How to Fix It When You Encounter Illegal Visa Agents?

Recently, we have received many inquiries stating that their original visa agent was investigated by the police and forced to shut down, leaving their visa issues unattended.

As a legitimate visa service provider, we published an article on common tricks of illegal visa agents before, and this article lists solutions in such situations.

Replacing of business license and official seal 

If your business license（营业执照） and official seal（公章） have been detained by the police, you will need to replace them.

Procedures:

• make a newspaper declaration（登报声明）； 

• submit authentic and compliant documents for a replacement business license in State Administration of Industry（工商局） ；

• file a new engraved seal with the local Ministry of Public Security（公安部治安管理局）.

Documents to bring: 

• copy of the business license；

• passports of legal person and shareholders；

• valid visa and residence permit；

• a record of change of business license；

• original copy of the newspaper.

Dealing with financial issues

Deal with your company's financial issues as soon as possible, including tax issues, annual remittance（年度汇算清缴）, annual inspection and filing（年检申报）, etc. Change your financial service provider promptly.

Company cancelation or continue operation legally

Company cancelation:

If a company opened by foreigners in China cannot operate normally, the company needs to be canceled in time. You can refer to our previous article Serious Consequences of Not Canceling a Company Properly.

NOTE

2) Does the company have a bank account for meetings?

Continue operation:

If you choose to continue operating your company, you need to check if your company is on the blacklist of the National Enterprise Credit Information Publicity System（国家企业信用信息公示系统）.

You need to remove your company from the blacklist first and have a physical office address and record of business operation.

Proof of the company's normal operations generally include: 

1)  Fapiaos for business transactions

2)  Company bank account

3)  Proof of hiring Chinese employees

Make sure your work visa is legal

Illegal visa agents could have done the following that put your visa at risk.

• submit fake materials;

• apply for work visa in a company you don't work for;
