用人单位违法终止劳动关系,劳动者可以要求继续履行或者支付经济补偿金吗?

Ifthe employer illegally terminates the labor relationship, can the employeerequest to continue to perform or pay the economic compensation?
《劳动合同法》第48条规定:“用人单位违反本法规定解除或者终止劳动合同,劳动者要求继续履行劳动合同的,用人单位应当继续履行;劳动者不要求继续履行劳动合同或者劳动合同已经不能继续履行的,用人单位应当依照本法第八十七条规定支付赔偿金。”由此可见,单位违法解除劳动合同以后,要求赔偿还是要求继续履行劳动合同的主动权掌握在劳动者手中,即如果劳动者不要求经济赔偿,就要用人单位履行劳动合同,用人单位一般应当继续履行。
Article 48 of the Labor Contract Law stipulates:If an employer violates the provisions of this Law to terminate a laborcontract, and the employee requests to continue to perform the labor contract,the employer shall continue to perform;if the employee does not require tocontinue to perform the labor contract or the labor contract cannot becontinued, the employer shall pay compensation in accordance with theprovisions of Article 87 of this Law. It can be seen that after the employerillegally terminates the labor contract, the claim for compensation or theinitiative to continue to perform the labor contract is in the hands of theemployee. That is, if the laborer does not require economic compensation, theemployer must perform the labor contract, and the employer should generallycontinue to perform.
但如果审理过程中发现劳动合同确实不具备客观履行条件的,劳动者要求继续履行,按照以下方式处理:在仲裁审理阶段,仲裁员将告知劳动者将要求继续履行劳动合同的请求变为要求用人单位支付违法解除劳动合同赔偿金等诉讼。如经仲裁员释明后,劳动者仍坚持要求继续履行劳动合同的,将驳回劳动者的请求,告知其可另行向用人单位主张违法解除赔偿金等。如经释明后,劳动者的请求变更为要求用人单位支付违法解除赔偿金的,仲裁将继续处理。在法院审理阶段,驳回劳动者的诉讼请求,告知其可另行向用人单位主张违法解除劳动合同赔偿金等。
However, if the labor contract does not meet theobjective fulfillment conditions during the trial, the employee requests tocontinue to perform, the following methods will be adopted: in the arbitrationtrial stage, the arbitrator will inform the laborer to change the request forcontinuing to perform the labor contract to require the employer to pays forlitigation, such as illegal termination of labor contract compensation. If,after being arbitrated by the arbitrator, the employee still insists oncontinuing to perform the labor contract, it will reject the employee’s request and inform him or her that he or she may separately claimcompensation for the illegal release of the employer. If, after beingexplained, the employee’s request has changed torequire the employer to pay the illegal termination of compensation, thearbitration will continue to be processed. In the trial stage of the court, theemployee's claim is rejected, and the employer may be informed that theemployer may separately claim the illegal termination of the labor contractcompensation.
