【英文专栏】用人单位安排劳动者超时加班需要承担什么样的法律责任?
What kind of legal responsibilities doemployers need to bear if employers arrange employees to work overtime?
(1)加班超时,用人单位应当按照下列标准支付高于劳动者正常工作时间工资的工资报酬:①安排劳动者延长工作时间的,支付不低于工资的150%的工资报酬。②休息日安排劳动者工作又不能安排补休的,支付不低于工资的200%的工资报酬。③法定休假日安排劳动者工作的,支付不低于工资的300%的工资报酬。
In the case of workingovertime, the employer shall pay wages that are higher than the wages of theemployee during normal working hours in accordance with the followingstandards:①If the employee is arranged to worklonger, he/she shall be paid a salary of not less than 150% of his/her normalsalary.②Employees who work on rest days and cannot be arrangedcompensatory rest shall be paid a salary of not less than 200% of their normal wages.③Employees who work on statutory holidays shall be paid not less than300% of their normal wages.
(2)用人单位不支付超时加班工资将面临如下法律风险:①劳动者可据此解除劳动合同。《劳动合同法》明确规定,用人单位未及时足额支付劳动报酬(含加班费)的,劳动者不需提前通知就可解除劳动合同,用人单位还应当向劳动者支付经济补偿。②可能面临行政处罚。用人单位安排加班不支付加班费的,劳动行政部门责令限期支付,逾期不支付的,责令用人单位按应付金额50%以上100%以下的标准向劳动者加付赔偿金。
Employerswho do not pay overtime pay will face the following legal risks:①The employee can terminate the labor contract accordingto the law. The Labor Contract Law clearly stipulates that if the employerfails to pay the labor remuneration (including overtime pay) in full and ontime, the employee can terminate the labor contract without prior notice, andthe employer should also pay the employee economic compensation.②May face administrative penalties. Where the employer arrangesovertime work and does not pay overtime, the labor administrative departmentshall order payment within a time limit. If the employer fails to pay withinthe requied time, the labor administrative department will order the employerto pay additional compensation to the employee at the standard of 50% to 100%.
(3)用人单位违反劳动保障法律、法规或规章延长劳动者工作时间的,由劳动保障行政部门给予警告,责令限期改正,并可以按照受侵害的劳动者每人100元以上500元以下的标准计算,处以罚款。
If theemployer violates related labor laws, regulations or rules and extend theworking hours of the employee, the labor administrative department will give theemployer a warning and set a deadline for the employer to correct, and may chargethe emoployer according to the standard of 100 yuan to 500 yuan per person forpenalty.
