What to do when a foreigner's visa is overdue ?
A. Foreign adults living in China with their children who is under 18 years old, have their residence permits that are still valid but their children’s have expired.
Will it be affected?
-- Absolutely! According to regulations, guardians who cause foreigners under the age of 16 to illegally reside will be punished.
If a guardian helps a minor evade border inspections, it constitutes assisting others in illegally exiting or entering the country.
B. What should a foreign employee do if their visa expires for nearly 10 days for NOT attention tothe validity period of their Z visa upon entry?
-- First of all, according toArticle 78 of the Law of the China on the Administration of Entry and Exit,aliens who reside illegally shall be given a warning.
If the circumstances are serious, they shall be fined 500 yuan for each day of illegal residence, with a total amount not exceeding 10000 yuan, or detained for not less than five days but not more than 15 days.
However, as this visit to China is for actual work, the solution is to apply for a new STAY visa with a validity period of one month after receiving a penalty.
The validity period for entry and exit will vary from 10 to 30 days depending on the actual situation. Then apply for a work visa again.
C. If a foreigner is informed but they refused to leave the country within a specified time limit, what may be the next action?
-- Likely, to be deported!
Based on :
Article 62 of the Exit and Entry Administration Law,
foreigners may be deported if they:
a. Those who have been ordered to leave the country within a specified time limit but have NOT left within the specified time limit;
b. Those who are prohibited from entering the country;
c. Illegal residence or employment;
d.Those who violate this Law or other laws and administrative regulations and require deportation.
(Other overseas personnel who fall under one of the circumstances listed in the preceding paragraph may be deported in accordance with the law.)
D. What is the maximum time limit for foreigners to leave the country within a specified time limit?
-- The maximum time limit for leaving the country shall NOT exceed 15 days.
According to Article 33 of the Regulations on the Administration of Entry and Exit of Foreigners, if an alien is determined to leave the country within a specified time limit, the authorities making the decision shall, after canceling or confiscating their original exit and entry documents, complete the stay procedures and limit the time limit for their exit.
E. How long is it possible to re-enter our country after being deported or deported?
-- a. shall not be allowed to enter the country for one to five years from the date of deportation
according to Article 62 of the Exit and Entry Administration Law, personnel who have been deported.
-- b. According to Article 81 of the Exit and Entry Administration Law, aliens who have been expelled shall not be allowed to enter the country for ten years from the date of their expulsion.
