也并不能当然的产生法律效力,还是要看劳动者加班的真实情况,毕竟,法律之所以对加班时间以及加班工资予以规定,还是基于对劳动者休息时间的保护,如果有违该立法目的的,不应获得支持。

In practice, some employers stipulate that the company does not allow overtime work. All overtime work is voluntary. The employer does not need to pay overtime pay. Even if the rule is democratically formulated and publicized, we understand that it does not of course produce legal effect. It is still necessary to look at the real situation of employees working overtime. After all, the reason why the law stipulates overtime hours and overtime pay is based on the protection of the rest time of employees. If there is a violation of the purpose of the legislation, it should not be supported.
