小心！你发的每个 emoji 都有可能成为呈堂证供

今天， #微信表情符号写入判决#登上微博热搜，引起网友讨论。经检索裁判文书网，2018 年以来，全国共有 158 起以表情符号作为证据的案件，其中 2018 年 8 件、2019 年 23 件、2020 年 66 件、2021 年 61 件，增幅明显。

表情符号的表意解读具有较强主观性，缺乏统一标准，法院难以精准“翻译”当事人的真实意思。此外，同一表情符号在不同手机设备中也会存在显示差异，如苹果 IOS 系统中的“尴尬微笑”表情在安卓系统中显示为“开心大笑”，极易造成双方理解误差。

看来表情包虽然生动有趣，但涉及到关键信息，还是需要用文字来明确答复的。不过话说回来，“表情包”的英文就是 emoji 吗？其实 emoji 也有着各种各样的表现形式，包括动物、地点、物体以及表情。它们通常用来替代文本，表达某种想法或概念。Emojis coexist in all kinds of genres including animals, places, objects, and expressions. They are basically smileys and ideograms used to represent an idea or a concept without using words。
因此，emoji 代表的是真实的图像，而非文字。它们不仅可以代表普通的物体，也可以代表古怪的幽灵。Emoji represents an actual image instead of text, and they can be anything from an image of a common object to an image of a whimsical ghost。

很多人不知道，其实 emoji 最早来源于日语“絵文字”‎，e 代表“絵”‎ 也就是 picture，moji 代表“文字” 也就是 character。所以 emoji 也就顺理成章地代表了一种“图画文字”，假名为“えもじ”，读音即 emoji。

除了 emoji 之外，英语中还有哪些单词也能被叫作“表情包”呢？

01. meme

第一个，meme，它的音标就是：/mi:m/。meme 也是我们平时比较常用的一种图片表情包。

《牛津高阶英语词典》给出了 meme 的两层含义：

When a meme resonates with many people, it's spreading via social platforms, texting and more. The more a meme is spread, the greater the cultural influence it has.

当某个 meme 引起了很多人的共鸣，它就会通过社交平台、短信等方式传播，传播得越多，它的文化影响力就越大。

“an image, a video, a piece of text, etc. that is passed very quickly from one internet user to another, often with slight changes that make it humorous.” 

就可以释义为在网友之间传播速度很快的图片、视频或者段子，通常比较搞笑——这不就是我们常用的那些搞笑图片和动图嘛！

02. sticker

同样，发送 sticker 也是一种与朋友分享感受的方式。sticker 和 emoji 其实差不多，最明显的不同在于它们的尺寸更大一些。

Sending sticker is a way to share how you are feeling with your friends. Technically speaking, a sticker is just an image. One of the ways they are different to emojis is that they are larger.

此外，sticker 也不能和文字同时发送，每一个 sticker 就是一条单独的消息。
Also, they can't be placed inline alongside some text, sending a sticker counts as a single message.

03. emoticon

emoticon 则是情感 emotion 和图标 icon 两个单词的组合。这是使用字母、数字字符创建的一批特殊符号，以此来表达感受或情感。
Emoticon is a combination of two words: emotion and icon. They are a large set of ad-hoc symbols created using alphanumeric characters to best express human feelings or emotions.
