1. 民法典草案合体亮相

Full text of China’s Civil Code (Draft) Unveiled

24日，十三届全国人大常委会第十五次会议分组审议民法典草案。

On December 24, 2019, the Civil Code (Draft) was deliberated at group meetings at the 15th Session of the Standing Committee of the Thirteenth National People's Congress.

民法典（草案）共7编，依次为总则编、物权编、合同编、人格权编、婚姻家庭编、继承编、侵权责任编，以及附则，共1260条。

With a total of 1,260 articles, the Civil Code (Draft) consists of such seven parts as the General Provisions Part, Property Part, Contracts Part, Personality Rights Part, Marriage and Family Part, Inheritance Part, Torts Part and Supplementary Provisions. 

侵权责任编完善了高空抛物坠物责任规则，明确物业要尽安全责任。合同编规定禁止高利放贷，借款的利率不得违反国家有关规定。人格权编完善禁止性骚扰条款，明确“机关、企业、学校等”的防止性骚扰责任。婚姻家庭编草案规定一方患有重大疾病的，应当在结婚登记前如实告知另一方；不如实告知的，另一方可以向人民法院请求撤销婚姻。

The Torts Part improves the rules on liabilities for high-rise throwing or falling of objects, and clarifies that the property management company should fulfill its responsibility for safety. The Contracts Part makes a stipulation to ban the usury, stating that the interest rates of loans should not violate relevant national provisions. The Personality Rights Part consummates provisions on prohibiting sexual harassment, and specifies responsibilities of the organs, enterprises, and schools to prevent such behaviors. The Marriage and Family Part provides that the party who suffers from a serious disease should truthfully inform the other party before the marriage registration; and if he or she fails to do so, the other party may request the people's court to revoke the marriage.

此外，草案还对离婚冷静期、近亲属范围等作出规定。

In addition, the Draft also sets forth a cooling-off period before divorce and the scope of close relatives, among others.  

2. 证券法草案四审

Securities Law (Draft) Submitted to the NPC Standing Committee for Fourth Deliberation 

12月23日,证券法草案提请十三届全国人大常委会第十五次会议第四次审议。　

On December 23, 2019, the Securities Law (Draft) was submitted to the 15th Session of the Standing Committee of the Thirteenth National People's Congress for the fourth deliberation. 

《草案》主要内容包括：一、全面推行注册制，不再规定核准制，取消发审委制度。二、精简优化证券发行条件。将发行股票应当“具有持续盈利能力”的要求，改为“具有持续经营能力”。三、明确国务院统一规定资产支持证券、资管产品管理办法。四、明确证券法必要的域外适用效力。在中华人民共和国境外的证券发行和交易活动，扰乱中华人民共和国境内市场秩序，损害境内投资者合法权益的，依照本法有关规定处理并追究法律责任。五、明确投资者保护机构可提起代表人诉讼。六、将违法处罚标准提高到一至十倍，欺诈发行顶格罚2000万。

The Draft mainly includes: The first is to fully implement the registration system instead of the approval system and cancel the Public Offering Review Committee system. The second is to streamline and optimize the conditions for issuance of securities. The requirement of continuous profit-making capability is replaced by the requirement of continuous operation capability. The third is to clarify that the State Council should uniformly set forth the administration measures for asset-backed securities and financial management products. The fourth is to specify the necessary extraterritorial application effect of the Securities Law. Where any issuance or trading of securities outside the People's Republic of China disrupts the domestic market order of the People's Republic of China and damages the legal rights and interests of domestic investors, it should be handled and legal liabilities should be investigated and affixed in accordance with relevant provisions of this Law. The fifth is to make it clear that the investor protection institution may bring a representative action. The sixth is to raise the punishment standard for violation of laws by one to ten times. The maximum penalty for fraudulent issuance is 20 million yuan.

3. 社区矫正法草案三审

Community Correction Law (Draft) Submitted to the NPC Standing Committee for Third Deliberation

23日，社区矫正法草案提请十三届全国人大常委会第十五次会议第三次审议。

On December 23, 2019, the Community Correction Law (Draft) was submitted to the 15th Session of the Standing Committee of the Thirteenth National People's Congress for the third deliberation.

草案规定，使用电子定位方法的期限不得超过三个月。对于不需要继续使用的，应当及时解除；对于期限届满后，经评估仍有必要继续使用的，经过批准，期限可以延长，每次不得超过三个月。草案同时增加两种电子定位的适用情形：拒不按照规定报告自己的活动情况，被给予警告的；拟提请撤销缓刑、假释或者暂予监外执行收监执行的。

The Draft stipulates that the time limit within which the means of electronic positioning can be used should not exceed three months. Where the means no longer needs using, it should be lifted in time; and when time limit expires, where the method still needs using upon assessment, the period can be extended after being approved, but it should not exceed three months each time. The Draft also adds two circumstances under which the electronic positioning may be used: where a person is given a warning for his or her refusal to report their activities in accordance with relevant provisions; and where a proposal is raised for revoking probation or parole, or putting the person who is temporarily serving his or her sentence outside prison behind bars.

4. 多部法律草案提请全国人大常委会会议审议

Several Bills Submitted to the NPC Standing Committee for Deliberation

第十三届全国人民代表大会常务委员会第十五次会议于2019年12月23日起在京举行，本次会议对多部法律草案进行审议。

The 15th Session of the Standing Committee of the Thirteenth National People's Congress was held in Beijing on December 23, 2019, and several bills are deliberated at this Session.

《长江保护法(草案)》提请首次审议，拟由国务院建立流域协调机制。

The Law on the Protection of the Yangtze River (Draft) is submitted for the first deliberation, and it is proposed that the State Council should establish a coordination mechanism for the basins.

《基本医疗卫生与健康促进法(草案)》四审稿增加规定，公共场所应当按照规定配备必要的急救设备、设施。

The Law on the Promotion of Basic Medical and Health Care (Draft) for the fourth deliberation adds that public places should be equipped with necessary first-aid equipment and facilities in accordance with relevant provisions.

《固体废物污染环境防治法(修订草案)》二审稿增加规定：旅游、餐饮等行业应当逐步推行不主动提供一次性用品，办公场所应减少使用一次性办公用品。 

The Law on the Prevention and Control of Environmental Pollution Caused by Solid Wastes (Revised Draft) for the second deliberation adds that the tourism, catering business and other industries should gradually become less and less active in providing disposable items, and the use of disposable office products should be reduced in offices.

《森林法（修订草案）》三审稿明确森林公安机关职能范围。

The Forest Law (Revised Draft) for the third deliberation specifies the scope of functions of forest public security authorities.

此外，城市维护建设税法草案、契税法草案、出口管制法草案均提请首次审议。

In addition, the Law on City Maintenance and Construction Tax (Draft), the Deed Tax Law (Draft) and the Law on Export Control (Draft) are all submitted for the first deliberation.
