劳动者自行申请不缴纳社保和公积金合法有效吗?

Is it legal and effective for employees to apply to not pay the social security and provident fund?

首先,缴纳社会保险是用人单位与劳动者的法定义务及法律责任,因此劳动者和用人单位约定不缴纳社会保险的条款面临着违反法律法规强制性规定从而无效的法律后果。根据《北京市高级人民法院、北京市劳动人事争议仲裁委员会关于审理劳动争议案件法律适用问题的解答》第25条,如果劳动者自行申请不缴纳社会保险,事后以此为由要求经济补偿金的,法院仍会支持。所以建议用人单位要依法为建立劳动关系的劳动者缴纳社会保险。

First of all, the payment of social insurance is the legal obligation and legal responsibility of the employer and the employee. Therefore, the terms of the employee and the employer that agree not to pay social insurance face the legal consequences of violating the mandatory provisions of laws and regulations and thus invalidating. According to Article 25 of the "Beijing Higher People's Court and the Beijing Labor and Personnel Dispute Arbitration Commission's Answers to the Application of Laws in the Trial of Labor Dispute Cases", if the workers apply for non-payment of social insurance, they will be required to pay economic compensation on the grounds. The court will still support it. Therefore, it is recommended that employers pay social insurance for workers who establish labor relations according to law.

其次,对于公积金而言,我们所讲的公积金一般是指住房公积金,根据《住房公积金管理条例》中相关规定,住房公积金是用人单位及其在职劳动者缴存的长期住房储金,是住房分配货币化、社会化和法制化的主要形式。住房公积金制度是国家法律规定的重要的住房社会保障制度,具有强制性、互助性、保障性。因此,约定不缴纳公积金同样违法。

Secondly, as far as the provident fund is concerned, the provident fund generally refers to the housing provident fund. According to the relevant provisions of the Regulations on the Management of Housing Provident Funds, the housing provident fund is the long-term housing deposit paid by both employer and employee, which is the main forms of monetization and socialization of housing allocation. The housing provident fund system is an important housing social security system stipulated by national laws and is mandatory and mutually-supportive. Therefore, it is illegal to agree not to pay the provident fund.

只是从目前北京的司法实践看,住房公积金的纠纷暂时未列入劳动争议解决的范畴,但不代表用人单位不需要承担责任。

From the current judicial practice in Beijing, the dispute over housing provident fund is temporarily not included in the scope of labor-dispute-resolution, but it does not mean that the employer does not need to bear responsibility.
